[Resolved]  Toplite Holidays — Help: Toplite Holidays unethical behaviour towards me

On Jan 2nd 2022 around 4pm, one of the Toplite Holidays sales person, reached us while we are shopping in Goa near KFC, stating that they have 11th anniversary since they are providing gift cards, offers etc & made us scratch the card until we got an offer. Later he said just have a hotel tour at NEELAM GRAND Hotel - (Calangute Goa which is steps away from KFC) and give us your feedback it will take less than a hour - we can provide discounts on your next trip in Goa. So we went.

The lady Rep.Asma - asked all information from us and started to tell that we have 11th anniversary since we are providing 40% off on actual prices.
Said below offers:
25 years package - Rs.1, 40, 000
Includes 7days a year free stay for 25years, Total 8 members can go for holiday in a 3BHK Villa, you can choose any 4stars & above hotels like Hyatt and other few, can avail free Breakfast/complimentary drinks. if you don’t use any holiday in a year, you can carry forward up to 2year holidays i.e, 21 days and minimum maintenance charge only if you use holidays/year. If you want to use extra holidays we can carry from next/previous year or else pay amount Rs.7000/week. and some destinations we charge 12k, 16k and all international 22k

15 years Alternate - Rs. 1, 20, 000
Includes 7days a year free stay for alternative under 15years (i.e 7 times), Total 8 members can go for holiday in a 3BHK Villa, you can choose any 4stars & above hotels like Hyatt and other few, can avail free Breakfast/complimentary drinks. if you dont use any holiday in a year, you can carry forward upto 2year holidays i.e, 21 days and minimum maintenance charge only if you use holidays/year. If you want to use extra holidays we can carry from next/previous year or else pay amount Rs.7000/week. and some destinations we charge 12k, 16k and all international 22k.

after completion of explanation, she called SANA, and introduced. asked SANA to provide what plan/offer is suitable.

we had some discussion related amount, since its huge amount we can’t spend that much and then they have talked about our card limits, EMI options, and possible payment modes like pay 30% and rest you can pay after reaching home. still in thinking process my wife went to take care of our baby. Later they have said - Sir, there is one more plan which is actually for new married couples, even though you are not eligible for that i am giving it only for you because you are showing interest but thinking about money.

Then said about 10 years - Honeymoon - Rs.70, 000 - SANA particularly said that only difference from 25years and Honeymoon plan is just years. everything is same. which is - Includes 7days a year free stay for 10years, Total 8 members can go for holiday in a 3BHK Villa, you can choose any 4stars & above hotels like Hyatt and other few, can avail free Breakfast/complimentary drinks. if you dont use any holiday in a year, you can carry forward upto 2year holidays i.e, 21 days and minimum maintenance charge only if you use holidays/year. as we were spending much time from our holiday its been 1 and half hour so I took my wife card and while checking the details, suddenly a guy came up and took the card and sent a link for payment and did it in under a minute. and later Asma came up with papers and said sir its an agreement between you and us since we need your signatures. I saw the papers checked names/amount/tenure years. They did not mention, showed, underlined or stressed any of the points regarding Apartment Type, Maximum Occupancy, Entitlement. which I came to know after coming back to my home town. So in Hurry and since as we have trip plans we left the hotel.

Next day customer care called regarding welcome call and was clarifying the details that membership has alternative plan for 10years which is only 5years - A couple plus 2 kids under 6years for 7days. I said am not accepting that, this is not they have told us. and not approving the membership. Enquired in family and friends gave negative review saying there are frauds, scam. Since I rushed back to hotel and asked the same. The plan details are not right, moreover I saw bad reviews. as there are other people in room they have increased music volume and asking us to calm down since its not professional i kept calm and asked to cancel and give refund. They started the right person is not available now. later 30min of waiting SANA came up and started stating sir we have discussed whatever is the paper, none of the offers are my creation. and you signed the papers we cannot refund amount. you can use our service if you dont like you can cancel but you will not get refund. I argued with them for 20min no help and I tried up calling my bank and reverse my payment as they were not helping me. Since I was getting delay for return flight I had to leave from that place.

After coming back to Home, I replied to email stating this is not at all acceptable, you guys are not providing me services which you are offered and additionally now the papers have AMC - Charge Rs.9000 for every trip in year used and should pay before we use free trip and to maintain membership active.

From then I have spoken with 5 members of Top lite Holidays: Each one of them are telling different options/offers now. And upon arguing related to offers which were told, now they are saying that I am a Liar and asking why did you sign papers. Will you sign your property if we give papers? They are rude and not at all listening to me.

Please, Help me regarding this. Even though I cancel i will be loss paying interest on EMI's even explained this point but they are talking very very unethical manner. Literally they mean you can’t do anything now.

Since we have every right to cancel as a consumer: if the said offer/service is not provided or misleading information on service. More over the card I used belong to my wife I did not ask her while paying and she's not approving the charges.

So, I request the officials to please make TOPLITE HOLIDAYS cancel the membership and REFUND the amount. and I need a sorry from customer service people who called me LIAR.

Dear Madam,
We have already had long conversation with your husband Mr. Sushil in regards to the same on the reviews put on social Media by you and him including many other friends of your again an again repeated against the firm.
Mr. Shusheel had mentioned clearly on call that he had claimed the funds from two places from Razor Pay as well as to the company plus dropped in for charge back, When it came to our notice we informed Mr. Shusheel that since his put the same in dispute with Toplite and Razor pay, we would hold it unless we receive a letter from the bank as its gone into depute for chargeback process. that would take at list 60days as the bank will drop a letter to the Merchant.
But Mr.Shusheel even after miss using the firm in two ways call the customer care team and abused her on a very bad note.

Please the lady on duty was doing her job and I'm Sure madam your a lady and wouldn't like a man abusing a women on duty.

Once we receive a letter to the Merchant from the bank we'll look into the same but would take 40day to 60 days once the matter is resolved.
Please contact the Customer Care Team on the same. And once in process you will have to mention on all social media as well on the forum as resolved since you have already damaged the company dropping false allegations thru friends and family.

My Bank Representative called your company and also sent an email stating the CHARGEBACK has not been initiated. and the merchant should refund the amount to the same loan account number. Which is not done till date. this is NOT RESOLVED.

I have discussed the issue with my relative who is "Inspector of Police - Shiva Kumar and Samaram sir". they will be taking action sooner on you.
