[Resolved]  ABN-AMRO Bank Credit Card — Harassment from collection agency & Wrong CIBIL status

Sir,

I was holding an ABN-AMRO credit card bearing no.[protected] during 2005 to 2007, I used the card for Rs.13700/-, (Rs.Thirteen thousand seven hundred only) the bank sent me a statement for Rs.15000/-, I disputed this because the card was offered me for free of charge for first 3-years along with free insurance, so it become due and the bank made many follow-up calls, I told them the fact that I will pay the actual amount used as per your offer if you are sending me a revised statement.On August-2006 one person visited my residence, he introduced himself as Collection Executive from ABN-AMRO Recovery dept. he was holding lots of credit card statement along with my statement, I told him the fact, he told me remit the actual as full & final settlement, he collected the money from me and wrote and given the same on the statement which he brought, he told me that the settlement letter will sent through courier, also told me that we have already handed-over your file to our legal department at DELHI, so there is chance of getting legal notices to your address, he advised me to not receive it and just ignore it. As he said 2-3 Notices was there I ignored it. After that there was no communication till last year, I thought the card is settled even-if I didn't received the settlement

after a long 6-years, last year I got a call as well as an e-mail message asking for the settlement of my entire card amount from "RBS". I got shocked, I told the same-above to the person who called me, and there was no communication till the time, now somebody from Phonix ARC (claims as syster concern of the KOTAKMAHINDRA BANK) regularly calling and harassing me to my personal mobile numbers and residence land line numbers, they are threatening me that you are in CIBIL record, you have to settle the credit card amount Rs.19464/- and are offering settlement + NDC for Rs.15000/-, actually I don't have any dues with the bank. Because of this wrong CIBIL status I am not getting any banking services from any banks.
please kindly help me to close the issue to up-date my CIBIL status.

COMPLAINT UNSER SECTION 12 OF THE CONSUMER PROTECTION ACT, 1986

The complainant most respectfully showeth:

1. That the complainant is an individual person and is an advocate by profession.

2. That the opposite party is a bank duly registered.

3. That the representatives of the opposite party called the complainant and offered to take a credit card of their bank i.e. the opposite party.

4. That the opposite party has issued a credit card facility to the complainant at Lucknow vide credit card No.[protected].

5. That the complainant used the said credit card in the manner prescribed.

6. That the complainant also paid each and every bill on time as and when generated.

7. That all the statements of timely payments made to the opposite party are duly maintained / recorded with the complainant as well as with the bank as the same was generated by the opposite party bank itself.

8. That there are no dues upon the complainant against the opposite party.

9. That however the opposite party many times used to call the complainant and harassed to make the payment of the opposite party as there are some dues still remaining as per their information.

10. That the complainant told the opposite party that the complainant has already made all the payments to the opposite party against their bills and now there is nothing remaining that is to be paid.

11. That the opposite party is in the habit of harassing the complainant mentally and torturing for dire consequences.

12. That the opposite party threatening the complainant to pay the opposite party as they demand or they will make the complainant’s life miserable.

13. That the opposite party not only itself harassing the complainant but also harassing the complainant through their advocates and trying to use the law for their extraneous intentions.

14. That the opposite party also started some arbitration proceedings at New Delhi through their advocates in which the counsels and the arbitrator all are their own hired counsels who just want to harass the complainant through every possible means.

15. That the advocates of the opposite party called the complainant at New Delhi just to pressurize and making influence upon the complainant and also for the mental and physical harassment.

16. That the acts and actions of the opposite party are the gross deficiency in service on the part of the opposite party.

P R A Y E R

Wherefore for the facts, reasons and circumstances as stated above it is most respectfully prayed that the learned forum may kindly be pleased to grant the complainant the following reliefs:

i. Quash the unjust demand of the opposite party.

ii. Direct the opposite party to pay to the complainant following amount for the compensation:

a. For mental harassment Rs. 50, 000/-
b. For legal expenses Rs. 7, 000/-
c. For defamation Rs. 50, 000/-

TOTAL COMPENSATION Rs.1, 07, 000/-

iii. Any other relief which this learned court/forum may think fit in the interest of justice and the circumstances of the case may also be granted.

