Running commercial work in housing society.
The people living above us run the carpenter business. Often they bring their work home and continuesly work and make noises. Society has given them multiple warnings but still they do the same. Is there any chance I can file complaint against them?

I am a member of society in Navi mumbai. Society has raised a deficit bill for flats without giving the period and breakup of bills. I am a 71 year old Sr citizen and prently stuck out of India due to travel restrictions. Society is threatening to impose interest if not paid. How can they do without giving a proper bill?

Owner and Agent/Broker
I am renting a 1bhk I. Kondhwa khurd pune maharashtra . I have paid 40k deposit. The agreement was on my husband's name, however we are separated now. The deposit money wa paid by me from my bank account and the rent agreement also mentions the same . I have completed the 30 day notice, however the owner states all her property is managed by her broker. The broker has been harrassing me and not returning my deposit even though my husband has given him authorization to release the payment to me. It's been more than 10 days however the owner is not communicating with me and the broker is not allowing me to speak to her hence holding back my deposit deliberately. I am facing constant mental harrasment from the broker with new excuses and run around .

faulty ceiling fan
I am a member of a cooperative hsg society in mumbai. The person staying below me has a fautly ceiling fan which needs to be repaired but he is not doing so even when i told him i am ready to bear the expenses. He has some grudge against me for not giving cooperation for a redevelopment plan in which he was a previous committee member and the current committee members to are his friends and they too are not ready to do anything about it. I have sleepless nights as the fan makes a lot of noise the whole night and coz of that my work is getting affected. So in such a scenario whom should i complain to get the problem rectified.

definition of bachelors and families for housing societies

Dear sir,
I want to give my flat on rent and the housing society says it won't allow bachelors. When i asked about the definition of bachelor's, they could not tell me anything. Is widow, young or old considered a bachelor? Again society just kept quiet.
In my case, rent agreement is with two brothers in their late 30s. They have 66 year old mother living with them, who is a widow.. The two brothers have not married and in that sense they are bachelors.in reality, this is a family of a senior citizen mother and 2 sons looking after their mother. This in my mind clearly is a family.
Is this legal on part of the housing? What course of action can one take next.

unethical rules and regulations regarding bachelors

I am currently living in desire residency with my two other flat mates. Bachelors renting rooms is allowed here.in fact there are groups of boys and even girls living there. But the issue there is that even though they have allowed us to rent a room there, there are a lot of rules against us that make living there really tough. One of the rules being, a guy residing there couldn’t invite a girl to his flat. According to the people living there, it spoils the environment. This is violation of privacy and human rights. I invited two of my friends, which happen to be girls, to my flat and some of the people living there actually kicked them out that too at 10 pm. Atleast they could have considered the time.in fact the guards even came to my flat knocking, asking whether the girls had left. This shows i have no privacy here.
So i request you to please help us regarding this issue.

society committee not looking into common area repair and maintenance work

My top flat internal wall's plaster and pop with furniture getting damaged due to rain water seepage through external wall cracks near horizontal beam. I had repaired internal damage in last but again damaged due said external wall cracks. I have approached committee members with issue and following up since last 4 months but they are not listening and asked me to do it at your cost. Society will not pay for this issue since issue is with single flat.
Since external wall is under common area i can not rectify the issue. Kindly help here what action should i take.

not allowing to rent my flat to bachelors

I am staying in nirmal lifestyle sapphire building in mulund. I have flat in sapphire building at 6th floor. I have 4 bed room flat and its very difficult to get family for such big flat.
I have given my flat to company and they put bachelors on leave license for 11 months. I had submitted proper agreement and police verification. They are not allowing my tenant to get into my flat.
This is the against human rights and fundamental rights.

unauthorized people running the society

I am adarsh kumar handa, resident of bay village co-operative society near mes college, sancoale. I own a flat in the said society and am a full-fledged member of the society. I wish to kindly inform you that for the last 5 years, there have been no proper elections in our society to elect the chairman, secretary and treasurer for the society. It is only that a few people group together and form their own committee as per their whims and fancies. There are in total about 105 flats in our society. No proper election rules are followed and actually no elections are being conducted for the last 5 years.
Also, i would like to bring to your kind notice that due to a select few being the chairman and other office bearers of the society, there has been widespread misappropriation of society funds which has been collected from all the members of the society for the last 5 years. A lot of of money has been spent on the name of society development without floating proper tenders no one is there to question them and they behave in a totally irresponsible and dictatorial manner. There is no proper accounts maintained and nobody is aware as to how the society funds are being utilized. Most importantly, since there are no elections held to elect the office bearers of the society according to co-operative society rules, these few members do whatever they want as they know that they are the self-styled leaders of the society.

