[Resolved]  Maruti Suzuki India Ltd. — Supply of damaged vehicle

Dear Madam/Sir,

This is regarding Supply of Damaged Vehicle by Maruti dealer M/s Anand Motor Agencies Ltd, Lucknow. I had written several mails to the dealer M/s Anand Motor Agencies Ltd, Lucknow as well as Maruti Suzuki officials, which are not even replied till date by any of the officials of MARUTI. The mails were sent on several occasions to Maruti officials, since I was continuously being harassed by their dealer M/s Anand Motor Agencies Ltd, Lucknow from the date of purchase of a Maruti car i.e. 4th September 2008.

Although I have filed the matter with consumer forum at Lucknow also but till date not a single hearing is done & I am getting dates only. Now I am in a position of dilemma, since I do not know what to do to get justice hence I was left with no option but to write to you for this matter.

I would like to bring to your kind attention the sequence of events leading to this dismal situation:-

"I was very happy when I intended to buy a Maruti product thinking to be part of MARUTI brand, which I thought takes lot of care for its customers. However I am pained to write to you that I have not been relieved from the agony I have passed through, since 4th September 2008(Date of delivery of Swift DeZire car) till date & am now frustrated the way I was being dealt by Maruti Dealer M/s Anand Motor Agencies Ltd, Lucknow & MARUTI itself. To sum up the matter: I purchased a new car (???) Dezire VXI (Engine Number-442919, Chassis Number-119819) on 04/09/2008 which I got delivery on 04th, September 2008 from M/s Anand Motor Agencies Ltd, Lucknow by paying total amount of Rs. 5,53,353.00 (Rs. 1,05,353.00 by Cheques + Rs. 4,00,000/- Loan DD from SBI & Rs. 50,000/- against my old car under true value).
• On 04/09/2008, at the time just prior to delivery, the car was in bad shape i.e. the Dashboard was very dirty & had a small cut & appeared as if the same was being used for quite some time.
• On my request, the vehicle was cleaned & polished thereafter & I took delivery of the same in the evening around 7.45 PM on 04/09/2008.
• Same day, when I was going to Temple with my family, I observed that there was some water on the back seat of the car, but I thought that the same may be due to entry of some water may be because the window might be open during washing of the car.
• Subsequently, when I went to get the seat covers for my car, it was observed that the whole of the back seat foam was soaked in water & the metal parts for holding the seat were badly rusted.
• The same was being brought to the representative of M/s Anand Motors, but with no satisfactory reply/action.
• During this period of time, I observed that there were two more problems, which existed at the time of delivery of the vehicle but came to my notice subsequently; 1. The combination switch for lights was faulty & the headlights of my car were on for almost half a day. 2. The washer function of the windshield was also not working.
•Thus I went to the workshop of M/s Anand Motors on 18/09/2008 & met with the GM (Workshop), who told me that the combination switch is having no fault, however with new/improved technology.
• Subsequently, when I argued about the matter, the same was referred to attending person, who observed that the 'Combination Switch' was faulty & the motor for windshield washer was also not functioning.
• Both these items were replaced immediately from another car which probably was there may be for servicing, however there was no satisfactory reply for 'Soaking of back seat'. This was not even entered in the service register of the dealer.
• There was problem to the vehicle horn also & the same was repaired on many occasions subsequently. Moreover the same is creating problem now & then.
• This was shocking to me that there were such types of faults/shortcoming with a new vehicle delivered to me.
• These n number of problems & sequences led me to believe that either I am given a vehicle which has been used for a long time before delivery to me OR the vehicle might be submerged in water for a long time leading to all these problems.
• I doubt that some or other problems like these may arise time to time in future & am afraid that these would lead to severe damage to my vehicle & more troubles to me & my family. Further it is to be informed that the Registration Certificate no. UP32CQ2497 of the car (which was delivered to me by your dealer on 4th September 2008) was given to me on 14th February 2009 only. Before this an incorrect RC was given to me by the dealer deliberately to harass me & my family. Throughout this period of more than five months I had never enjoyed the moments of driving new car, since from the time of delivery of the car, I was facing multiple problems like:
• Condition of the car in which the same was delivered to me & for which I have written several mails but did not get even a reply till date as detailed above.
• The issue related to the registration of new car, which was got registered by the dealer on 27th November 2008 only after much follow-up & despite the fact that the total payment was made to the dealer before taking the delivery of the vehicle. Moreover the dealer had charged from me Rs. 1,800/- extra than the total fee for registration of the car.
• NOC of the old car no. UP78AE5459 for which I had to suffer a lot due to the fact that your dealer got the chassis tracing wrong three times & subsequently I have handed over the NOC to the representative of your dealer along with NOC from the financier. I would like to bring to your kind attention that no one from the side of Maruti Suzuki or the Dealer was explaining to me the reasons for the dismal/damaged condition of the car at the time of delivery. However I had sent to the dealer as well as Maruti Suzuki some of the photographs for the stockyard of their dealer for the month of August 2008, which are shocking & speak of the story behind the poor & damaged condition of the car delivered to me. These photographs were received by me later on. Looking to the photographs it can be concluded that I had been delivered a damaged car by Maruti dealer M/s Anand Motor Agencies Ltd, Lucknow, which is not acceptable to me, since I have paid for a brand new car & not damaged one.

Thus I had requested Maruti as well as their dealer M/s Anand Motor Agencies Ltd, Lucknow to:-

i) Immediately replace my car by a brand new car,

ii) Refund Rs. 1800/- being charged extra against registration of car &

iii) Compensate me for the mental agony suffered by me throughout this period of time.

I am attaching one of the photographs also.

The matter is already filed with consumer forum at Lucknow as already informed above, but it is taking so long time that it would be like 'justice delayed is justice denied' & now I am transferred out of Lucknow & have come down to Gurgaon.

I request you to help me out in this case if possible, through your esteemed channel.

Maruti Car Combination Switch — Non-delivery

Doc no.18380224 sent by Maruti Service Centre Sagar on 28 Dec 09 not delivered to Maruti Service Centre Raipur till 31 Dec 09 5pm. Lots of delay considering the expected service sensitivity.
