Templeyatri — harassment during tour of do dham for women belong to backward class- schedule caste

The undersigned with 3 groups working with Ministry of Defence, Indian Ordnance Factories, Machine Tool Prototype Factory in the Middle Management Level i.e. Group B Officers (Total 8 Ladies, 3 Young Boys, 2 children and one Male ). Out of these 8 ladies one of the Lady is holding Group B Gazetted post and also the member of the Women Cell. We booked the package on line with Temple Yatri after coming in contact for more than 2 months and Shri Ranjan Srivastava, CEO of the TEMPLE YATRI and got finalized the tour according to their terms and conditions. (Copy enclosed for ready reference)

1.Rs.22000/- through NEFT was paid on 2nd May 2019 and other payment on 20th May 2019 for Rs.22000/- through NEFT (Total Rs.44000/-) to the firm Instamaze Infotainments Pvt Ltd. Bank Name : Indusind Bank A/c. No.[protected] Current Account, IFSC INDB0000383 at Branch Gaur Gravity Mall, Gaur Green City, Vaibhav Khand, Indrapuram, Ghaziabad 201 014 (UP) . whereas the total tour was booked for Rs.138000/- for 12 adults and 2 children below 5 years.. According to Tempel Yatri policy we paid the amount in advance and the receipts are enclosed herewith for your information pl. (Receipt enclosed for ready reference)

2. The vouchers for the hotels should have reached well in advance whereas we received it on 26th May 2019 at 1130 am while we were to proceed on tour from our residence. In the Hotel Vouchers the details of the payment was not mentioned clear like an advance paid to the hotel while booking and the balance amount was also missing in the hotel vouchers. We were about proceed being the schedule so tight after going through the vouchers at a glance we rectified that the names of the hotels and also amount of the booking provided in the itinerary were mismatching and it was brought to the notice of Shri Ranjan Srivastava, CEO of Temple Yatri . Shri Ranjan Srivastava replied that my role got completed and now onwards we have to approach Shri Vivek Srivastava since he was our tour manager. After having conversation with Shri Vivek Srivastava that the hotel vouchers provided for us is not same as mentioned in iinerary, Vivek Srivastava stated that hotels provided for us is of same standard and of same range also requested to manage for 27 May 2019 since at the last moment it is very difficult to manage and from 28th May onwards the hotels will be provided according to an itinerary.

3. According to an itinerary it was stated that by TEMPLE YATRI that Tempo Traveller will be provided to us from the begining of the journey to an end of the journey i.e., from 27th May 2019 onwards to 3rd June 2019 but remained failed to provide the services as per their itinerary and also as per their assurance.

4. We reached Dehradun on 27th May 2019 at 1030 pm and no vehicle was found at Dehradun Rly. Stn. We have crossed the following channels from the beginning of the tour for the service of vehicle according to itinerary.

(a) When we called Vivek Srivastava tour manager he provided the contact no. of driver [protected]. When we called the driver some body appeared in between and stated that he had send SMS in which Driver Name Mr. Sameer and contact no, [protected] whose Tempo Traveller no. UK07TB4020 was provided and we have come in contact and thereafter vehicle reached at Dehradun Rly stn. At the begining of the journey for Transportation we have crossed near about 3-4 channels. In this process we wasted more than 2 hours with family and children and that too at unknown city with unknown people. In the Itinerary our Hotel was Hotel Doon Palace at Dehradun in the itinerary whereas we have been dropped at Hotel Amrit Regency. After reaching to the Hotel Mr. Sameer driver of the Tempo Traveller demanded for the transport charges whereas we denied to pay as we were already paid Rs.44000/- in advance before the commencement of the journey.
5. According to an Itinerary on 28th May 2019 after breakfast check out from the hotel proceed to Mussorie. Visit to Mussoorie sight seen like Kempty Fall, Bhata Fall, Mosy Fall, Happy Valley, Mall road and in the afternoon proceed to Uttarkashi overnight stay at Hotel Shiv Putra at uttarkashi bur remain failed due to non-availability of transportation.

