Compensation for delay in posession, no OC nor letter of discharge
Having made aware of National & State Consumer redressal forums'orders today awarding Rs 1Lakh and penal costs to 2other residents in D wing Premier Residences Kurla, I am here by asking HDIL to pay me compensation for delay in posession of flat D1206 in Dec 2013. Failure to do so will invite a case precedence in all appropriate courts. Also HDIL is requested to show me proof that they had applied for an OC, Occupation Certificate & given a letter of discharge to the Association during Handover. We are still suffering in all A to K wing due to this and water supply problems & leakages in almost all flats.

Hdil paradise city palghar delay in delivery of flat
Had booked flat in 2010 . Already paid around 12 lakhs . Possession promised in 2013, project appears to have been adandoned . Want to get back my money invested

huge delay in palghar project
I had purchased a flat in paradise city, hdil palghar in dec 2010. The flat was supposed to be ready for possession by dec'2013 as per agreement. However there is practically no progress even after 8 years. There is no response from the builder on various email communication. I had visited the site last year and they cited various problems earlier resulting in delays. They said the problems are sorted out and it will not be built on full swing. However there is no further communication even after that. It seems they are suggest buing the time and have no intention to deliver the project, else how can it be not ready even after 8 years which was supposed to be delivered in 3 years. What recourse i have now?

I am rahul datar booked flat in whispering towers in october 2015 subsequently registration has been done in oct. 2018.
Possession was committed as may 2018.
However till date no further construction progress has been done.
Hdil site is also sealed because of non payment of property tax.
Recently 2moths back i got mail that hdil has paid dues of 34.5 crores of bank and property tax will be paid by oct. End.
Can anybody update on recent developments

non handing over of flat booked in year 2010

I have booked a three bhk flat in pardise city palghar in sector 6 wing c flat no. C-103, building no.3. Sale agreement was done on[protected]. Possession date as per agreement was[protected]. But still no possession given by company. I have send a written complaint to managing director, hdil company on[protected] but no reply recieved. The had stop the work of sector-6 since long. Possession of sector 1 is given but there is no shedule for sector 6 as per information recieved from site. Rera registration of project is p[protected] for sector-6. I have not recieved any information about the project. The company has to pay the interest on my paid amount or rent of flat since[protected]. Also may i know the date of actual possession being given as per rera registration. My mail id is [protected]@gmail.com.

The builders are not providing me either the rent or temporary allotment for my house that they have demolished 17 years ago

Under the sra scheme my house was demolished in 2000 till the date the builder first gave termporay allotment the after that they told us to move so they can build the buildin there so they gave us rent on 11 months basis now its been 5 months now that the builder has not giving us any rent or temporary allotment and note that the place where our house was they built selling buildings and sold them now give me advice what should i do and i have adressed builder many times thats please give us something either rent or a temporary allotment but its of no use so give me advice what should i do now

Hdil majestic towers nahur west

This builder has promised a lot of people for flats and is now not delivering as per the promise. They earlier promised to provide me my flat by Dec 2016 but the work has completely stopped since 1 year post my booking.. It seems the work is stopped since 7-8 years now. They demand money for what has been completed so far but they have no updated on the project completion. Every time I visited their office their sales staff gave me a different date when the work will start. These guys are just fooling customers and taking them for a ride.
They also never informed of TDS to be deducted for their payment and also never provided accounts team contact even after sending 10 emails to their team. They are a very skeptical team and company to rely on. None of their staffs have any clue of when the work will start. They always hide information.

Abnormal delay in possession of our flat booked in hdil palghar

We have booked a flat in HDIL, Palghar way back in 2011 which the builder promised to give possession by 2013. Till date we have not received possession of our flat even after registration. We have paid huge amount as and when as per their demand as per instalments letters, but there is absolutely no progress at site. Kindly look into the matter and take corrective actions.

My self Razik i am traying to get cable connection from last 20days at my home but hatway cable engineer has not coming for give connection at my home, when i called him he did not pick my call also i went your office for the same query they said you will get connection in 2 or 3 days but still no body will come from last 15days,

Non possession of the flat at Paradise City, Palghar

I booked a flat at Paradise city, Palghar. With the name HDIL which was well known for me, I kept a trust and seems its failing. I dreamt of my own home and booked a flat in December 2010. Possession date given was October 2013. Its now July 2015 and still I don't see any sort of activity at site for completion of project. I have invested around 8 lakhs by taking bank loan. Every month am paying thousands of rupees as interest on that. And I think that the amount is diverted to another project to make money by the developer like HDIL. Individually there was no response. So made a group. And we could see little more response by HDIL. But just the response is not acceptable. I need a home which I have dreamt for.

