Non payment of maturity amount
Sir,
I have a fd o[censored]nitech ltd as per details below.

Fdr no:1229447 - a/c no:079733 - date of issue: 25.07.13
Dt. Of deposit:19.08.13 - amount:rs.35000/- - period:3years dt. Of maturity:19.08.16 - maturity amount:rs.50826/-

The deposit was made through their authorised agent m/s bajaj capital, bhubaneswar branch. Looking at the present financial condition o[censored]nitech, i was advised by bajaj capital to submit the original fdr duly discharged along with an application and the necessary age proof addressed to mr prem chand, branch officer, company law board, cgo complex, lodi road, new delhi for an early settlement considering it as an "hardship case under under senior citizen ground". Before one month of the maturity date.

I have accordingly complied with all their requirements and submitted the papers to bajaj capital on 15.07.16.

This is with reference to the above posted query.

Please find the below update .

The company is not releasing the maturity payments as of now and they had also approached CLB (Company Law Board) for taking further extension to repay the funds that has been rejected by NCLT.

As per the court hearing dated 8th / 22nd / 31st August 2016, NCLT Bench has suggested ROC to start prosecution against the company and further steps to be initiated.

Also, the company was directed that a separate bank account be opened for the sale of proceeds of the six immovable properties furnished before the bench specifically to meet the financial obligations towards the FD holders. Next court hearing date was 7th Sept 2016. (Please find attached NCLT order copy).

The procedure to file fresh cases against the company, with NCLT is ye to come. Please find below updated details from Legal team :

In court hearing dated 07.09.2016, Unitech Limited has raised legal objection of Territorial Jurisdiction. Court has fixed 22 Sep 2016, to file a reply by the investors on the Territorial Jurisdiction Objection o[censored]nitech Limited.

We request you to kindly wait till 22nd September 2016, and we will inform you with further course of action shortly.

Please Note: Company Law Board is no more in existence, and now NCLT (National Company Law Tribunal), set up by High Court, will take care of the application files.