6. Again on 28 May 19 we had conversation with Shri Vivek Srivastava regarding our programme and Vivek Srivastava stated us to be ready at 9 am transport was on the way to pick us. We all waited for more than two hours in the mean time we have crossed the following channels to get the transport:
a) We received 4 calls from Shri Vijay Vijalwan Taxi regarding transport whereas we all were in dark and could not understand what was going on and why we had given mental stress, trauma, harassment, mental torture, embarrassment, demoralization and humility in front of other tourist, hotel management of Amrit Regency and in front of our family members. After speaking to Vivek Srivastava got cleared that he instructed Shri Vijay Vijalwan for transport for sight seen. After waiting for more than 3-4 hours we contact Shri Vijay Vijalwan regarding the transport he stated that since his vehicle is under breakdown it may take more than 3 hours. In this process we wasted 3-4 hours since morning. Again approached Shri Vivek Srivastava reg. transportation he replied that he is arranging the transport from Haridwar it may take 2-3 hours to reach Dehradun. In the meantime we received 8 calls from [protected] by Ashok from Haridwar regarding transporation and he cleared that Shri Vivek Srivastava instructed for transport for us for sight seen at Dehradun but he was not moved from Haridwar as not a single rupee was deposited in his account so he could not move with transport. In these whole picture we have come across that Vivek Srivastava is playing a blame game with us, cheating us not providing the service as per the itinerary and per their assurance and remain failed to get the transport for sight seen on 28th May 2019 we have crossed the following channels being aware that the majority in the tour were ladies with small children in the journey but still not fulfilled the promise by Temple Yatri.
During this period we have crossed the following channels:
(ii) Received 4 Calls from Temple Yatri .[protected] on 28th May 2019 regarding transportation but no transport was arrived.
(iii) Received 1 Call from mobile no.[protected] on 28th May 2019 regarding transportation but no transport was arrived.
(iv) Received 10 Calls from mobile no.[protected] and the name of the person Shri Vivek Jain who provided the vehicle for sight seen instructed by Shri Vivek Srivastava
(v) Received 8 calls from [protected] by Ashok from Haridwar regarding transporation but remain failed.
(vi) Received 8 calls from [protected] on 28th May 2019 regarding transportation for sight seen but failed
(vii)Received call from Danish Sarkot on 28th May 2019 on 2 occassions regarding transporation.
(viii) Received call from A.R.T.O Dehradun whose photo is also visible on mobile contact no [protected] on 28th May 2019.
(ix) (i) Vivek Jain contact no.[protected] (Recd more than 10 calls on 28th May 2019 regarding Transportation). The instruction recd from Vivek Srivastava to Vivek Jain for providing transportation. Two transport reached at about 3 pm to have local sight seen of Dehradun. We could only visit FIR and Sahastradhara and returned to the Hotel Amrit Regency by 9 pm. and charged Rs, 7500/- in which we paid Rs.5000/- and balance Rs. 2500/- was paid by Vivek Srivastava.

7. On 28th May 2019 we narrated the whole picture to the Hotel Owner ofHotel Amrit Regency that this is the circumstance arised in front o[censored]s. According to an itinerary we were supposed to proceed to Uttarkashi enrouting Mussoorie sight seen like Kempty Fall, Bhata Fall, Mosy Fall, Happy Valley, Mall road and in the afternoon proceed to Uttarkashi overnight stay at Hotel Shiv Putra at uttarkashi neither we have extended our journey nor could check out from Hotel Amrit Regencey due to non-payment as Shri Vivek Srivastava had not paid a single rupee to book the hotel and the hotel manager was not ready to release us. Then, the hotel owner spoke to Shri Vivek Srivastava in his language stating that this is not the way to behave with out guests as they have come from far distance paying huge amount and you are cheating and ditching the tourist. Requested Vivek Srivastava to provide the proper service and amount according to itinerary else the Hotel Owner will take action against Vivek Srivastava.
After coming across with such a fatal incident our tour manager Vivek Srivastava made an arrangement of two transport and that too the payment part was left with us. Transport owner after having sight seen at Dehradun from 3 pm to 9 pm charged an amount of Rs.7000 in which we paid Rs.5000/- and asked our tour manager Vivek Srivastava to pay Rs. 2000 from our advance. Again here we faced mental stress, trauma, harassment, mental torture, embarrassment, demoralization and humility in front of other tourist, hotel management and in front of other tourist and family members. After having hot talks and request Rs. 5000/- got released on 28th May 2019 and continued with the same hotel for 29th May 2019 as there was no transport to move ahead for the journey and there was no option left in front o[censored]s by our tour manager Shri Vivek Srivastava.