TO seek immediate possession or Full compensation as written in email to hdil
I sold my 3 properties to pay installments of hdil in time.
i asked orally and by emails to hdil to inform me, if any delay in possession, so that i can delay sale of my properties.
But these corrupted, selfish people didn't care to inform me. and i sold at throw away price.
Later on prices increases drastically. I would have been earned handsome profit if sold later on.
Due to hdil i suffered heavy loss aprox 75 lakhs.. But hdil didn't care to reply to atleast one of my hundreds of emails
4 years to complete but still waiting for possession. On site work is totally stopped. He is liar. Giving different excuses at different times from lack of sand to lack of labors. They have earned handsome by corruptions in previous govt time.But denying for compensation??

We have booked flat in HDIL paradise palghar in 2010.we were said we will be getting the possession in 2012..but till date we have not got any update on the possession.every time we go and speak to their sales team they tell us they will revert us back or we will get a call from mumbai team...In 2011 they had sent a letter of installment payment when we asked why it has given a short notice to pay so their answer was we are finishing work very fast so complete your payment...but till date there is no progress is work...government has already announced of there is dealy in possession the builder has to refund 12% from the total amount...Enough is enough we need our flat or our money back...HDIL is a fraud builder we are very middle class people all our saving we have blocked in Hdil property..we need a help if somebody filing case against HDIL do let me know we can file together...

not it over 3 year late and they demanding over 1 Lac more in name of interest on service tax.
how to sue builder for late possesion and get damages.

DELAY IN GIVING POSSESSION OF FLAT

1. Delay in Allotment of Flat BOOKED in ‘HDIL
PARADISE CITY’ Plagarh West.
2. As per clause 33 on page 17 of the
Agreement, the date of possession of the flat
allotted to me is indicated as 13/12/2015, however, hitherto,
HDIL has not given me the possession of the said flat due to the very obvious
fact, that the construction has not progressed beyond the first slab. In fact the construction work appears to
have stopped for years together.
3. All the installments and any other
payments as and when demanded by HDIL have been paid by me promptly, and
without any sort of delay whatsoever. You can see that from your records.
4. HDIL has neither informed me about
the delay in the construction work, nor has HDIL informed me about the reasons
thereof.
5. From personal visit to the site it is seen
that there is no construction activity taking place for the building in which
the flat that was allotted to me. I visited the site on earlier occasions and
enquired from the staff there as to when I would get the demand notice for the next installment and
they used to answer like trained parrots “within the next two months”. This was the one and only answer I got. The demand
never came of course since the construction was not progressing at all. At the
time of booking Mr Noel told me that once the plinth was ready, within every 21
days thereafter the next slab would be ready. That sounded really fascinating !!!. What a tall projection. I
failed to sense that it was too good to be true, but since I was dealing with
HDIL I got carried away or - fooled/taken for a ride so to say.
6. I want
to be informed about:-
i)
Does
HDIL have any intention at all of giving me the possession of my flat; and if
yes by when?
ii)
The
reasons for HDIL delaying granting possession of the flat allotted to me, and
also the reasons for having kept me in the dark about the Non progression of
the construction work. Had I been
informed about this inordinate delay I could have taken corrective measures, as
laid down in the agreement.
iii)
Will
HDIL compensate me for the huge delay in giving possession (ie. if possession
is given at all)? What, and how much
will be the compensation?
iv)
Why
are my mails not being replied to?

