Report submitted by the Private Detectives of the Party:

THE FACT:

01. VICTIMISED PROPERTY IN QUESTION:

All that piece and parcel of land old building bearing West Madras Municipal Door No. 28, Chennai Corporation Old Door No.68, New No.16, Periana maistry street, Periamet, Chennai 600 003, measuring 1820 sq.ft., (as per patta ) with all the fixtures & T.N.E.B electrical connection & deposit and other amenities lying thereon, comprised in O.S. No.457, R.S. No. 430, Patta C.A. No. 313/2009, situated at VEPERY VILLAGE, Fort-tondiarpet taluk, Chennai District standing in the Name of Vijaya Bai Rufus, herein is hereafter referred to as the said property for brevity.

02. VICTIMISER:

One Mr. P.C. Chugh son of Jonan Chand Chugh, First Victimizer, Residing is at Flat-1, Wing No. 1, 7th Floor, Arihant Majestic Towers , Koyambedu, Chennai – 600094.

Running Business Name and Style M/s. Macenzie Exports Pvt. Ltd., # 14, Ambalavanan Street, 1st Floor, Arumbakam, Chennai – 600106 and his company had started operation with the second Victimizer Vijaya Bank in the year 1997, Vijaya Bank had given various loans such as business loans, home loans and personal loans and the Bankers had given loans to Chugh, out of the way beyond their limit for materialistic reasons jointly as a team created a scam, and Chugh had done a total turnover within 2005 to a tune of 16.63 crores and his company had paid to the Second Victimizer Vijaya Bank, interest alone to an extent of Rs. 71,00,000/- [Rs. Seventy one Lakhs] he had submitted letter for discounting of his bills under L/c from prime Banks and requesting to adjust as high as 25% from every bill towards adhore PCL and FUDBP but it seems that the Bankers had demanded more bribe, more than the profit he could make, hence there were no positive reply from the Vijaya Bank and And P.C. Chugh was unable to repay and the Bankers had big headache so they master planned to escape from the clutches of the scam that as follows.



03. VICTIMISEE:

That the Victim Mr. A.C.S. Chellappa was searching for a loan of two to three lakhs during that time one Mr. Kannan, a Finance Broker introduced the Bankers [Spiderman] of Vijaya Bank, Industrial Finance Branch, [Spider-net] Ankur Manor, No. 182, Poonamallee High Road, Kilpauk, Chennai – 600010 to Mr. A.C.S. Chellappa son of S. Sundaram, aged about 73 years, Residing at No. 16/68, Perianna Maistri Street, Periamet, Chennai – 600003 and the Banker introduced Mr. P.C. Chugh to A.C.S. Chellappa.

04. The Bankers, Mr. P.C. Chugh and Mr. A.C.S. Chellappa had a meeting on Monday the 25th April, 2005 in a Restaurant, one of the Banker told Chellappa that P.C. Chugh had approached Vijaya Bank for a fresh loan of Rs. 20,00,000/- [Rupees Twenty Lakhs only] and that the Bank was willing to provide the said loan on security of third party collateral. Mr. A.C.S. Chellappa had said to the banker that the said property originally belongs to his wife Mrs. Vijaya Bai who was paralyzed and bedridden since 3rd January, 2005 further she had a serious illness due to cancer in gallbladder and her body condition was unfit for operation and she was in a coma and Later she died on 4th Jan, 2008.

05. The Bankers asked, if Chellappa could furnish the original title Deeds of the said property and sign wherever required and the bankers had told that they will take care. Further it is understood from Chugh that the Manager had suggested that Chellappa, should become a Director of M/s. Macenzie Exports Pvt Ltd before registering any document or signing any contract, this fact reflects in the legal opinion, as ‘Abundant Caution’ given by the Bank’s Panel Advocate Mr. S. Jayakumar.

07. Accordingly Mr. P.C. Chugh had given a proposal in writing to Chellappa. And both signed a Memorandum o[censored]nderstanding that was brought by Chugh and Chugh took some signatures of Chellappa in few printed papers and some blank papers. Chellappa had signed all in good faith, without the knowledge of Chellappa, Chugh made him a Director of his company and on the same day Chugh cunningly eliminated his father-in-law Mr. S.P. Chattorjee, from the company. To this deal Rs. 420,000/- [Rupees Four Hundred and twenty thousand only] was fixed and that to be paid by P.C. Chugh. Rs. 4,00,000/- [Rupees Four Lakhs] to Chellappa and Rs. 20,000/- [Rupees Twenty thousand] to the broker.

08. As Mr. Chellappa was terribly in need of money to give treatment to his wife and to run the family, he agreed to the idea proposed by Bankers and Chugh.