8. On 29th May 2019 Shri Vivek Srivastava the tour manager promised of providing vehicle type Tempo Traveller for further journey whereas he send two vehicles one is Scorpio and other is Swift Dzire being aware that 12 adults will not get accommodate in the above transport and he provided our contact no. to the drivers and the following calls received on following occasions:-
(vi) Received call by Shri Rajesh Yadav contact no. [protected] we went to the transport and had a look had discussion with him. He clearly stated that in scropio only 6 adults were allowed and there was no carriage bar for luggage on his vehicle. When we asked about the luggage he straightly refused and stated that the luggage is our problem and we have to manage on our own. Also stated that he do not have the licence of vehicle for more than 6 persons, if caught in between by RTO or Police the fine also has to bear by us which was against the rules of the itinerary.
(vii) Shri Ashish called on 3 occasions and his contact no [protected] who was having SWIFT DZIRE was not ready to keep luggage in his vehicle.

After crossing so much mental stress, embarrassment, humility we came in contact with Shri Ranjan Srivastava, CEO of Temple Yatri and Shri Vivek Srivastava out tour manager had hot talks, abused, used un-parliamentary language and criticism towards caste and your are not supposed to enter in the temple being untouchable and belong to backward caste and class and not to perform further journey due to Schedule Caste. After insisting and pleading a lot released Rs. 11000/- by Shri Vivek Srivastava our tour manager.

Overall out of Rs.44000/- paid only Rs.20500/- by Shri Vivek Srivastava and then for further journey he failed to keep his words as well as to maintain the itinerary programme as promised and assured by the company.

After spoiling our two days trip by travel agent, further we do not wanted to spoil our tour we managed the further journey on our own as there was no source/option left in unknown city to get help and remained handicapped.

From the above seen, it seems that Temple Yatri is breach of promise and mental harassment, mental torture, demoralization, humility, embarrassment towards the women and their family members,

It is requested to take legal action and demand to pay the remaining amount out of our advance payment paid Rs.44000/- as well as the fine for harassing the women in unknown city, making demoralization, humiliation, mental stress, mental torture, embarrassment and remaining failure in managing the tour according to the commitment by the Temple Yatri.

From the above experience it shows that Shri Ranjan Srivastava, CEO of Temple Yatri and Shri Vivek Srivastava, the tour manager harassed us, and made ashamed in front of family members and other tourists too and remain failure while performing the tour programme as assured in the itinerary Temple Yatri from the beginning of the tour and failed to proper response and remain failed to continue the journey as per their terms and conditions.

After going through the reviews of Temple Yatri we have come across that till date how action has not been initiated and how it runs for such a long years spoiling the name of the country, society, in the name of pilgrimage as well the humanity of the human beings. We feel that the name of the company should be Mental Yatri instead of Temple Yatri which hurts the spirituality of the culture and devotee of the tourist as well as defame the tourist activity around the country.

Kindly look into the matter and give us justice at the earliest and also charge for defamation of individual by other person in order to malign the status or reputation of the individual in the society under 499 IPC.

The expression “cruelty” has been defined in wide terms so as to include inflicting physical or mental harm to the body or health of the woman and indulging in acts of harassment with a view to coerce her or her relations to meet any unlawful demand for any property or valuable security under section 498 IPC

Kindly impose the penalty towards both the executives Shri Ranjan Srivastava and Vivek Srivastava as well as toward the Travel Company so in future such type of activities will be appeared/approached with other tourists during pilgrimage tour.
