State Bank Of India — Wrongful Dishonouring of Cheque | |||
1. I am a retired Army Officer. I have been a practising Advocate in the High Court of Karnataka since 1982. 2. I had issued a State Bank of India crossed cheque bearing No. 217632 on 05 February 2015 out of my SB Account No. [protected] maintained in the State Bank of India Branch in the ASC Centre (South), Bangalore- 560 007 (IFSC Code No. SBIN0004742). 2. I was informed by the payee that the said cheque, when presented, had been returned dishonoured by the Bank on[protected] on the ground shown in the Rejection Slip as: "1. FUNDS INSUFFICIENT" 3. On verification, I had found that my said cheque had been negligently dishonoured and rejected when I had had, in my account, in excess of Rs. 2, 00, 000/- (Rupees Two Lakhs) in credit on that date. 4. I pointed out the said fact in my letter dated 24 February 2015 addressed to the Manager of the said Branch, and had complained that I had stood severely embarrassed by the return of my said cheque dishonoured on such a humiliating, but patently false ground. I had sought an explanation as to why my said cheque had been negligently rejected in that manner for no lawful reason whatsoever. 5. I felt aggrieved that I had not received any response to my said complaint until 13 March 2015. I had therefore requested the authority concerned to take note of my said grievance, investigate the matter, pinpoint responsibility, and, intimate action taken against those found guilty of the said negligence, lest I should be compelled to take recourse to remedy in appropriate forum for the said undeserved insult heaped on me through the said act of callous negligence on the part of the staff concerned in the Bank. 6. My said complaint had been sent to the Bank's office in St Marks Road, Bangalore- 560 001 through 'acknowledgment due' Registered Post. The receipt of my complaint by the said office was duly acknowledged by the said office. 7. I regret to point out that no action has been taken so far on my said complain. I remain aggrieved without even so much as an intimation given to me about any action taken/proposed to be taken on my said complaint against those guilty of such culpable negligence. 8. Please take this as my final effort to move those concerned to urge prompt action on my said complaint in order to make amends for my said grievance. If I do not receive satisfactory and appropriate response within one week from date, I shall initiate action under law, as deemed necessary, for the said act of gross negligence and professional misconduct on the part of the staff of the Bank.