I would like to bring up this issue to the concerned notice on my credit card which am not using at present but there is a due payment, for some personal financial reasons and health isues i cud not pay in time and I agree there are some mistakes from my side but same time its not deleberatly done as i did not have any idea of cheating run away knowing that its not possible and a position i hold i can not ...

coming to the point ... last couple of months when i was able to arange barrow some funds i approched your collections people who was literly behind me and thretening I request them to do me a favour to close the card and asked them for a decent discount on the closing amount with three or four instalments . I trust that M/s. Info Management services, Domlur Bangalore is one of your authorised recovery agent who gave me a option and settlement amount of INR 25000/- for which i was asked to make a initial payment of INR 3000/- towards settlement process and towards first instalment of 16000/-
totally i have made a payment of 19000/- as part payment for final settlement further the balance payment of 6000/- was supposed to pay by cash or DD once i have the settlement/closure letter on hand which was agreed and from there on there was no response from the said agents and after couple of months i traced out teh person who was in touch with me and upon checking with him i was told that the settlement letter is in process and they wil contact me once its ready .but again nothing happend.

now after more than 6 months the same person started calling me as he does not anything and troubling me for the payment ..when i asked him about his commitment to me on the settlement he claims that he cud not do it and now I shud pay the dues ...when i said its not possible they threat me on creating a scene at my office and home if i dont atleast pay a min amount to avoid problem at my office i paid a amount 1600/- on 28/1 2009 upon the same person commitment that he wil rework on the settlement but today i get e cal from the same person again asking for payment and if i don't pay the amount (min amount ) he wil create problem in my office

If I get a positive revert from the concerned i can produce proof of the abv said payments done and also idnetify the person

I Applied for a Personal Loan from HDFC Bank in last week.During there enquiry process they got complaint that I had credit card with ABN AMRO Bank showing writeoff.
Actually I never used credit card.
Please issue me the non complaince certificate other wise my loan process would be rejected.

IAMABN AMROCARD HOLDER FROM LAST FIVE YEARS AND REGULARLY MINIMUM AMOUNT DUE ON DUE DATE. ON 25.11.08 I WAS PAID MINIMUM AMOUNT DUE FOR NOV.08 RS.6000.00 PAID CASH ON 25.11.08 TO BANKS AUTHORISED BPO SAIFINANCIAL NAGPUR VIDE RECEIPT NO.49202 25.11.08. BUT BANK CREDIT MY ACCOUNT ON 11.04.09. IN BETWEEN BANKS AGENTS CONTINEOUSLY FORCE ME FOR PAYMENT ON TELEPHONE AND SENDING THEIR GUNDE AGENTS. FROM NOV08 TO MAY09 THEY ALSO NOT SEND ME ANY STATEMENT OF ACCOUNT.AND DEBIT 650 LATE FEES EVERY MONTH UP TO MAY09.AND CONTINEOUSLY HARRSH ME EVERY TWO MINUTES GAP ON TELEPHONE FROM DELHI. How much will take to investigate payment of Rs.6000.00 five month already been passed but investigation not ye done. You are every moth debiting my account by late fees Rs.650.00. and chassing me for payment by your agents every 2 minutes and harrsh me regularly. Then how to add in bill statement for critical illness DR Amount 13612 & convert in to easy pay transaction ??

Pl check the & reverse that amount because I am not interested in this type of policy.

Sir/Madam,

I am using your credit card No. [protected]. Today i.e 12-9-09 I received a phone call from your bank by Mr. Raj Sharma ph. No. [protected], 46861800, 46766400 for a offer to credit card customers. I had gived my home phone no. to your bank, from there he got my cell no. and since then I have received more than 6 calls on my cell and equal no. of calls on my office and home phone no's. He has asked me to tell my father at home to talk to the person who calls again after some time on my home phone as Karan and not as his father. What is this? why should my father tell a lie. I and my family is very disturbed and harassed by these calls again and again for offers which I donot want.

