Samsung India — Replacement or refund of E500H Phone having manufacturing defect

In the ocean of cheap mobile options my mental catastrophe started on 01/11/15 when I proudly went to buy a Samsung smart phone. I asked the dealer to show me a latest best phone of price around Rs 15000 which has good camera and battery. He showed me Samsung Galaxy E5 and told it have powerful processor, good camera & good battery. On his advice I brought that phone which cost me Rs 15000. I was surprised when I learnt that at the same price I could have got a far better phone Galaxy J7 of the same brand. GALAXY E5 GALAXY J7 CPU Speed 1.2GHz 1.5GHz CPU Type Quad-Core Octa-Core Size (Main Display) 12.63cm 13.95 cm Front Camera -Flash NO YES Main Camera - Resolution CMOS 8.0 MP CMOS 13.0 MP Battery Fixed Removable Battery 2400 mh 3000 mh OS Kit kat Lolipop In spite of the above joyless experience, I activated the phone on 05/11/2015with a new Nano SIM. From the first day I was not able to connect to internet through Mobile data. I took help from Samsung product experts through phone support[protected], [protected] and Live Chats. I followed all the technical things they told but they could not resolve the problem. Ultimately they told either the SIM has no internet facility or the settings are not correct. I took help from my ISP; they resend the internet settings and told that internet is activated on the SIM. Then again I consulted Samsung online customer care they told to rest the phone. I did, but the problem was not resolved. Samsung live chat support asked my pin to get the nearest service center but there was no nearby service center. They gave me the service center name which is around 150 KM away from my house. I also tried Samsung online service center. It took several days to register my phone with Samsung online service center. E5 has fixed battery and the procedure to check Sl. No is given for removable battery and Sl. No given in bill is IMEI. Anyway I registered my phone and asked help for my problem (request no [protected]). They suggested upgrading phone to the latest software version through FOTA. I decided to visit a service center in Lucknow for the same. Through the online service center I was able to locate service center address. But most of the phone numbers were not in use or no one received the calls. On 20/11/2015 I visited service center in Lucknow. The service engineer after few hour of inspection of phone told that the motherboard of the phone is damaged (service request detail [protected]). You have to leave your phone for repair. Knowing my new phone having critical manufacturing defect from the first switched ON, I asked the service center to replace the mobile or refund. They replied that they could not do so because DOA is issued within 7 days of purchase. My question is that how can one know data connection problem may be due to motherboard problem? The same was also not predicted by Samsung product experts giving support through live chat or phone to me within 7 days of purchase. Kindly help to get refund ASAP.
