Respected Sir, Im having a shop in Mahavir Villa cooperative Society in Palghar, Dist -Palghar Society has not given basic facility like Common toilet, lights and water supply to shopkeeper. Now they are trying to make boundary wall In front of shops and blocking our customers. Kindly take correct strict action against the Society.     I m member of one of society, which located at Naigaon-Vasai. Last year i had given my flat on rental basis with proper goverment register agreement and policy NOC. Which i had also informed to society chairman about the same. Now i want to renew my agreement with same licensee for next 11 months. But society demanding Rs 5000/- for renewal agreement with same licensee. And this rules was passed in society meeting as confirmed with chairman. So kindly confim whether this is valid and where i can register my complaint about this to get solution ASAP,

      I owned flat in Kandivali & I want to let it on Leave and License but my housing society is asking me to pay Donation to Society every year then only tenant can live in my flat otherwise tenant can`t enter in my society. Society is not giving any receipt against this payment and also non occupancy charges not charged in my monthly maintenance bill.

      I don't want to pay this donation, society submitted minutes on above matter passed in last AGM & due to only 3 flat on L&L majority side of other members approved this resolution.

      Please guide me on this on urgently how to save my money & how to stop my housing society to do unfair practices.

        There was AGM held on 11th Aug 2013 for our co-op housing society .My husband who is member was not able to attend it .I being not a member did not go for it.Then a watchman was sent to call me and when i went not only i was asked to attend it i was asked to sign the attendance sheet.There was another lady who attended and signed attendance sheet,This was done because there were not enough members present and an A G M cannot be held with out a minimum attendance ( Unless the forum is there).Once A G M started after much latter few more people came.

        During meeting i had few objections and i raised my hand ,sought permission to speak and only when i was allowed to speak i raised my objections and also requested the committee to put it in the minutes of A G M which they agreed in front of everyone.

        On 14th AUG 2013 they wrote a letter stating that i had no right to attend AGM being a non member and raise objections.They don't want to put my points in A G M minutes and hence this is done deliberately. Pl guide as the committee is seeking ways not to listen and most residents are non vocal. I want my objections to apper in minutes of A G M so that it reaches everyone.Thanks .

          Hi sir,

          I am Amit Chhetri Staying in Bangalore for past 6 years. Last year I bought a flat in begur road. Till now builder was maintaining the apartment so every think was fine.
          But now builder is handing over the flat to the association. Now association is telling we will not collect maintenance as builder has collect i.e (Sq ft basis) we will go in mixed way. We are having flats from 625-1550 sq ft. If we go in mixed way flats with lesser area have to pay more money and flat with larger area has to pay lesser money in comparison to sq ft basis.
          In sale deed it is clearly mention that what ever common expenses has to be collected sq ft wise only, but they are more in no. so they are telling that majority is our so whatever we will decide we will do that. They are not ready to except the sale deed point.
          Please suggest me what we can do. Can we file case in consumer court or what?

            Recently my brother in law has started staying with me who has own a two wheeler. When i requested the society for a parking slot, first they refused to allot the same saying there is parking space problem in our society and also told that they will allot the parking space only if i pay parking charges which the members who are staying on rental basis i.e. double of a member. Now had issued me the maintenance bill in which they charged Rs.100/- parking charges. The actual parking charges for two wheeler in our society is Rs.20/- i.e. the society had charged 5 fold more. Is it justifiable?

            Further some members in our society has more 3 vehicles (using for commercial purpose) and the society has allotted the parking space for all their vehicles. Is it justifiable?

            Please give me information regarding the parking rule of vehicles inside the premises of housing society. What is the minimum distance that has to be maintained from the windows of a ground floor flat so that there is no disturbance caused for the people residing on ground floor.

              hello friends

              i am kiran i m facing some isuue with the society commitee members..... plz give me the proper suggestion or let me know my legal rights



              it is about the maintaince , in the last general meeting it was decided that if any one is facing genuien issue in regards with maintance need to give the letter before the maintance due date and they will consider it.As i face the economic issue 1st time in last 6 yrs and i was not able to give the maintaince and i have also given in written but no reply was sent to me ..(if you will check the record i am the regular payer in maintance )and they have charged the late fee


              let me what action can i take for this and where can i complaint abt it >

                chairman & secretary not solving problem and abusing member of complaint

                We have drainage system problem in our society and water doesn't pass through drainage system and overflow from tank, we have asked the housekeeping person to clean the tanks on time so we won’t face this problem instead of cleaning tank he ask for money, he don’t clean society premised and collects garbage from flats if he and his wife want to collect or else we have to go to municipal garbage bin to through garbage. when...