09. Banker had maneuvered the encumbrance certificate without reflecting the registered deed of settlement dated 2nd Day of January, 1960 Supplementary Settlement Deed dated 4th Day of February, 1976 and Deed of Cancellation dated 17th Day of July, 1979 and had arranged a stranger to manufacture a impersonated Power Deed in favour of A.C.S. Chellappa as if executed by Vijaya Bai, the Power Deed was forged with signatures impersonating Vijaya Bai further more the stranger had subscribed her left thump impression in the fabricated Power Deed whereby the Power Deed is null and void hence the activities of the fraudulent by the said Power Deed does not imply to Original Vijaya Bai and the said stranger Duplicating Vijaya Bai is still alive willing to give confessional statement before the court of Law while the Original Vijaya Bai is Dead. She had died without any knowledge of these criminal transactions.

10. According to the master plan of the Banker, On 11th November, 2005, Chellappa was taken to Sub-Registrar’ Office at Peramet for the Deposition of Title Deeds. The Bankers took signatures of Chellappa in some printed papers and blank papers. And Chellappa was asked to sign and some one for the second time to duplicate and signed the signature of Vijaya Bai in the Declaration brought by the Banker, hence the forged signatures impersonating Mrs. Vijaya Bai differs from one another [so the signatures impersonating Vijaya Bai in the Power of attorney totally differs from the signatures impersonating Vijaya Bai in the Declaration] two different persons duplicating had been engaged by the Bankers to impersonate Vijaya Bai at two different occasions, in fact the original signature and Thumb Impression of Vijaya Bai is very much available in the Registered settlement deed dated 20th Day of January, 1960, Supplementary Settlement Deed dated 4th Day of February, 1976 and Deed of Cancellation of the settlement dated 17th Day of July, 1979 registered at the Sub-Registrar’ office at Periamet and also in the original records maintained by the Sub-Registrar, Periamet.

11. Mr. P.C. Chugh paid Rs. 1,00,000/- [Rupees. One Lakh] to Chellappa and promised to pay three lakhs on 14th November, 2005.

12. Technically the Bankers split the registration into two parts, Subsequently On 14th November, 2005 Chellappa was taken once again to Sub-Registrars Office at Peramet to sign a document after which Chugh paid Rs. 2,80,000/ and Chugh also issued a Cheque for Rs. 20,00,000/- [ Rupees Twenty Lakhs] without date. Chellappa is totally victimized and being cheated.

13. After getting the Victimized Documents as collateral security in substitution of Chugh’s properties for the loans availed long time back, the Banker released the properties of Chugh.

In the letter dated 19th September, 2008 written by Chugh to the Bank we find as follows:

01. We sold our property at Mutukaddu Lake , E C R, in the year 2005 at the INSISTANCE of the bank to reduce our liabilities so that we could be provided with the working capital needed to revamp our business. With complete trust we disposed the same for Rs. 24,00,000/- [Rs. Twenty four lakhs] under distress. Today the value of the property stands in excess of one crore. After this neither we received any working capital nor could we retain the property which we would have disposed now at todays market value, we could have wiped off our entire liability with the Bank.

02. Soon after the receipt of Rs. 24,00,000/- [Rs. Twenty four Lakhs], the bank DECLARED our account as non performing asset in the Month of December, 2005.

03. Still with the hope that the bank would stand by us and commit as promised, we sold our residential property in Mogappair once again under distress for Rs. 10,00,000/- [Rs. Ten Lakhs] in the month of January, 2006. On repeated letters and plea, yet we did not receive the working capital as promised to restructure and move forward with our business. Today value of this property stands in excess of Rs. 30lackhs.

04. Total loss occurred from selling these two properties untimely on the INSISTANCE of the bank was nearly 1 crore app.. This amount would have been useful for us to settle the entire outstanding with the Bank, had we not sold those properties then.

05. In both cases, we had SUBSTITUTED with a third party collateral with the bank to the tune of 46lakhs to SAFE GUARD the bank interest before being SUGGESTED by the Bank to sell these two properties.
06. Further we recovered claim 19.25lakhs from ECGC in the month of February after long pursurance and follow up and reduced the FUDBP liability to this extent.
07. Finally we have sacrificed our only residential property and sold for 32lakhs [Thirty two lakhs] to one of our friends to reuce the liability further with the Bank.

14. Soon after the deposition of title deeds of Vijaya Bai, the Bankers released the documents of Chugh and had suggested and insisted Chugh to sell the property to reduce the liability. Such are the Bankers bringing in innocent people’ property, instead bankers would have provided their property in substitution for having given loans beyond their capacity. We INDIAN ACTION PARTY strongly condemn and protest.

