CC: To: The Managing Director, Samsung India Electronics Private Limited A-25, Ground Floor, Front Tower, Mohan Co-operative Industrial Estate Suites, New Delhi-110044 Date: March 11, 2015 Subject: Deficiency in services by failing to provide repairs of my mobile phone On 10th January 2015, I purchased a Samsung NOTE-4 (IMEI # 355306/06/8113747) from Android Land, GIP Mall, Noida and paid Rs.55, 000 for this purchase and attached is the copy of my payment invoice (#g213578) as Annexure I. Unfortunately, soon my phone faced voice cracking problem and on 20th January 2015, I returned it at your service center. On 13th February 2015, your service centre replaced the phone with a new one (IMEI No: 355306/06/700997/9). Attached is the copy of my Job Sheet (No. [protected]) as Annexure II. However, to my utter disappointment, the problem with cracking voice persisted even in this mobile. Your service centre staff too accepted that there was an issue with the handset. Attached is the copy of the note from your engineer stating it as Annexure III. However they denied to replace the faulty handset saying that as per your company policy, an already replaced handset cannot be replaced for the 2nd time and advised me to approach the higher authorities to get the issue resolved. However, none of your company authorities reverted to my mail (Copy attached as Annexure IV). I am extremely let down and it is annoying that a handset I bought spending so much money turned out to be defective. Moreover, I was surprised to receive a response from your company recently saying that my handset has been checked by your senior technician and they found no issues with it - which is absolutely wrong. This is not acceptable to me and this irresponsible attitude is least expected from your company. I would like to mention here that 'As per Section 2 (1) (c) of the Consumer Protection Act, 1986, I am a consumer as I have bought the goods from you / availed your services for a consideration that I have fully / partly paid'. Moreover, 'You can be held liable under Section 2 (1) (g) of the Act for deficiency in service (where deficiency means any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service)'. I, therefore, request your company to exercise your authority and give me either a replacement of the phone immediately or a refund of the cost of the phone. As a consequence of your deficient service and the repeated incompetency displayed by your employees, I have suffered undue hardship and mental frustration. I would like to emphasize that: • You have been grossly negligent in resolving my complaint. • I have undergone a lot of extreme stress and mental agony because of your deficient service. Given the above sequence of events, I request you to kindly give me a replacement of the faulty handset with a new one or a refund of the cost of the handset. In addition, I request you to compensate me with an amount of Rs. 10, 000 for the extreme stress and mental agony you have caused to me and the cost incurred by me in trying to resolve my grievance. In case you fail to resolve my complaint within 15 days from the date of this letter, I would be forced to: • Ask my lawyers to file a consumer complaint against you for not providing detailed information, and deficient service, as well as additional compensation for mental agony and legal costs; • Ask my lawyers to consider the filing of a civil suit against your company • Start a sustained online campaign spreading the word about the appalling level of service that I have received from you; and • Issue press releases online and in the print media.