                I have purchased a flat in s society. The Society had given me NOC mentioning that there are no pending dues from the owner. The same thing was also mentioned in the "Sale Deed" agreement which the owner had signed. After a year it was found that the owner had not paid the maintenance for last two years prior to sell of flat. Now the society has imposed the dues on me. I have informed the previous owner about this thing, but he is not bothered about it. Please advise what needs to be done.

Committee member of our society are not taking any required action as they are not effected by this problem . so much of shortage of water is there we have water only for cooking purpose. this problem we have suffered last summer too. that time they verbally promised they will try to solve problem . now same problem we r suffering . can u please solve this problem as soon as possible please.

                    My housing society MC refuses to act when I submitted a complaint of water leakage into my flat from the flat above.
                    I would like to know if the MC is duty bound to act and make the flat owner from whose house the leakage is caused.

                      Our CHsg.Society has started locking the Compound entrance gate and as well the entrance to the Staircase/lift. This is done by the Night
                      Watchman at around 12 midnight, after which he goes to sleep near the Pump Room 30 mtrs. away from the entrance.
                      Members coming/returning home after 12am are left helpless outside the bldg, yelling to the watchman to open the gates. after a lot of commotion he is woken up, similarly members wishing to go out of the bldg. premises are again handicapped.
                      The watchman tells us the Chairman has told not to open the Gates till 6am ??What do we do in this situiation . whom should we lodge a complaint to.??

                        i have a flat on the 3rd floor, the 2nd floor occupants complain of water leakage from the bathroom, mason confirms there is water proofing problem so entire bathroom needs to be broken, estimated costs rs.50, 000, which is huge, and we are being pressurized to get the work done, however as per my knowledge such work is done at the time of construction and should be borne by society as we maintenance charges every month pls guide on urgent basis. can this act rescue us in any manner.

                            Hi, we stay in a society that shares the boundary with a small temple. The temple is surrounded by many societies. At least once a month there are loud prayers and celebrations that are hosted in the temple which sometimes continue till midnight. During festivals like krishnamashtami, the prayers on loudspeakers begin at midnite, on other occassions it starts at 4Am and continues till 8in the morning. It destroys our sleep and on other occassions, annoy the sick and students preparing for their examinations.
                            Today is 26th of Jan and its already 11PM, the prayers are still going on which started yesterday night!
                            Firstly, I'm not sure, whether we can file a complaint about this, and if yes, where can we submit our complaint.

                            To The Residents Associations,

                            Residents here have observed that there is Increase in Loud Noise Pollution Levels in Residential areas near Hebbal - Kempapura, Bangalore, Karnataka, that has been affecting Elderly Residents in particular & also the People working in Night Shift & Evening Shifts. Very Loud Levels of Noise Pollution in these Residential areas are a Disturbance here. There seems to be Continuous Noise Pollution Levels from Early Morning in turn Spoiling the Sleep of The People who work in Night shift & Evening Shift here.
                            Bikes Driven by Teenager boys are Creating A Lot of Nuisance here Raising Accelerators of Bike in Residential areas near Hebbal - Kempapura, Bangalore, Karnataka. There is a Bike Driven by a Teenager Boy that has been Creating Nuisance here by Raising Accelerator of Bike & Making Very Very Loud Deafening Noises with the Loud Engine Noises Disturbing Residents here on a Regular Basis. There is a Bike Driven by a Teenager Boy that has been Creating Lot of Nuisances here with the Loud Deafening Engine Noises & Raising Accelerators of Bike Daily basis. Hope the Residents associations here will look into this.

                              The committee did not follow the election procedure in for getting themselves elected as committee members. They got themselves elected in the Annual General Meeting.

                              The committee did not sign the M-20 bond which according to me is mandatory.

                              Would need your help to get me some court judgements with regard to the above two issues.