HDIL HDIL HDIL...NAME IT I HAVE SEEN NOT A SINGLE PROJECT OF THIS REPUTED BUILDER FOR NAME SAKE IF WE HAVE TO SAY IT HAS COMPLETED PROJECT IN TIME.
WE HAVE BOOKED FLAT IN HDIL PARADISE CITY PALGHAR AND ALSO HAVE FORMED A GROUP OF APPROX 100 FLAT MEMBERS..WE WERE ASSURED THAT PROJECT WOULD COMPLETE BY END 2013, BUT YET OUR RECENT VISIT TO SIGHT ON 12TH APRIL 2015 WE STILL SEE THE SAME ...NO CHANGES...
WE HAD MEETING WITH HDIL REPRESENTATIVE AT SIGHT WITH OUR GROUP OF 35 PEOPLE FOR 2 HOURS AND THEN FINAL DECISION WAS MADE ON 17TH MAY SENIORS WOULD MEET US AT SIGHT AND SOLVE OUR ISSUSES.
AFTER THE MEETING WAS COMPLETE AND WE WERE ABOUT TO LEAVE ONE PERSON FROM HDIL WHO JUST APPEARED FROM OUTSIDE AND HAD COME IN STARTED ABUSING US AND ALSO THREATENING THAT IF WE DONT LEAVE THEN WE WILL BE PUSHED OUT WHICH HE ALSO DID AND PUSHED SOME O[censored]S AND CALLING SECURITY PEOPLE...

did you file FIR against the builder? if u would have a complaint against the HDIL Builder then he has no rights to abuse the investors I have also invested in this project and trying to find out people those who have invested in this project so that we all can take legal actions against it.

THEY HAVE COMMITED ME THAT YOU WILL GET THE POSSESSION BY DECEMBER 2011
BUT THEY HAVE FAILED TO DO SO AND AFTER LONG WAIT POSSESION IS GIVEN TO ME
NOW THEY ARE CHARGING THE MAINTAINCE AMOUNT IS VERY HIGH FOR MIDDLE CLASS PEOPLE
i.e RS 7 PER SQ.FT AND PLUS SERVICE TAX ....

I book a flat at palghar HDIL project on October-2011. My registration of the flat is alreadt completed. The builder given the possession dt in agreement 30.06.2014.
Yet i had not geting the possession. There is construction work is closed since last to many days.
Now i am in tense what to do, sir plz advise me what to do.

No sufficient water supply for Residency park Virar.

I Have purchased a flat in Residency Park Phase -1.It has been observed that the water supply provided for domestic use & toilet use are from different tanks & the connections are different.
The building administration(HDIL) department has decided to provide water to tenants only twice in a day for 2 hrs in morning & 2 hrs in evening. It means the toilet flushing system, Jet spray & toilet tap can not be used when there is
no water.
We can store the water for domestic use but what about the flushing system.
How can a family leave without using a toilet for whole day?
How can administration department can take such decisions without informing tenants?
I request to the concern department to take the necessary actions & the water should provide for 24 hrs at least for toilet system.
Otherwise the matter will be taken to consumer court.

I have purchased the flat in Residency building. I am not getting any tenants for rental basis from last 1 year due to lack of drinking water. Even thou HDIL is well known builder but not able to provide many of the facilities promised by them, one of them is basic water. Till this time they have not the got water connectivity from the Municipal corporation for the flat. If it is not possible in near future they should think about alternative arrangement. I suggest all the flat owners should put a case against the HDIL in the court.

Refund against cancellation

I had book a flat at Palghar- Paraside City- Sec IV Building 13 Wing B, third floor- 303 on 17.04.11. At the time of booking the flat was promised after two years. But even after two years the flat is still not ready. I have already paid HDIL Rs. 4, 26, 466/- including service tax. I gave letter to HDIL, Bandra on 07.02.13 requesting to cancell the booking and refund the said amount. I was told it will take 3-4 months for arranging the funds. After that I repeatedly called them and personally visited the premises but still the refund is yet to come. No response or any letter/ call is coming from HDIL. Please help me in getting my funds.

Dear Friends. need your support is raising our issues against the Builder HDIL whose flat in Kurla by name of premiere residencies we had bought in 2009 and were committed possession in 2011(some buyers even 2010).Its 2014 now and HDIL is now behaving in most malicious and greedy manner. after having sent letters for possession and payment of last dues. he has collected all money and just done a turn around saying now I want more money if you want your house under illegal and irrelevant cost heads. please review links of media on same and share and like them to voice our issues. Please refrain from any new projects of theirs and if you know of any friends stuck in same situation with HDIL ask them to join hands with us . we are now a 500+ protesting community.
He is asking money in cash without any demand letter that is black money which will have no records and that too after payment of 100%. Chairman Rakesh Wadhwa has gone to extent saying buyers that Do whatever you all want, even court case takes more than 10 years .

