[Resolved]  ICICI Bank Limited — Cheating and breach of trust by icici bank limited

I was approached by m/s soni realtors private limited, sector-44, gurgaon through their employee/ representative with the proposal of selling to me a plot in the soni palm city, karnal, a project run by m/s soni realtors private limited, as was claimed by him. this representative of the builder had collected from me the requisite documents on behalf of builder, which he claimed were mandatory for applying for the loan from any of the nationalized/ public/ private sector banks. the ioan was finally sanctioned by the icici bank ltd. and the loan amount disbursed to m/s soni realtors private limited, sector-44, gurgaon by the bank. it is pertinent to mention that no one from icici bank either contacted me or the co-applicant during this entire process. i think it was by design that i was kept in dark during this entire process, in spite of my best efforts to ascertain the facts. the bank never made the things transparent to me, to the extent that they have not even disclosed till date, the branch of the icici bank limited that approved, sanctioned and disbursed loan and; mortgaged the said property. the builder on the other hand has not handed over to me any of the documents concerning to the said property. as my repeated requests for the site visit had evoked no response from the builder, therefore i visited the said location of the plot at karnal to have a look at the said property myself. i have not been able to locate my plot at the given address. this is a glaring example of malpractices done by builders and developers to dupe the buyers of their hard earned money in collusion with the banks. this also gives an impression that there was an implicit understanding in this case between some of the bank employees of icici bank limited and the builder to fund the latter at the cost of the icici customer, as no effort was taken by the bank even to verify the originality, correctness and authenticity of the documents submitted to them. here the document being referred to is the facility agreement, which the only document forwarded to me by the bank. serious anomalies noticed with respect to correctness and authenticity of the document have already been conveyed to icici bank limited. authenticity, correctness and originality of other documents submitted to the bank by builder and his representative are therefore not beyond doubt. to my opinion, deceptive and unethical conduct of the builder and bank calls for sternest legal action. further, this case needs to be highlighted adequately in public domain to save the probable investors from getting duped of their hard earned money due to the unholy nexus between the icici bank limited and m/s soni realtors private limited.in view of the above, it is requested that icici bank limited may be instructed to hand me over the photocopy of the documents including the tripartite agreement concerning the said land for verification by my ca and the lawyer. further, the said property has been mortgaged by the icici bank limited, which means that the bank had checked and verified the aforementioned property before disbursement of the home loan, it is therefore requested that the icici bank limited may be instructed to forward me the following details:-


(i) details, address and contact no. of the icici bank ltd which dispersed the loan.

(ii) modus operandi/ process /sop being followed by the icici bank limited for verification of land/plots before disbursement of the home loans.

(iii) details of the land verification done by the icici bank along with the date.

(iv) details of the land including its location and related documents.

(v) original title deed obtained from the owner and also the confirmation that the same has been examined in detail by the bank.

(vi) confirmation from the bank that the property is in the seller’s name. this is to validate that the seller has a right over the property.

(vii) is it a joint venture development?

(viii) name, address proof, specimen signatures and contact details of the land owner in the bank records.
(ix) endorsement from the icici bank limited confirming that the land is free from tenancy claims and does not have any legal dues.

(x) layout plan to verify whether the layout has been approved by the city development corporation and the local body.
(xi) plot nos.in south/east/west/north, land area i. e. length, breadth and diagonals mentioned in the sale deed.
(xii) tax receipts for taxes paid by the owner of the plot of land if held with the bank.
(xii) confirmation from icici bank limited that none of the documents connected with the said property submitted/ held by them are forged.