BEFORE THE LAST AGM, HE MADE A COMPLAINT AGAINST ME AND OTHER OFFICE BEARERS THAT WE ARE LIKELY TO PREVENT HIM PHYSICALLY FROM ATTENDING THE AGM. THE LOCAL POLICE STATION IMMEDIATELY SUMMONED THE OFFICE BEARERS TO POLICE STATION AND DEMANDED EXPLANATION FROM US AND WASTED OUR THREE HOURS. DURING AGM,...

                                Our Housing Society Office Bearers,Have been Demanding Money from us for no reason, Since 2003.They do not have any Records or Documents of the Amount Money, They keep demanding from us, But very smartly add Interest to that amount Every Year.Because i have asked them for an explanation of the amount, which they do not seem to have. They Threaten to Seize our room and Cut our Water Supply, if we dont agree to their Demands.They even sent a letter to the NMMC Ward Officer Water Dept, Nerul , Navi Mumbai. to disconnect our Water supply.. They even send Notices Demanding Money Directly on our Name.Though they have not made us Members till date in the society. Even the Monthly Service Charges we pay every month, even those Receipts are given on the Previous Owners Name. In the Notice sent, their Advocate has demanded 1,000/- Rs One thousand only ,extra for the notice sent , however they demand 16,000/- Rs Sixteen thousand as legal fees.In their other Notice sent by another Advocate to us demanding 1,500/- Rs One thousand five hundred only, extra for the notice sent, however they demand 25,000/- Rs Twenty-five thousand and more as legal fees and litigation etc..Reason best known to them..Why??                                 None of them have been able to provide any explanation regarding the amount they keep demanding from us.Reason best known to them Why?? We were told to go to court by Mr D D Kolte - [Chairman / President] regarding this issue. So as a consumer we filed a complaint In the Consumer Disputes Redressal Forum. CBD Navi Mumbai. My complaint no 45/2010 in Feb 2010. However when ever we were called to Court several times, The society office bearers Never Came. As they think they are the Landlords of the Society. However surprisingly an order was passed in Dec 2010, After nearly a year. By Mr R D Mhetras [President], and Mrs Jyoti A Mandhle [Member], That this complaint cannot be put up in the Consumer Disputes Redressal Forum. CBD Navi Mumbai. and Dismissed the Case.. Unfortunately Housing societies do not come under the RTI Act 2005 So We approached the Joint Registrar of CoOperative Housing Societies. CBD Navi Mumbai. Though we have been writing to the Joint Registrar of CoOperative Housing Societies. CBD Navi Mumbai. Since 2006 to get this issue cleared however we have not got any favorable response on this issue. So we wrote an RTI application , Not One But we had to write Three RTI applications, Since May 2011. But no information was given to us.Again.. So we gave another RTI application Our Second Appeal To The Commissioner , State Information Commission, CBD Navi Mumbai in Sept 2011. However its been 2 months and we have not received any information from the Commissioner, State Information Commission, CBD Navi Mumbai. nor from the Joint Registrar of CoOperative Housing Societies. CBD Navi Mumbai. In fact we also sent a reminder to The Commissioner, State Information Commission, CBD Navi Mumbai. Regarding our RTI application.. We received a letter from the Joint Registrar of CoOperative Housing Societies. CBD Navi Mumbai, calling us no the 8th of Dec 2011. As they had received a letter from The Commissioner, State Information Commission, CBD Navi Mumbai. Appeal No KR2075/2011, Dated 14th Oct 2011. Requesting them to give us the Information we had asked for, However when we were called in the office the Joint Registrar Mr Vikas Rasal ,told us that No information can be provided since the RTI Applications were not in proper format the way he wants it to be when we asked what is the proper format He said I am not here to give Advise and refused to give any thing in writing..And WASTED another day of ours.. Is Our System So Bad...That a common man has to wait so long for Justice and still does not know weather he will get Justice or not....AS DELAY IN JUSTICE IS INJUSTICE.. As It Seems RTI Act Is Just A Waste Of Time, Which We Pay For..

                                  Our Society was formed with the municipal employees. The builder / chief promoter had collected 20% of flat cost from each member. He also had collected Rs. 250/- from each member towards the 5 Shares. On formation of the society it obtained 80% loan from the Municipal Corporation.

