I booked a commercial space in ILD Trade Centre developed by International Land Developers (ILD). The chairman of International Land Developers (ILD) is Mr. Alimuddin Rafi Ahmed. Their website is http://www.ild.co.in. In the agreement that we signed with them, it is clearly stated that possession will be given on 1st December 2008. But the builder keeps delaying possession. Everytime we ask them, they keep saying that it will be ready within 3 months but they always delay. This has caused us mental harassment and loss of rent. What are my options in this case? Please help.

    In April 2008 I have booked and paid Rs.4 Lacs for a flat of 1450sq ft. then I paid Rs. 1, 62, 800.00 after two months as per the terms fixed with M/s. International Land Developers (ILD) now for the last four months I have been chasing them for refund of my money i.e. Rs.5, 62, 800.00 and they are not releasing the money and give excuses that Director or concerned persons are busy / not in office.

    I request you to help us in this matter so that we can take us the whole amount with the interest.

    You should file recovery suits under Order-37 CPC in DELHI which is more effective and expeditious remedy for recovery of money rather than approaching to consumer courts, which takes lot of time.

    Do also file criminal complaint in EOW (Delhi Police) since the Registered Office of the Company is in Delhi.
