SBI — wrongly charged for not submitting rc book

Address: Pune, Maharashtra, 411036

I have purchased S-Cross worth Rs. 12 lac for which I have made down payment of Rs. 10 lac from my hard earn money and taken car loan of only Rs. 2 lac from SBI Viman Nagar, Pune. On this loan I am paying EMI of Rs. 3200. At the time of loan procedure, I have not been informed by loan manager about submission of RC book to the bank. And now they have charged fine of Rs. 5900 for not submitting RC book. During last 6 months I have not received any intimation mail /SMS or call from bank regarding the same and suddenly they are charging me fine more than my EMI.

I have visited bank on:

13 April – For EMI payment

5 May – For Repayment of loan (Rs. 70000)

24 May – For Repayment of loan (Rs. 70000)

In last 2 months I have visited bank thrice but neither of your staff has informed me about RC book submission nor I have received any formal notice regarding the same. My car was registered on very next day of purchase and I was having RC book after 1 month. If I would have been aware about submission or any of your staff would have asked me about the same, then why I would have avoided the submission. You people send regular alerts regarding EMI payment but no SMS/ E-mail regarding failure of RC book submission? If I will stop paying EMIs then you will come to my place for collection then why there is no such procedure for other necessary submissions?

When I raised complaint online regarding the fine (Complaint No [protected] ), Mr. Rathod from the branch have closed the same and replied that these are late EMI charges. Please refer below screenshot.

When I called in the call center then about these huge charges they said that late EMI charges are not Rs. 5900 but Rs. 590, this must be some mistake in typo 590 to 5900. So your people only are not aware about the issues and charges. They are misleading me which is a mental harassment and I am under tremendous pressure due to the same.

After this, I have again raised complaint (Complaint No [protected] ) for which I received call from Mr. Rathod and Branch Manager of Viman Nagar said that we have mistakenly written that these are late EMI charges but actually it is RC book non submission charges which are not charged by branch but by head office. He has also agreed that they have not communicated regarding non submission of RC book and apologies for the same. He also assured me that he will take the issue to head office and reverse the charges. Now they are denying to do as same is denied by Bank Controller.

Sir, I work very hard to earn every single rupee. Rs. 5900 is a very big amount for me. I have taken only 2 lac loan and out of which I have settled 1.5 lac within 6 months. Also I am a punctual borrower whose non of the EMIs has been delayed. Still you are charging me such a big fine. On other hand people like Vijay Malyya are eating up the entire banking system and still moving freely. Then what is the use of me following the rules strictly? Give me one valid reason, even after this injustice, why I should pay back my loan as per rule and not default the same?

I request you to please reverse these charges.

Okay Guys,

I got this sorted out. Here are the steps to get your Money back.

1. File a complaint at your bank. Every SBI bank has an email ID. Ask for it by calling them and send a formal complain. In my case, i had to follow up with them for almost 5 months but nothing happened and then they just said " You have signed the papers and as per terms and condition you will be charged". I knew this is ### as while signing those 60+ LOAN papers, do they even ask Customers to read the terms and conditions before signing it?? I was pissed at that time as they had wasted 5 months without action.

Now, i complained at Banking Ombudsman

2. You can do it from this link and creating a logging ID.

Once you register a complain on this portal, they will assign a officer who will assist you in getting your money back. Just mention all the details in that complain like your bank address, LOAN account number etc.

This is as per RBI direction and you will surely get your money back even though it may take few months.

See attached screen shot, they refunded my Money :)

Hope this will help.