                                  After a period of possession and issue of the certificate, one member surrendered his flat to the society, which was further allotted to a new member
                                  .
                                  What steps are required by the society in above case. Whether the share certificate, which has already been issued to the old member who surrendered his flat be cancelled with immediate effect on surrender of the flat? and a fresh certificate be issued to the new member? OR the same certificate be re-issued with entries for transfer of flat and endorsement on the back side of the share certificate?

                                  As said above the builder / chief promoter had collected 20% amount along with Rs. 250/- for 5 shares and entrance fee. Can society re-collect those amounts from the new member?

                                  Pl clarify in details and also quote appropriate Bye-law, act etc.

                                    i m a residence of a RUKMINI VAIBHAV CHS, situated at kanakia road, nr.mac-donald, mira road (e).I m also a comittee member of our society. During meeting 9 members out of 20 were present.As other members were not knowing regarding the permission of Chairman,and attended the meeting, even i was also not present in the so called meeting.
                                    Now i would like to know can this meeting be called a liable, or shall we disqualified this meeting, where a permission is not granted from a Soc.Chairman. Even a comittee members were not aware of this meeting.Their were no discussion with the comittee members regarding this meeting.

                                      our society has passed a bill to put up asbestos roof ceiling on the terrace of our building to avoid water seeping in the top floor homes. the per block contribution of the 15 house building has been put up at rs.12000/- each. . since i have moved in of late i have not been registered as society member so i have no say in the proceedings of society. in the past too a number of measures were taken and plenty of money has been wasted for water proofing of terrace. are there no any alternatives to avoid putting those asbestos roof ? . please help.

                                        Oue Society is collecting Rs1000/- as repair fund from each member to be collected for 12 months this was passed in SGM,now from this month onwards Managing Committee has send maintenance bills for next three i.e.for April/May & June months.
                                        Please advice whether Society can charge it's member for the service it has not provided,water charges it has not supplied or can charge 21%penalty in case not paid on time

                                          I stay in Shivani Apartments, Plot no - 63, Nr. Balco Market, IP Extn. Patparganj, Delhi - 92 on a rented accomodation. I am not provided any rule book by the society nor have I received any balance sheet since I have been staying here (Oct'2009). Everymonth I am paying maintenance charges of Rs. 750/- but other than water and security guard all the other facilities are self paid. This maintenance are being paid by me and another tentant who stays on the low floor since its a duplex flat. Total we pay 1500 /- as society charges just for water and security guard. Request you to help us in getting the balance sheet or detail of the expenses because without getting any facilities these charges are too much.
                                          Also since we are not provided any rule book, everyday some new rules are floated on us. Request you to help us in getting the same as well.

                                            I stay in Shivani Apartments, plot no.-63, Nr.Balco Market, IP Extn, Patparganj, Delhi on a rented accomodation. I have one car which is being parked outside the society premises due to unavailability of space for parking in the society. Still I am forced to pay Rs. 200 per month as parking charge to park my car on the road outside my society, by my society president. On demanding any authorisation from MCD he threatens to break my car or not to allow my car to be parked there. I have been paying these parking charges since Nov'2009. Request you to help on this illegal parking charges being charged by them.

                                              Dear Sir,
                                              I am staying in Thakur Village, Kandivali-East in multistorey building. The person staying one floor below under our flat complained about leakages in their flat coming from our flat. Since the construction was made by builder, we did not make changes, it was due to the poor workmanship by the builder. Still we did rectification under supervision by our society committee. The person who complained did not share the expenses (in our opinion he should have shared 50%). Again after a couple of years he started complaining. We feel the leakage is not from our bathroom. However we were ready to share the expenses but the fellow is not ready to spend money. Now he complained to the society and the Chairman stopped water supply to our bath room. Is it legal to stop water like this ? Is it fair to spend money on each complain made by some members?