15. Mr. P.C. Chugh promised that he will be releasing the documents within six months. Using the financial crisis the Bankers and P.C. Chugh had victimized A.C.S. Chellappa and thus Chellappa is injured jointly.

16. Later Chellappa was tortured to pay 71 Lakhs to the Bank in order to release the documents and Chugh insisted Chellappa to sell the property, giving a false promise that he will repay the said Rs. 71 Lakhs in 10 years period of time while Chellappa was counting his last days later passed away on the 9th Day of January, 2010 because of the crises and mental torture.

17. According to the Correspondence Made by Chugh to the banker, his letters reveal the truth behind the whole play made by the Banker, no where the banker refused to the accusation made by Chugh. Mr. Chugh was approached by the members of Indian Action Party. On the request of Mr. Chellappa, Party had collected some documents from Chugh forcefully and found the entire operation made by the Bankers and Chugh.

18. Secured Loan:

M/s. Macenzie Exports Pvt. Ltd.,

1. Packing credit loan Rs. 75,00,000/-
2. FUDBP loan Rs. 50,00,000/-
3. Housing loan [P.C.Chugh] 11,55,000/-
4. Housing loan [P.C.Chugh] 7,00,000/

19. Unsecured Loan:

5. Pronote loan to Chugh 2,00,000/-
6. Pronote loan to Mrs. Chugh 2,00,000/-


20. The banker had planned to get a third party collateral and sold the property of Chugh to reduce his liability and now holding the victimized property of Chellappa. All these loans were given long time before depositing the title deeds of the said property. The banker was well aware that they had given excess unsecured loans beyond the their limit to Chugh and they knew that Chugh will not be paying back, lead to the headache for the banker, to find a remedy as such a criminal plan had been plotted by the bankers and purposely brought in an innocent victim Mr. A.C.S. Chellappa. No further loans were given against collateral security of the property and the cover note and declaration made on the property is 1,40,00,000/- [One crore and forty lakhs] where the property was valued by the banker’s valuer was Rs. 43,00,000/- forty three lakhs only.

21. The Valuation report submitted by the Banker’s Valuer shows the Value of the Property was Rs. 43,00,000/- [Rs. Forty Three Lakhs only] if at all bank intends to provide fresh loan on third party collateral, Bank should follow the norms given by Reserve Bank and that which cannot not exceed 34% of the Market Value. Taking this Document as security for Rs. 1,40,00,000/- [One Crore forty Lakhs] for the existing loan beyond the value of the said collateral shows the Criminal activity of the Banker and force to treat the Banker as the first Accused in this case.

22. The Banker and Chugh recently insisted Chellappa to pay Rs. 71,00,000/- [seventy One Lakhs] to secure his property that let to Heart attack of Chellappa and he was hospitalized and bedridden. Poor Chellappa himself an aged person was taking care of his own sister who is around 66 years old, but mentally handicap.

23. If we challenge the signature of Vijaya Bai one between the other on which the foolish bankers are relying upon it will be proved that all are fabricated and thereby those documents are null and void.

24. Mr. Chugh had corrupted the banker and had obtained loans beyond the security given by him. The banker in order to safe guard had cruelly planned and victimized an innocent person Chellappa.

25. We wonder why this Criminals, so called Bankers, behaved like a third grade Bloody Politicians and Samiyar [] and son of .

Bankers were waiting since 2005 for

01. Vijaya Bai.
02. A.C.S. Chellappa

to die after which Bankers now started and trying to snatch the property of the innocent people. RIDICULOUS.

Let the bankers answer.

01. Is it true or not?.
02. What for they have been waiting then?
03. Why did they not taken any action against Chugh?
04. Why did they not attack Chugh’s property at Calcutta ?
05. Is Vijaya Bank, ‘A FRIEND YOU CAN BANK UPON’?
06. Are they not fraud?
07. Why a criminal case should not be filed against them?
08. Why not we entrust this matter to MAOIST, POTA, ULFA,
Naxsalites or Viduthalai siruthai to deal with them?
09. Do they want us to go in a Democratic way?
10. Let them reply!!!!!!!!!!!!!!!!!!!!

26. Suggestion:

The Banker and Mr. Chugh are 100% Criminals.

A complaint could be filed U/s. 200 r/w 243 and 315 Cr.P.C..

Charges punishable U/s. 420, 406 and 506 [ii] IPC.

The Bank should release the documents of Chellappa unconditionally.

27. FINAL INFORMATION:
Mr. A.C.S. Chellappa, the poor Victim died on the 9th Day of January, 2010 say he was killed by the Bankers indirectly.
