[Resolved]  Reliance General Insurance Co. Ltd — RECOVERY OF NO CLAIM BONUS (NCB) VIDE POLICY NO. [protected]

Dear Sir / Madam,

This is in reference to my subject policy no. that i had taken for my Honda City-ZXI car last year from Reliance General insurance Co. and paid the applicable premiun. Recently I received a letter dt. 05.07.10 on 25.07.10 (delivered through speed post on 22.07.10) from their office that is located in sector-18 Noida, stating therein that I have given an undertaking / declaration vide letter dt. 09.03.10 whereby i have declared that no claim has arisen in the expiring policy (ICICI Lombard, policy no. 3001/55118619/00/000) and hence on the basis of that they had offered me 20% discount on the existing policy.

However, it is pertinent to mention that i have not given any such declaration as alleged by them and the claim asserted by them in the aforesaid letter dt.05.7.10 is false and fictitious in order to malafidely cancel my policy. If they reject my policy on this wrongful and illegal basis then they should be asked to pay me back on prorata basis the premiun amount of policy. This act of theirs is untenable and unlawful. Infact, they have not even stated in their letter any applicable law or regulation under which they are entitled to cancel my policy,which they ideally should have.

Importantly, the letter was written on 05.07.10, posted on 22.07.10 and received on 25.07.10. In the letter they mentioned that in order to reinstate the policy under section 1 of the said policy, i had to send them a cheque of Rs. 2489 within15 days from the date of issuance of the letter i.e. 5.7.10. Since the letter was posted by them on 22.7.10 and received by me on 25.07.10, therefore, the time factor to renew, to even negotiate or communicate to them concerning the cancellation of policy lapsed automatically by virtue of late disposal of letter by them i.e. 22.7.10. This is totally unjustified and it clears out that they had all the wrongful intentions to cancel my policy and deny any future claims. Even at the time of taking the policy from them, i had not declared any false statements. If that is the case then they should bring out and show the true picture.'

My humble request is to seek your indulgence in the matter and direct them not to cancel my policy illegally which is contrary to law and regulations of IRDA.
