Plot No.35, Sector-4, Airoli, Navi- Mumbai, Dear Sir, With deep pain, depression and hope we are writing this request letter. Hope proper Justice will be given be given to us. Index of sequential activity Sr Date Activity Attached document 1 09/03/07 Auction was carried and we stood 1st Allotment letter by Bank 2 28/03/07 Bank informed delay in handing over due to court matter Letter attached 3 14/03/07 Loan defaulter filed case in DRT attached 4 19/06/07 Judgment by DRT in favor of bank attached 5 01/12/10 DRAT again redirected matter to DRT attached 6 28/03/11 Notice to SBI SARC asking details of proceedings in matter. attached 7 19/05/11 Consent terms for out of court settlement between US & Loan defaulter was submitted to Bank 8 17/2/12 Judgment by DRT in favor of bank 9 24/03/12 We approached court to be incorporated in matter as intervener 10 05/05/12 Issued notice to Bank & Loan defaulter for our intervener in matter 11 24/07/12 Bank and Loan defaulter had out of court settlement withdrawing matter and depriving us from possession ( Copy of DRAT order ) 12 07/10/12 Our request letter for doing Justice We are senior citizen, have stayed through out our life in hut/Chawal since 1958 in Mulund Mumbai 400 081. Based on advertisement dt. 6/2/07 for Auction of above subjected flat in Free Press Journal we have applied for bidding and were successful bidder in Auction. Based on requested letter from Bank we paid the total due amount on 13/3/07 and were expecting that bank will provide us the peaceful possession of the said flat. On 26/3/07 we received a letter from Bank that due to some court matter in DRT and status-quo order was passed on 14.3.2007. On 19/6/07 DRT has passed in favor of bank. Mrs. Raksha Gosher approached DRAT they again directed matter to DRT on 1/12/10. We approached in High Court for delay in Justice to us, The Honr. High Court has directed DRT to hear & conclude the matter in one month accordingly DRT again has passed order dt. 17/2/12 favor of Bank. Till this time we showed our confidence & solidarity with Bank. Mrs. Raksha Gosher once again has approached DRAT this time we approached DRAT for getting incorporated as Intervener in to the matter and served notice to Bank as well Mrs. Gosher on 21/5/12 ( Copy attached ). Schedule date for hearing was 14th September-12. To our surprise when our advocate when went in DRAT on 14/9/12, we were informed that the matter was settled out of court with mutual consent between Mrs. Raksha Gosher & Bank for about only Rs. 20lac. Now our concern in the matter is 1. If the matter was to be mutually settled why Bank holed us for 5 years. 2. When Bank was claiming dues of Rs. 18, 25, 019/- from Mrs. Gosher in Feb- 2007 (@ 16.5% Interest ) towards out standing from her, What made them settled the matter for about Rs.20lac. 3. Where We go from here, What @ us, Can Bank provide us 1050sft Carpet area in Airoli Navi Mumabi within the budget which they propose to pay us. 4. When We made an honest attempt on 19/5/11 for mutually settling the matter with Mrs. Gosher and agreed Consent was submitted why Bank never supported us at that time ( Detail of MOU attached, with Banks Acknowledgement ) 5. Why Bank kept us in dark all the time and never replied / Communicated to us in the matter. 6. We are senior Citizens and illiterate for legal issues where should we approach for Justice. 7. Who will bear the loss caused of Public / Government due to illegal benefits passed by Bank to a defaulter & fraud who did with bank all these years. 8. We are exhausted of funds and do not have capacity to fight legally with Countries no-1 Bank, Dose it mean any Official/Bank can take us for ride. 9. We have lost hope in life, all the time we have a feeling of being cheated. 10. We are confident that team of Bank Official along with Banks lawyer have committed fraud and have been bribed in the matter. 11. We request you to kindly conduct a thorough enquiry in the matter and do Justice to us by proving us the flat and taking necessary action against the responsible officer. 12. If we fail to get the Justice before 30days, We will be forced to take necessary appropriate legal action against you of fraud and doing malpractice in the matter Regards Maganlal R.
