Samsung — New Mobile Phone defective

I had bought a Samsung W619 CDMA cum GSM dual sim handset on 8th December 2008. However the from the third day there were technical problems with the phone so the dealer was supportive and replaced the handset on the 14th December 2008. After using the phone for a about a week, again I started facing a lot of issues in the new handset which were as below:
• Phone hanging abruptly
• Phone switching off abruptly
• Battery life very low (as against advertised being a powerful one) and not even lasting one day with minimum or no use (idle)
• Display on opening the slider not there or appears after delay of 5+ secs

Spoke to the dealer again who refused to replace the phone again till a DOA (Dead on Arrival) is received from the service center.
I went to the service center on 27th Dec 08 where they said that the DOA can be given only if the phone is brought within 7 days. However they said that since the phone is under warranty they will check and expect the problem to be rectified in two working days (Work Order No: WA[protected]). The service center after two days responded (on my call) that there is a problem in the motherboard of the phone and hence it will take at least 10 days to rectify the problem as the same has been sent to their HO.

I have a CDMA number and had replaced my old phone when I bought this handset. Currently I am not able to use my postpaid card and am using a pre paid GSM number which is also costing me. I am a working professional and all my customers are unable to reach me causing me severe difficulties in my business dealings. The service center is not able to provide a spare phone as I have a CDMA connection. The whole experience of buying a Samsung handset (first time buyer as was using Nokia otherwise over 3 years without a glitch) and that too an expensive one has not been pleasant at all. I demand that my phone be replaced immediately or my money refunded if this cannot be done. The Area Service manager had been supportive in looking at the problem himself but he too says that as per company policy he cannot give me a DOAand as the motherboard is not available it will take 7-10 days for the repair.

Please look into this problem on an immediate basis as this is causing me immense difficulty and business loss as well and I cannot be expected to operate without a phone which has been recently bought with so many complaints on the handset model.