                                              Housing Society — stopped water supply

                                              I am residing in a 2 BHK flat. The flat is in my name only and other flat owner requesting me to take the decision on this. There is a common water supply system for building. On the ground floor storage tank and at the terrace we have syntax tank and from this syntax tank water is distributed to all the flats.
                                              As per the declaration agreement between Land owner and Builder, Terrace is belongs to the Land owner. Now Land owner wants to acquire all the flats. He stopped water supply (expects his flats) and locked the terrace area.
                                              When we launched the complaint against land owner to the police, police saying this is a civil matter we can’t into the problem, might be bribe effect.
                                              Can someone please reply to this thread on priority basis, because last 7 days we suffering from water, all the flat owner collecting water with labour-intensive from ground floor to 2nd, 3rd floor.
                                              Please help us to resolve this matter on urgent priority
                                              Hope you understand.
                                              The police should have been acted on this immediately. Anyway, inform the registrar and file a case case against the builder collectively.

                                                Dear all,

                                                I stay in kalyan with my parents and my sister. My sister is unfortunately a victim of polio and is 80 % affected. She can only move on a wheel chair.
                                                We stay in fourth floor and the building i stay has lift and power backup. But from the ground floor to the ground there are 2 stairs and no ramp. This makes it very difficult for me to get my sister out for daily round in the evenings or to hosital etc, as we always have to look for someone who can lift the wheel chaiir for just these two steps.
                                                We asked committe members of the society to give us permission to build concrete ramp on our own cost. and that too just six inches wide on two sides (that leaves stairs usable as well) so that wheel chair can be moved. But they have denied and asked us to make a wooden plank or metal ramp temporarily. It would be difficult for my parents to lift that temprary ramp.
                                                Are physically challenged people denied of this simple amenities? How can society members be so insensitive ?? Can i complaint against them ?

                                                  I had purchase a Flat in Shankeshwar Nagar Co-Op Hsg Society from the Builder in the names of "Sanjay Sanghani"(Being the first holder) and "Chetan Shah"(Being the second holder and my brother-in-law), in May 2003. Subsequently, the name of Chetan Shah was deleted from the Agreement in Aug 2003 and the agreement was duly registered after paying necessary stamp duty and registration charges. However, when the society was formed, the builder had provided the old agreement with both names to the society and the share certificate was prepared by the society accordingly. Now, the society refuses to transfer the share certificate in my single name though copies of both the agreements are available with me. According to the secretary, a letter is required from Mr Chetan Shah for removal of his name from the share certificate. I do not know where Mr Chetan Shah is currently as I have not met him since the last 5 years. I have requested the society to transfer the share certificate in my single name, since I intend to sell the flat, which they refuse to do so.

                                                  Please suggest:

                                                  1) What is the action that can be taken for transfer of share certificate
                                                  2) Can I sell the flat without the society transferring the share certificate in my single name.

                                                    i am the chairman of the shri ganesh krupa society, our building having the 60 Rooms but 55 Room only have member to us , 5 are not member to the society, they are tanant of bulider, They are not paying the society Charges,
                                                    Our charges are only 300 rs. and we chargeing to non mamber 400 rs. but they did not paying the anount, for Ex. Room no 9 having the amount 1,90,000 rs. out standing. they are not our mamber what kind of take we can the action on them.
                                                    22 nov 2010 we had i mitting with all member. in that mitting all member are disided cut water suply those room. they are not member, we can not take Act/ 101 action. So we can cut those water line. we was inform to builder also abot this He is also not wory about that. He said Society can take action.
                                                    Please help us.
                                                    Room no 9 is Non member of our socity and he had out standing 1,90,000 rs. and also he was did very dengarus work. He staying Ground floor, His room back side he brok the wall and made the one door. without our or municipal or builder permition. Thatwhy we alrady complaint to municipal carporation. Can you please gide me , i did not to creat the problem to members.

                                                      I'm a Senior Citizen living with my son and daughter-in-law who have purchased a dwelling unit in a recently redeveloped Society (2004). The Society is having 3 wings, A,B &C. 'C' Wing is completely new from plinth where we have purchased a flat. In A & B wings 2 floors have been newly constructed.

                                                      Now again office bearers of the Society with some aim in their mind are again trying for redevelopment and have brought 2 proposals from 2 builders/developers. They have successfully convinced with various means to the majority for necessity of redevelopment. In proposed redevelopment there is no benefit of additional carpet and after redevelopment the maintenance charges will be 3 to 4 times high, hence my son has opposed for redevelopment. The Society did not get the time to conduct AGM and to submit Profit & Loss and Balance Sheet for last two years.

                                                      Please guide what are avenues open for us to oppose the society for redevelopment on individual ground.