HDIL has failed in giving possession of flats in time, on enquire they says still it will take 18 more months for possession, mean while without any construction work in progress they are demanding again & again for payment with threats of forfeiting the paid amount if the payment is not made in 3 to 7 days, how to pay and on what grounds that they are not ready to clarify, nither they are ready to talk on phone or nor ready to reply our letters, according to their registered agreements clause 32 says that as per section 8 of Maharashtra ownership of Flats if possession not given in stipulated date or any written extension there after promoter has to refund entire paid amount with interest, now the quotation is HDIL is rudely refusing to refund the amount with interest as per the Claus 32 of their agreement. in that case all the peoples who have booked the flats in HDIL - Paradise City, come together form a consumer forum and file a suit against HDIL in consumer court. so that any concrete steps can be taken against promoters and force them to refund the entire amount with interest. right now everyone is fighting individual war for their rights, everyone can come under one roof and we can fight for our hard earn money. some one knowledgeable can launch a website and gather all consumers of Paradise City under one roof to save everyone from mental touchier

I had purchased a flat in Paradise CIty, HDIL Palghar in Dec 2010. The flat was supposed to be ready for possession by Dec'2013 as per agreement. However there is practically no progress even after 8 years. There is no response from the builder on various email communication. I had visited the site last year and they cited various problems earlier resulting in delays. They said the problems are sorted out and it will not be built on full swing. However there is no further communication even after that. It seems they are suggest buing the time and have no intention to deliver the project, else how can it be not ready even after 8 years which was supposed to be delivered in 3 years. What recourse I have now?

I have done agreement with hdil for 2 bhk flat where hdil has agreed in the agreement and As per the agreement clause 8 and clause 32 that if they delay the possession the purchaser has the right to terminate the agreement and get entire amount refunded which i have paid as instalments with 12 % interest which now they are rudely refusing. It seems that the HDIL is cheating and i want to file a suit in consumer and pray for my legal right of getting my refund with 12% interest

buyers of a Kurla project have taken a top developer to task. On
Tuesday, an FIR was registered against senior executives of Housing
Development and Infrastructure Limited (HDIL), for failing to give
possession to people who bought flats in their Premier Residences
project at Kurla (W), allegedly after taking full payment from them.
The FIR was registered against HDIL on a complaint by Shabnam
Latliwala, one of the buyers, at Vinoba Bhave Nagar Police Station under
Sections 420 (cheating) of the IPC, and other relevant sections of the
Maharashtra Ownership of Flats Act, for failing to give possession of
her flat despite taking money from her. The company's top officials,
Rakesh Kumar Wadhwa, Sarang Wadhwa, Waryam Singh, Ashok Gupta and
Gurmeet Singh are named in the FIR. Latliwala, an advocate,
said, "In 2009 I paid the total amount of around Rs 55 lakh to HDIL for a
965 sq ft flat. They asked for an additional Rs 43, 000 as advance
maintenance, which I also paid. Despite that, the flat was not handed
over." According to her complaint, HDIL constructed 1, 000 flats
in the mega housing complex at LBS Marg. HDIL promised possession by
2010, but most buyers claim they have not been given possession. In
January this year, around 400 buyers protested the delay at HDIL's head
office in Bandra (E), and in February Laltiwala filed a written
complaint with the police after talks with the company failed. However,
as the police did not register an FIR then, some buyers filed a writ
petition in High Court. At the hearing last month, HC directed the authorities to take cognizance of the complaints.
"We met HDIL's top brass and sought possession of flats. But they asked
us to pay an additional sum saying that the area of the flats had
increased. I was asked to pay around Rs 7 lakh more in cash. I had taken
loan from a bank which already paid the final instalment. The
architects, BIDCO Engineering Division, had also issued a completion
certificate stating the building is ready, " the FIR reads. Latliwala
added that over 40 complaints have been filed against HDIL with the
police. "The dreams of a thousand home owners are at stake, as
HDIL is withholding possession while most buyers are paying EMI of bank
loans, " said A K Chowdhary, another buyer. Like him, most people bought
flats following newspaper advertisements in 2009, that said HDIL was
offering affordable flats for alimited period. The police have
said they will probe the matter and submit a report to High Court. "An
FIR has been registered. We will carry out an investigation and submit a
report to the court, " said Senior Inspector Subhash Raut of Vinoba
Bhave Nagar Police Station. HDIL, on their part, maintain they
have been handing over possession to buyers who made full payment. "The
process of handing over flats commenced as scheduled and we have already
handed over 289 flats to those who paid the entire agreement amount. We
have served interest letters to customers who defaulted on scheduled
payments. These demand letters for due payments are being raised as per
the agreements with home buyers. This is just mischievous and malicious
propaganda against the company. Since the matter is sub-judice, we do
not wish to respond to any allegations, " a statement from HDIL said.