Please instruct the concerned people not to call us again.

Dear Team,

I was surprised to know that my name was there in CIBIL list. I came to know about this by my bank when i applied for auto loans. My loan has been held on the ground that there has been some amount due on some of card issued in 2003 on my name. I don't even remember if I maintained that card. I have request CIBIL to furnish the details. I am clueless on how to deal with this. I am taking this a complete harassment by the bank.

I used services of ABN AMRO CREDIT CARD no.-[protected],which expired in 2008,in d starting I got a call 4m bank that on d amount of 545 per month they were offering FAMILY INSURANCE SHIELD for 2 year ,I purchased d policy,and paid my all EMI sincererly,but at end d end of first year I had not recieved any renewal docs,for that I talked to d customer care bt all went in bin,bank sent me regular reminder for that amount 4 which I didnt get any service even after request,bank want its 7275.30 but when I asked 4 my 2nd policy he had no reply,and adviced me to talk to ICICI bank,but at d time of issue of policy,I didnt recieve any call 4m ICICI.I jus want to confirm how ABN AMRO bank is working,without confirming 4m it s couster how they charged for such service which could not avail to me.
Plz do d needful,plz issue me d policy of second year so I may par d amount to d bank,or plz reverse amount i[censored] r not in position to privide me d best service.

ABN AMRO Bank — wrong statement

I was using ABN Ambro bank Credit card since a long time and at that moment bank relation was also very good. As my good payment track record bank offered a loan to me and it was also cleared before time and I got back all my PDC on time.

In the month of April I made a payment of 25000 through HDFC bank and after cleared the cheque I called to ABN call center no[protected] for cancellation my card, and want to know if any o/s are remaining in my a/c, the concern executive conform to me that bank have 1683.97/- excess and also convinced to me that you continue the card she also offering some scheme to me but I didn’t agreed so she logged the cancellation of my card.

as per her commitment I got the refund DD of amount 1683.97 dated on 26.5.2008 and I insured that my card has been cancelled. On 15.06.2008, I got a statement with due 0/- (zero) available balance zero and credit limit zero, after that I was insure that my a/c has been closed.

In the month of July I received a call from Delhi and as per caller executive he calling from ABN Ambro bank and demanding 50 thousand rupees against my card, I was shocked to know that after 3 month of cancellation why bank demanding so much amount to me and I approach to local office and mark a mail at [protected]@in.abnamro.com and a local executive harshadkumar.m.[protected]@in.abnamro.com on 19 July but I didn’t get any response from our end.

now my name shown in CIBIL, pl suggest

initial stage of credit card abn amor person reach to me and ask me for credit card and literly cry and say just keep it with you there was no charge for it but i fulfiled my target then he did papper procedure

and during that i again ask was there any charges he said no charges if you did not trust me i called my sinior and he called and clear it

now after six month i had received call for lady that we were sent you dd of rs 6000.00 that you can use as you like and i ask her why are you sent me that you just keep it because it decided to sent and phone cut

after three four days i had received dd and i surprice how any singneture and any my permition some one send me dd

i have not used it and even i reach to abn amro office at alkapuri and ask about department of credit card. That office in such good looking building but no one reply me to where to and whom to talk

i have not used it even that some abn or other one send me defolter like in cibil and cibil accept it to calculateing score etc ...That thay writen such writeoff

amout is somthing around rs, 6728-00

for any one this amount not that big i do not understand how finance ministry or rbi or whom so ever authorized in india to give permit ion to cibil and abn bank ( something royal etc) to do such practice
1) without permit ion sending dd of rs, 6000-00
2) our city no office of credit card to reply about that dd and what to do with it to submit it to abn bank ?
3) not ready to discuss matter with us during the periods of 2007-8
4 ) how such bank have given premonition by rbi and finance ministry and now cibil has not even ask the bank issue of credit card or wt ? means cibil is just lethargic and indian citizen has no value of life peace
5) we need clear and perfect reply form authority of finance handling department in india (bharat)
^) our time is e consuming with such issue by the lack of ...

How such bank allow to do work in india