illegal parking charges and parking occupied

This is to inform you that i am residing at "a" type "a" wing 401 ranuja ramdev park, indralok phase iv, my brother (I am the joint owner) has given a flat on rental in the same building i. E "b" type "a" wing 201. We are parking our vehicle in the premises and our previous tenant was not having any vehicle but than to "b" type society (Specially chairman) mr. Saajan chauhan residing contact no.[protected] at "b" type "b" wing 6th floor 601 is charging parking amount more than they charge to the permanent members (Owner of the flat) of the society, saying that your vehicle will charged as per the amount fixed for the tenant vehicle (Rental flat).
In reply to that i have issue the letter mentioning, i am staying in the same building called ranuja ramdev park where in lay out plan (Lop) is the same than why they are charging my vehicle as per the tenant vehicle as it is member rights to park the vehicle into the premises. Even secretary is not ready to support on this his no. Is [protected]
In addition to this our chairman mr. Saajan chauhan is denying to give the acknowledgement of the letter which i had replied to them against their letter dated 29/01/2018, he commented via phone that i will not going to give any acknowledgement for the same (Conversation was made on
31/01/2018 at 10:12 pm upto 9 minutes 24 second).
Also mr. Saajan chauhan is using two parking for his vehicle which is against the bye laws and for that he does not have any register document for the same nor society has issue him such parking in agm. If any one opposed for that he strait away says that do what ever you want to,
This is my parking and no body else can use this.
I feel this is completely illegal where in the chairman of the society is breaking all the rules as mentioned in the society bye - laws.

I am residing as a tenant in Mandal house, Gouri Shankar Nagar, near-MS tower, Doranda, Ranchi. I have been staying here since 16 months. The owner is not ready for any kind of rent agreement, he doesn't even give electricity bill but charges for that. Please help me in this.

parking not as per building plan and fire act.in high rise buildings.

This building tower of 14 floor is at rna regency park tower chs ltd, m. G.. Road, ner maharashtra nagar, andivli west, mumbai 400 067.
First complaint is:
1. Parking of vehicles in compound not as per building plan, after builders allotted the parking, thereafter society committee have allotted parking by taking money from the residents. Fire engines should be able to moved in the compound as it is high rise building of 14 floor..
2. Fire life is not not functioning satisfactory. As fire alarm in the lift is not working and lift doors is also having problems.
Request for inspecting by the lift inspector for the new license for operation. Kindly do the inspection of all the fire safety equipment required in the building.
3. One refuse floor on 8th floor is used as society office and other refuse floor is also used sometime for parties and yoga or dance classes.
4.in shopping arcade some shop are closed as i belief that it is in possession of the rna builder. As per building plan i feel it is not commercial property it is shown as resident rooms.in the building plan. Request for verification's fro your office plan submitted by the builder for the noc.

complain for society secretary

Last month on 10th of sep i have parked my vehical in my society compound & on 12 morning i found my vehical was damaged, so i call my society secretry to see on cc tv to see who has done the mischeif.
In spit of several call made to society secretry no reply or no cc tv footage is shown to me & excuse was given to me every time password is missing we have to contact our contractor&sometime he say contractor is admitted to hospital.
I have incureed a lose of 8000/- for my car damage.
Yesterday on 1st oct 20017 when i called him regarding the footage he told me we will do if we get the time.
The name of my society secretry is mr rajesh parekh & his mobile number is [protected].
I hope i would get the justise at the earliest.

regarding water, drip and pour wall of the wall in my house

Chhattisagarh housing board society from my door el. I. E. Flats bought. After the allotment, till date, flip flops, drip the problem of 'l' is often through letters chhattisagarh housing board society were told but due to today the problem has not been resolved due to which were told but due to today the problem has not been resolved due to which my comdison not happy i mantally desturb.

complaint against a member
A member in our society has not paid the penalty whihc was charged to them for leaving the water tap open and goint out...in the bargain the entire society had to stay without water fro two days... This was in 2013.. The society has cahrged them a fine as decided in the agm of that year... However that member continues to default that payment and pays only a short amount against the maintenance bill and now they have lodged a complait with the registrar to inspect the accounts of the society...
I want to know in such a case of default payment can they lodge a complaint and can the registrar except such a complaint and take charge of the society

Charged high for non objection certificate

I have purchased a new flat and charges rs 35000/- for noc (By cheque and received a receipt from society). Also, chairman asking bribe rs 5000/- to issue a mortgage noc.
May i request you to clarify about legality and steps to lodge a complaint against such people and teach one lesson. So it would be a lesson to such people.

My Society in New Panvel, New Mumbai charging 20% Non occupancy charges (NOC). As per law Max 10% NOC permitted. Inspite informing Society by a letter to revise NOC, NO action and NO REPLY. However, kept charging 20% NOC more than a year & interest @ 21% for NOC difference.

