[Resolved]  Mahindra First Choice [MFCWL] — damaged car delivered

I had bought Ford Figo 2013 model (diesel) bearing from Retona Motors, Ernakulam, Keralam on 2nd December 2017. My warranty book number is WF2016 and Warranty Registration Form Number - 42070.

The car problems began to show up on my first service. I had covered 5000 kms within few months by then I had'nt received the warranty booklet, so I had to do the mandatory car service to ensure the warranty and I did at PVS Ford Service Centre, Meenchanda, Calicut (Authorised Dealer and Service Centre in Calicut). The mechanic had raised many complaints with the car. He mentioned that many of the parts are in bad condition and I have to make urgent repair works. Looping of the wiring in dash board and engine may have been carried out.

Sooner I started experiencing problems. It all started with Engine oil leak, Suspension issues, Gear box complaint, AC issue and so on goes the list. When inquired with the Warranty assist phone number (First Choice), I was told that either I should have the certificate showing ownership of the car or the warranty book.

By that time I had neither received RC nor the warranty booklet. I had been pressurising the dealer since my purchase and when I finally received the warranty booklet, I decided to inquire with the service authorised dealer.

Bosch, Sulthan Bathery, Wayanad, Kerala was the service authorised dealer near my location. So I went by him and asked to check the vehicle for oil leak and AC issues. The employer informed me that AC (switch) doesnt cover under the warranty and also no parts are available for the car, if I have to get parts I have to take the car to authorised service centre in calicut and there is no other issue with the vehicle. And he even told me that the oil leak is fixed.

But, the oil leak started again, I dont want to wait for further troubles with the car. Hence I took the vehicle to authorised service centre for Ford in calicut, Kerala. The Mechanic inspected the vehicle thoroughly and prepared a detailed estimate and parts to be replaced.

I gave my vehicle for repair on 14/07/2018 at PVS Ford and the car was delivered after covering almost all problems on 31/07/2018. The bill amount including body works came to Rs 61, 228. And my Vehicle registration was successfully completed by then. I enquired with warranty and received a claim amounting to Rs. 36, 631.

That was just the begining, I had another set of repair works by February 2019 for an amount of Rs 38, 805, which have not been reimbursed. Also, i was able to found out that the reserve/ stepney tyre provided was of some other car which doesnt fit my car.

Just after the service the car started misbehaving again. Now its with wiring, as the wiring was done from outside the company by the previous owner/dealer Iam experiencing sever difficulties while driving. Iam not able to drive reverse in car without accelerating indicating lack of power. Also, while riding uphill not enough torque is generated. When enquired with Ford First choice I happen to know that the dealer who sold me the car (Retona motors, Ernakulam) have been terminated from your contract. Then I happen to enquire with the First Choice representative regarding warranty for the vehicle as it was about to expire. He told me that engine wiring doesnt come under the warranty. So, there was no point in renewing the warranty without any use.

At present the car is in PVS Ford Service Centre, Calicut. The estimated amount including engine wiring comes around Rs. 1.50 lakh.

Now regarding the warranty terms and conditions, clause 4 - warranty is not applicable from use of non-genuine parts other than those approved by respective manufacturer. In may car, there were many parts which were not genuine and installed either by previous owner or dealer. So what happens when failure of those parts occur or serious damage (like short circuiting) occurs due to use of those parts? Isn't it the responsibility of the dealer to ensure that all the parts in the vehicle are genuine? Or to properly check the vehicle and replace damage parts before selling it to customer? The mechanic in the PVS authorised service centre told me that panels and BCM (body control module) were damaged due to the fault in rewiring which was carried out from outside. They also suspect that PCM (power control module) might be damaged as Iam experiencing power issues.
I believe there has been a fault in the Dealer (First Choice) as I was given a vehicle which was not properly checked by the dealer. I have spent more than 1 lakh on the vehicle since purchase. And its not possible for me to spend another one lakh on the same.

Hence, my proposal is either to cover the upcoming expense for the car for the current work and bumper to bumper warranty for two years from now or you can take back the car and pay me the expenses incurred till now (including the cost of car).

As per our record this vehicle was sold with one year warranty on 20th Feb 2018 & the warranty was valid for one year i.e. 20th Feb 2019 or upto 46625 Kms whichever is higher.

We regret to inform you that your vehicle warranty number WF[protected] expired on 20th Feb 2019, hence we will not be in a position to assist you for any vehicle related claim.
We have ask our service station to assist you with best possible repairing under paid basis to resolve your concern.
