I had purchased a 1bhk flat in 2007 (Flat no. 6) from mr. Hemant vadhavkar in abhimanshree housing society jyoti nagar, aurangabad. I am the third owner of the same flat. Mr. Vadhavkar had purchased that flat from mr. Bhosale in 1997.

When members of society met with chairman and secretary to handover the society to members. (As chairmen and secretary are builder of that apartment and not staying in the premises). The secretory said that there is loan over the flat no 6 and owner need to repay the same. Till date secretory not told me anything about it.

When i came to know about it, i checked all the documents and i observed that loan details are no-where mentioned in any of the registered document (Ie. All 3 registries). I cross-checked with mr. Vadhavkar but he was also unaware about the same. Then i checked it with the bank (The maharashtra state housing finance co. Ltd. Aurangabad), i found the loan against flat no. 6 by name of mr. Bhosale. We don’t have any contact details of mr. Bhosale and not found with society as well.

Mr. Bhosale had taken 1.25l loan in 1993 and replayed amount of 1.55l in 1997. But as per bank statement, still he was having 59000 loan balanced in 1997.
Now bank demanding 2.04l amount to give the clearance letter.

Chairman and secretory are very arrogant and they said you have no option and you have to repay it.
Society not even audited since last 10 years.
Could you pls help me in this regards.. Shall i go to court or have any option?

EVEN AFTER PAYMENT OF LAST INSTALLMENT WE ARE NOT RECEIVING THE NOC AROUND 1.5 YEAR HAS PASSED .THE OFFICERS INCHARGE IN SATARA ARE NOT KNOWING THE PROCEDURE OF THE SAME WE ARE FOLLOWING FOR THE SAME FOR LOST 1.5 YEARS

PLEASE LET ME KNOW WHAT SHOULD BE MY STAND
