Cheque Bounce
Hi,
I have booked a Flat in Triveni's Faridabad Project in Sec-78 but due to not implementing project i asked for cancellation and got Post Dated Cheques in the month of August, 2008 with the effective date as 15th January, 2009. When i presented the cheque on 15th January, it bounced with the reason as "ACCOUNT BLOCKED"
I contacted Builder and he is saying that there is Income-Tax Raid and they blocked our account and when it will be unblocked then only he can make payment and there is no end date for unblock of account.
What is the solution in this regard?

I totally sympathise with you. I had also booked a flat in Triveni Signature and there is no progress in development. So I sent a cancellation request, but Triveni is not ready to refund the money giving reasons that they do not have any money left with them. These excuses are just to gain sympathy and fool people. If the company does not have any money then how come the Mittals (Sumit Mittal Madhur Mittal) drawing a salary of more then 15laks a month!
What you can do is to lodge a formal complain with the revenue department and consumer court. Also, do involve the agent/broker as they are always hand in glove with the builders in cheating people. I had booked my flat via Jitender Gupta (Indiaspaces.com) and he boosts a lot about helping his customers but the reality is evident once you face problem and ask him to be your representative to resolve the problem. |
I am also in the same position. My 2 refund cheques have bounced citing the account blocked reason.I have sent legal notice and plan to file a criminal suit aganst the builder in section 138/142

| I have paid for a plot at Sec 89 to Ferrous Triveni and since they do not have any approval for developing a township there, they are suggesting that i turn over the receipt in return for post dated cheques. Reading the above complaints, i do not think that is a good idea. The question is - what can i do? |

One thing that requests all is to continue to raise your voice through internet, blogs, email, & media. This will put pressure on the developers and would also expose these cheaters to the public. At least other people will not fall pray to them. |

Hi,
I am also a victim of triveni I have booked a flat in Signature around 3yrs back but still no progress.
We are trying to form a group and for that we have already registered an association for that. If you people want can join it through <http://finance.groups.yahoo.com/group/TriveniApartments_Fbd>.
We are already around 80 members. Only with group we can put pressure on them.

IN SEP.2006 I BOOKED ONE FLAT AND PAID 350000.00 AS ADVANCE FOR REGISTRATION.
AGAIN IN JUNE 2007 THEY TOLD THEY ARE STARTING CONSTRUCTION WORK IMMEDIATLY AND PAY RS. 300000.00 AS FIRST INSTALMENT. TOTAL I PAID THEM 650000.00, SAME I PAID IN JULY 2007. NOW THEY ARE TELLING THEY WILL ISSUE A POST DATED CHEQUE OF 2011.
SO I WANT TO MAKE A ASSOCIATION AND FIGHT AGAINST THEM.

| I am a suffering from same problem. We should take all possible steps to wipe out such fraud companies. It is really sad that our law is so weak that it doesnot punish such companies and its promoters and these criminals thrive on public's hard earned money. I think you can file Cheque bounce case us 138 along with cheating us 420, as i think there account was blocked before they have issued cheques to you and then you can file FIR against triveni.

The company is not having any intention to refund money or complete the project, moreover the company is luring customers in form of launching other projects, it may be noted that till date this company has not handed over a single flat in any of its project through out India. It is simply intrested in collecting money. Let all the victims join togather with a three pronged approch
1. Filing a complaint with EOW
2. Filing a case in consumer court.
3. putting pressue on Ministry of company affairs, for prohibiting this company for launching any other scheme
4. In case if the company says that it has no money to refund, let a case of banckcruptcy be filled against the company.