I booked a flat in Paradise Park, HDIL project at Palghar, Dist. Thane in December 10 & paid installments regularly. At the time of booking they promise us to give the possession in 2012 in mid July. After several mails/phone calls but no reply of my mails as wel as my calls. After that we go personally at Palghar site but not recd the proper reply from the concerned. Again we go personally in March 2013 & talked Mr. Sandip, HDIL....

According to the agreement possestion of flates were to be given in October'2013. which they have failed to give on time, looking to the construction work on site still many of the buildings have not reached till plinth level work also, but still they are telling to make the payment and promissing that the possestion of flats will be given in next six months, which looking to the work is next to immposible, in that case cant payment be done on possession to secure our hard earn money, HDIL has failed to give possesion in time so how they can be penalised for the false commitments. in indian law is there any action can be taken by government to provide safe side to customer intrest and hard earned money. some pics are taken just a month back for your rewie whose possetion was to be given in october'2013.

file a case in the court consumer/civil i think HDIL has the habit of cheating people there company should be closed down by diverting customers away from them and making the public aware about there nonsense. we all have to become one and ask them refund by filing a petition against them.these kind of cheaters would be dragged to court of law to stop this cheating publicly
Can some one who is in website development can start a website "PARADISE CITY - PALGHAR CONSUMERS FORUM" were all Flat/shops purchaser can register themselves and come under one roof and take some decession what to do further? How too takeup the matter ? fight for our rights and hard earn money. be united to fight for our rights.
I have booked1 BHK flat in HDIL-Galaxy, Kurla in 2009, At the time of booking they have confirmed about possession in Mar-12.I invested my hard earned money in this project, taken load, but the work at site is stopped from so many months, there is no communication 4m HDIL, why this work stopped ?, when this will start ? when we will get our possession ?

Compulsory Car park, Delay possession and not fulfilling promise to deliver facilities
I have booked a flat in HDIl première residence,we were promised possession in Dec2012,however have just received our house for possession after 3 years.Now the builder insists we pay Rs 4 lacs as car mandatory car park! We so not have a vehicle and do not need a parking as of now! Also club house,children's play area ,etc were to be a part of his development, and they havent provided with these services,
The government should look into this matter and penalise these builders for cheating the common man of his money!

Very Much Delay in Possession and construction

I Have booked flat in HDIL Palghar,Paradise City in January 2011,Possesion date was given Mid of the year 2012,But till now only plinth work is done.
After asking they say there are so many flats which we give together i really dont understand what they mean.
I doubt they have some permission issue,or local Political issue or money matters dont know please look into it as now they say possesion will be in end of 2013 which is also not confirmed.
Now am fedup and planing to sell this flat if its getting so much delayed.
Other HDIL Palghar flat bookers please join with me we will fight together to get the justice.

THE BUILDER HAS TAKEN 85% OF THE PAYMENT WITH A PROMISE OF POSSESSION IN DEC 2011, BUT SINCE LAST 6 MONTHS THE WORK IS STAND STILL AND NOW THE BUILDER IS SAYING IT WILL TAKE 1 MORE YEAR TO FINISH THE WORK AFTER RESUMPTION,PLEASE ADVISE.

No Progress in Palghar Project, it will delay the possession by one more year, cant say more than that also, work has started with 20-25 workers for such a huge project, it seems they want to grab the money from customers they are showing a jalak of construction work going on if it goes in this manner we cant get possession in 2016 also. its a request to all consumers to stop the balance payment right now and pay the entire amount on possession for safer side.