Banning bachelors

Everyone says that "Youth is future of India". What if youth do not get place to live.
I am bachelor staying and working in Pune. I live in wakad. Here, the new trend is "BANNING BACHELORS". I have been forced to leave my place as society members have decided that no bachelors will stay in society. If every society started doing this where will we go? A couple had some fight with watchman so society took this action. How can you punish all bachelors just because of a single person. This problem is not just limited to my society but in entire wakad society members are doing this.
Society are now limited to families. Where will bachelors stay? On Road?
If in a society only families will stay, why is there no society where only bachelors can stay?
I request to take some serious and immediate action as I have to vacate my place by this month end.

Additional charges for providing maintenance receipts

I am staying in Gangadham chs, Bldg No.1, New Panvel, Navi Mumbai. Our society is not issuing individual receipts for maintenance. After so many complaints, sub-registar asked society to issue receipts to all members. But they are giving receipts only me, charging Rs.1000/-per receipts. Whether this is possible to charge individualy from me extra?

I want to transfer my existing home loan from LIC to SBI and for that SBI require NOC from society. I gave 3 application to society but they are not responding me and around 1 month completed. My maintenance is clear and not pending any due amount. Please suggest me.

Transparency is not maintained in society work by appointed committee

Respected sir,
Irregularities done by the members of the elected management body, namely Mr.Yelve (Secretary), Mr. Gume (cashier) & Mr. Rao. I'm a flat owner in Flat No:-205, Plot No:-7, Parvati Park, Shivganga Nagar, Ambernath - (East), Dist Thane State maharashtra Pin No.421501. During their period the committee did not maintained the transparency while taking decisions or appointing any vendors for e.g. security, housekeeping, AMC, purchase of material or machinery.They also don't try to resolve the concerns of the society members even-after repeated follow ups.They are also collecting Rs.20000/- against NOC required for flat transfer which is against laws.Chairmen fails to take legal action against the flat owners who don't pay society maintenance. And then along with other committee members they cut the supply of basic needs like water and electricity.
Do they have any rights to call AGM as their term period is over in Jan'16? The elected body term is over in the month of Oct 2015 & still there have been no fresh elections. When we ask them the reason they tell us that the members are happy with the current committee hence no elections will be conducted as they are handling society more than 10years and their should be certain limit for management body application for election is been given to the Registrar office but there is no response from your end without proper external audit of accounts.Proper balance sheet of account is not shared with society members.Committee members are failed to collect the quarterly maintenance from flat owners.They are increasing insecurity in member by forming groupisum within society members. Chairmen, treasurer takes decisions without taking other committee or society members in confidence.
Sir, above are few examples (there are many apart from this) of the misconduct done by the Elected Management Body Members & I earnestly request you to please probe this matter seriously & help us in conducting fresh elections & regularizing the work related to our society.

Society not issuing share certificate

Dear Sir,
I have perches resale 1 BHK flat at PUNE, my owner has paid 25K to society for NOC and based on that I have complete sale deed, and owner all document handed over to me, now I am asking to Society chairman to issue the share certificate, but he refusing and asking 10K more for as per 2% of purchasing Value which is near 35K, last 8 month I have follow up but they still refusing me, I contact my owner but he say I already give it you all document go to police & launch complain against society, but I am now little worry, also they warning me if you not paid that balance amount we will stop your water supply will stop your entry, parking etc... please help me what to do.

Blackmailing and gunda-raj in mahagun mosaic ph-1,society

HI,
on the reference of gundaraj and misbehave to the society residents by
RWA of mahagun mosaic ph-1 society.
The current RWA members (Abhinav Tiwari(general security), Dinesh
Yadav(president) of mahagun
mosaic ph-1, sec-4, vashali, ghaziabad.not running any Society, but
threaten and blackmaling society member.
The chit fund and sociery, meerut done audit(as attached in below
mails) and found lot of loopholes, but event then RWA members threaten
and doing cheating the society members by charging electricity pre
paid meters(half the total amount)ie On Rs 1000 charging only Rs 500.
All the RWA members and their subordinates use free electricity
coupons and its confirmed in chit fund audit report.
Kindly help the society members to stop illegal electricity
blackmailing and stop RWA gundaraj in the society.

No supply of water.
No water supply in flat No 702 A wing B Type Nira Complex, Behind New Golden nest police chowki, Bhayander East 401105.
I given a letter on dated[protected] to society address to Chairman / Secretary / Cashier but no given written acknowledge. Almost one month is near to over no action being taken by the society. In my flat no single drop of water is supplied. Where as all on 1-2-3-4 floor are getting water. On verbal discussion with chairman and secretary of the society simply they are telling that member of 1-2-3-4 floor not shutting down their line after the problem will continue. I requested them the to given separate line to 5-6-7- floor and given three option also but no hearing from. My contact detail [protected]
