Paytm — Wrong product- Goodyear DP B1 4 Wheeler Tyres (185/60 R15 84H, Tube Less)

I have ordered for four numbers of Goodyear DP B1 4 Wheeler Tyres (185/60 R15 84H, Tube Less) and it was delivered on 01.10.2015 through Gati transports. On verification it was found that the seller has sent Goodyear DP V1 4 Wheeler Tyre (185/60 R15 84T, Tube Less) instead of Goodyear DP B1 4 Wheeler Tyre (185/60 R15 84H, Tube Less) . Subsequently a complaint was made to paytm and I was requested to send the images. Accordingly the copy of invoice and images of the tyres were sent through mail on 02/10/2015. But as usual without reading the mail properly, paytm sent a mail that your request for return against this order has been accepted. Then I informed them that I did not wish to return the product. The content of the mail was "Instead of DP B1 4 Wheeler Tyre (185/60 R15 84H) tyres, the seller has sent DP V1 4 Wheeler Tyre (185/60 R15 84T) tyres. Since it will take another 20 days for me to return the product and to get new set of tyres, I have decided to retain the tyres which was sent wrongly by the seller. My request in this regard is to pay back the difference of price between the two products since seller has sent only inferior quality against my order. As far as my knowledge goes the tyre which was sent to me was Rs 500 lesser that what I have ordered. Hence kindly make arrangements to refund Rs 2000 for 4 tyres either as cash to my account or cahsback in paytm account". Inspite of my mail, the paytm was repeatedly sending the mails that your request for return against this order has been accepted and also many reminders that it has been 5 days since you placed your return request. Finally I called paytm on 07/10/2015 and conveyed my ill feelings that I did not place any request for return of product and I wanted only the MRP difference amount. Mr. Shilpi singh who attended my call put me on hold atleast for 30 minutes saying that I am getting approval instantly from my superiors and finally told me that the amount will be credited within 48 hrs. Since the amount was not credited I called you on 10/10/2015 to address my issues, Ms. Jagriti rajora told me that I did not give any consent to the mail sent by Shilpi singh on 07/10/2015 and she once again sent the mail. The content was as follows "Thank you for contacting Paytm.com. This is with regards to the concern which you have registered with Paytm against the order number [protected]. Kindly, let us know if you want to keep all the four tyres or want to return few of it so that we can credit the MRP difference if it". I immediately responded that kindly credit the MRP difference amount since I want to retain the product. In between I received a mail from paytm on 11/10/15 (sent by Aditi Rani vide reference 11) stating that paytm would like to inform you that as of now we can offer you 5% amount as a token of apology and requested to confirm for the same. I responded positively . However nothing was happened as usual. So once again I raised a complaint on 14/10/2015 and as usual I received a reply that a complaint has been raised with the concerned team to resolve this issue. As usual no progress in this regard. On 17/10/2015, I was getting a mail from paytm on that request for return against this order has been cancelled.The question of request for return did not arise anywhere and I was astonished to see such ridiculous reply from paytm. On Oct 17, I received a mail from paytm and the content is as follows "This is with regards to the concern which you have registered with Paytm against the order number [protected]. I would like to inform you that their is no difference between the B1 and V1. It is the same and no difference and their is nothing to worry about. The difference in v1 and b1 is only the lot difference, they both are made by the Goodyear company in different plants therefore to identify the difference it is marked v1 and b1." So I immediately sent a mail on 17/10/2015 that the issue is not B1 or V1. It is the technical specification variation of 84 H and 84 T and also called paytm once again on 17/10/2015 and talked with Mr. Piyush and he promised to resolve the issue within 48 hrs. On 18/10/2015, once again I was getting a mail that my request for return against this order has been cancelled. I really wonder how the paytm is functioning with such a poor and irresponsible team? Before recovering from the setback of mail sent on 18/10/2015, I received a mail from you 19/10/2015 stating that paytm are arranging the reverse pickup for the above order and requested me to keep ready for the reverse pickup with brand packaging and original invoice. Let me summarize the issues 1. The seller has sent 185/60 R15 84T instead of 185/60 R15 84H. So the seller has sent the wrong product. 2. I paid only for 185/60 R15 84H and not 185/60 R15 84 T. So I have every right to ask for MRP difference. 3. If MRP difference pay back is not possible, it should have been informed to within 48 hrs after I raised the complaint on October 2, 2015. Is it valid or not? 4. In such a case Why did paytm ask my consent to credit the MRP difference on 07/10/2015 and 10/10/2015? 5. Now I was told that the team has not agreed for this. Without getting the approval, why did paytm get my consent? Nowhere in the mail, it was mentioned that subjected to the approval of any team. In such a case it is the responsibility of either paytm or the individuals (Shilpi singh and Jagrirtri rajora) to payback the MRP difference as committed to me on 07/10/15 and 10/10/15 via mail. 6. I did not ask for any token of apology amount. Paytm only voluntarily asked my consent to credit 5 % amount as a token of apology and requested to confirm for the same. I did accordingly on 11/101/15. However no action was taken in this regard sofar? 7. After 20 days of correspondences, paytm now requested for the reverse pickup. Do you think that after agreeing for repayment of MRP difference and 5% token amount as apology by paytm, any customer would keep the tyres without installing, where I have informed my intention on 02/10/15 itself to retain the product. What I finally conclude is the paytm is more interested in protecting the seller rather than the interest of consumer. Since paytm and seller is trying to play a foul game smartly by prolonging the issues for the past 20 days without resolving it, I decided to move to consumer court to get relief for my grievances if they don't reply even after this post.
