NHAI — TOLL TAX TAKEN FROM defence personnel

Address:Solan, Himachal Pradesh

Toll Exemption
Sir,
1. I am an active soldier in Indian Armed Force. On 13 jun12 at 0618 hrs. while i was on my way from kalka to kasauli.i was in hired taxy , at kalka parwanoo Tollway : chandigarh shimla highwya via kalka on production of my service identity card i was forced to pay the toll tax, where as i showed them that in their exemption list it is mentioned that for defence personnel on production of the same are exempted for paying toll, rather they humiliated me and force me to pay the toll.

2. The Govt of India, Ministry of Road Transport & Highways (MoRTH) in consultation with the Ministry of Law vide Letter No NH-12037/278/2003/PB/NH-1 dated 12 November 2003 (Appendix B), the relevant extract of which is quoted below :-

. “Ministry of Law and Justice have indicated that Indian Tolls (Army and Air Force) Act 1901 is a special Act which over-rides general acts such as National Highways Act, 1956 and private vehicles of the officers, soldiers and airmen of regular forces are exempted from paying toll irrespective of whether they are on duty or not.”
3. I humbly request you to take an appropriate action against it so that no other soldiers get humiliated in future

I Ex-sgt Debasis Sahoo Ex-serviceman was forced to pay the toll tax on 07/02/16 in the route from Bhubaneswar to Puri. Also on production of the copy of letter no 316801/PMO ACCCES/07/A Dt 28 Oct 2003 the concerned toll gate has harrashed me with slang languages. If the afore siad letter is valid then why it is not considered ? The authority is not willing to sort out this issue. We accept the final dissicision of authority but if authority is silent then every now and then we will face this kind of problems. We donot want undue advantages, but should not be exepted from our previledges. Kindly look into the matter so that no body can make a comment on us

But on Saturday i.e. 02.06.2018 I was travelling from Bangalore to Chittor via Hoskote, Mulbagal and Nangali Toll Plaza there was exemption ot Tall charges, While returning back to Bangalore from Chittoor via same route on Sunday i.e 03.06.2018 at Mulbagal Toll Plaza they dint allow the exemption so i paid Toll Charges of Rs. 65/- for one way to my vehicle No KA01 MJ 8547. Please confirm whether Toll exemption is eligible for Ex Servicemen or not.

Collecting the toll tax from ex servicemen is shame for the PM Mr Modi Government who always talk welfare of defense and exserviceman. May be govt is in financial crisis and by collecting the toll from defense and exserviceman the crisis will be finished. Shame on This type of misdeed. In Next election I request to armed forces and exserviceman to teach such lesson to this govt and throw from the power.

Respected NHA,
I am an EX service Officer owning my private vehicle. I travel regularly from Tamilnadu to Karnataka, and find it difficult to pay the huge Toll amount in many toll plazas.

While Ex-servicemen have rendered their whole life to serve our nation and are considered for concession and special facilities in many areas, it is pity to note that they are not considered for toll concession by the National Highway Authority of India.

Following is suggested for consideration and implementation, and to avoid misuse of the facility.

1. Consider exemption of toll tax to all ex-servicemen owning a private vehicle (Cars & two wheelers only) registered on their name.
2. Commercial vehicles/Taxi/auto owned by ex-servicemen should not be considered
3. NHA can consider issuing of a special pass to the vehicles (as in 1) after collecting a nominal fee. The Toll pass should contain the following information.
(a) Name Rank and Age of the Ex-serviceman.
(b) The name of the corps (Army/Navy/Airforce)
(c) The registered vehicles Number.
(d) Photograph of the Ex-serviceman and the photograph of the vehicle with the number plates visible
(e) The certificate should be printed on a watermark sheet of National Highway Authority of India
(f) Signature of the NHA with official stamp.
4. The toll pass should be valid for minimum 5 years, and should be renewed thereafter.

The Ex-serviceman driving or travelling in their own car should carry the Original Identity card/Discharge certificate, and to be produced if demanded by the Toll plaza staff.

If the authorities are not willing to consider the above for all Ex servicemen, the NHA may consider toll exemtion to all the SENIOR Ex-Servicemen who are above 60 years of age.,

Regards
Commander RM Sundaram (Retd) Indian Navy
A specimen of the copy of the toll pass is attached herewith.
