I have booked plot in sai garden paruthipattu 1.6 year back due to legal issue i have cancelled my booking within a month . after that i am struggling to get the refund of my token amount. Now, They denying to provide the refund as per the terms and conditions mentioned in the invoice receipt. That is 15, 000 is cancellation charges. Looks like it is fraud company. Cheating the public by offering improper assets.

I have booked two plots no 12, 13 with Krish Housing and Properties Pvt Ltd on 9/Aug/2021.

I have appealed for a cancellation three months after booking the plots (it was a long wait since the property did not have CMDA approval at that time).

As per the terms and conditions in the invoice, I will be charged 15% of the booking amount. But, the property developer is failing to refund the booking amount deducting the cancellation fee of 15% of the booking amount even after two months of our hand-written cancellation requests.

I am quoting their email response which says that they cannot refund the amount since they are paying interest to someone else for reserving (on hold) with someone else.

As we discussed over phone call, You Requested for cancellation Sai
garden Phase1 (Plot 12, 13 SQFT=2155), But we have completed 90% of
banking work and U booked in the date of 9th Aug 2021 Almost 4 months
completed, So Since we paying 2% interest to vendor for 4months but u
asking now cancellation without completing registration .. So U have
done 200000 Booking amount for this plots ..As per company norms we cant
refund the amount more than booking amount we paid interest for this
plot."

I am currently in Riyadh due to work and my contract is going to end in April and may not be renewed. What are the legal options which my father can take initiate against the company while I am here?

I booked one plot in pulipakkam, chengalpattu near by toll gate. Krish housing and properties (Rajesh-sales person) said like pay 1lak and register you plot. Then remaining amount they will arrange bank loan.

Before booking the plot, i clearly said them i have education loan. If loan is not eligible i am not going to book plot. We have persons in all banks. Don't worry about loan. So i belived him and i paid 1lak for advance...
