[Resolved]  Shalimar Estate (P) Ltd. Chandigarh — Registration of Plot is Delayed on what Technical grounds ?

I am an applicant of plot no.10P,of 10 Marla in Shalimar Enclave ,Village Nagall/Allipur-Panchculla. On dated 17th Jan.2007,the company issued a public notice that since the matter is subjudice in High Court of Punjab and Haryana on some technical issues , as such the possession of plots may be delayed. When i tried to know the technical issues by visiting/writing the office then no responsible person was available to satisfy my queries. Till date i visited many times and written many letters but of no use.I want to know under what circumstances/technical issues the registration is being delayed?? Were they not be avoidable or pre tackled ?? If so then who is responsible for so much harrasment to the Applicants ?? Hope court will look into the whole affair thouroughly.

My name is Amit brother of Dr Sundip, who has similar problem of not getting possession of Plot even after paying full payment of Shalimar estates, Chandigarh.
Mr Ajay Kapoor, please include me in “SHALIMAR ESTATE ALLOTTEES WELFARE ASSOCIATION, NAGGAL/ALIPUR (PANCHKULA)”.
Please let me know any progress in this matter and also if any legal proceeding is to be done.
Let us all join hand and approach/pray to the high court by moving another application for early hearing of the matter so that matter be decided and the registration of the plot is possible quickly.

Sorry i missed this forum ( SHALIMAR ESTATE ALLOTTEES WELFARE ASSOCIATION, NAGGAL/ALIPUR (PANCHKULA)” earlier and had been interacting with and airing my concern to Shalimar Estate individually. I am Col Manvijay Gautam from Jammu, currently staying in Delhi. I have been allotted plot No 14 (10 Marala) in Naggal/ Alipur (Panchkula). I had paid entire amount of plot in two installments by mid 2003. I was informed by their office that the registration of the plot will be done in Oct 2008.

In Oct 2008 when i approached for registration i was told that they have Court case with Haryana Govt and once case is concluded favourably (in 6 to 8 months) the plot will be allotted. Now since then i had been sending letters to them and also speaking on phone for finding out the status of case and likely time line of registration of plot. They never replied to my letter but every time i spoke on phone with their front desk executive, i was told it might take another 2 to 3 months for closure of case and then registration of plots will start. Of late they have even stopped picking up the phone.

Could you please update me on the current status of case and when are we likely to get the plots. I also request you to kindly include me in the association and i will hereafter be with the association for any action jointly the association wants to take to get our plots from Shalimar Estate.

I am allottee of plot No. 411(P), 10 Marla in Shalimar Estates, Naraingrh. During last few years a number of times I have written to the company for registration and possession of the said plot in my name but no reply has been received. I fail to understand the reason for not replying. Through net, I have noticed that many allottee. like me are complaining and also that some matter is pending in High Court. Can some one inform what actually is the matter?

I was also allotted a plot no 695 in Shalimar estate alipur naggal, panchkula . All the money was paid in 2008 and Shalimar estagte soppose to handover in plot in Jan 2008. but till date they not given the possession on the plot no 695 in Alipur Naggal, Panchkula. When ever I am enquiring no response is given by them so far. therefore, I request please lodge my complaint against Shalimar estate.

I also request to all the alottee of Shalimar estate to provide their contact no in this sight .

Those who have not got the possession/registration of the plots of Naraingarh they should jointly go to the consumer court, if they are ready to pay the registration fee as is as present, if they are not ready for this then how the registration/possession can be got. Try the get the name and mobile no. of the others also who are to get the possession. Also it is requested to meet the MLA of the area Nayab Singh Saini

AMBALA and if needs be to the Chief Minister Haryana as well as write to the Prime Minister of India who is very helpful to the needy also may also request the secretary municipal committee Naraingarh whose e-mail address is [protected]@gmail.com for giving electricity connection/lighting etc. in the estate so that the dealers who are making use of this they could not make. The collector rate of the shalimar estate is Rs.135000/- per marla but they try to get just at Rs.30000/- per marla. If the electricity etc. is provided by the municipal committee then they will not try for this and also the development will be done.
Those who have not got the possession/registration got done despite giving payment for the registration. They can get singly/jointly the directions from Punjab & Haryana High Court to execute the registration and possession given even if the owner is in jail by filing writ in this regard against the owner Ram Kumar Aggarwal.
I am allotted of Plot No. 511(P) in Shalimar Estates, Naraingarh. All instalments have already been paid well in time but the company is neither giving possession of the plot nor replying to my letters which I posted in last 4-5 years. Even the company has failed to make registry of the plot. I am a retired Govt.Employee and need accommodation urgently. Please help me in getting the possession of the plot.

All who like to get the registration of their plots either in Naraingarh or Naggal. They should individually or jointly prefer a suit in the Punjab & Haryana High Court, Chandigarh. The Punjab & Haryana High Court has the power to compel the owner to get the registration done of those who are willing to pay the fee as per the present collector rate which come out to be 13500 per marla. In fact the market value of the Naraingarh plots should be at least 2.5 lacs per marla. But property dealers are misguiding and are greedy to get the plots at just 40 to 50 thousand per marla. If all get the registration done then the property dealers will keep mum and will buy at at least 2.5 lacs per marlas. Be strong. Get the registrations done. High Court can give the directions done by giving directions to the Police and owner of the property.

In a major relief to plot holders in Panchkula-based Shalimar Estates Private Limited, the Punjab and Haryana High Court has ruled that restrictions on erection or re-erection of buildings in a controlled area were not applicable to the land being developed as a private colony by the builder.
The ruling by the Bench of Justice Rajesh Bindal and Justice Darshan Singh came on a petition filed against the state of Haryana and other respondents by Shalimar Estates through senior advocate ML Sarin, Nitin Sarin and Ritesh Aggarwal.
The Bench was told that the petitioner, in August 2001, entered into an agreement for purchasing 211 kanals and 10 marlas. Another 172 kanals and 5 marlas were purchased in October 2001.
Sarins told the court that the petitioner started developing the area as a colony and invested about Rs 3.50 crores on the project up to June 2002.
But notification dated July 11, 2002, was issued by the state government under the Punjab Scheduled Roads and Controlled Areas Restriction o[censored]nregulated Development Act, 1963, “just with a view to derail the project”.
The land around the existing boundary of Haryana State Industrial Development and Infrastructure Development Corporation Limited in the Industrial Estate of Alipur village in Panchkula district was declared a controlled area.
Sarins also told the court that the notice for alleged violation of the 1963 Act was issued in July and August 2002. In its reply, the petitioner claimed the nature of land had already been changed as a colony. As such, the provisions of the Act had not been violated. But the petitioner was directed to demolish the construction already done without affording further opportunity and permitting the petitioner to lead evidence vide order dated August 8, 2002. The order was totally non-speaking and cyclostyled, where only certain blanks were filled.
The petitioner’s appeal before the Tribunal constituted under the 1963 Act was dismissed without appreciating the contentions raised by it, especially that the land notified on July 11, 2002, was already being developed as a colony and substantial number of plots carved out had already been sold by issuing advertisements and collecting earnest money through banking channel.
Allowing the petition, the Bench asserted: “It is declared that on the date of issuance of notification dated July 11, 2002, under the 1963 Act, the land in process of being developed a colony should have been shown as such in the plan prepared under the provisions of the Punjab Scheduled Roads and Controlled Areas Restrictions o[censored]nregulated Development Rules, 1965.
The Bench also directed setting aside the impugned orders dated August 8, 2002, passed by the respondent and January 28, 2003, passed by the Tribunal.
