Subject: Complaint Against Flipkart – Request for Refund or Replacement for Faulty Moto Edge 60 Stylus Purchased via Open Box Delivery

Nature of the Complaint:
After accepting the open box delivery and using the phone for a few hours, I experienced several serious issues that make the product unfit for my purpose (academic use), including:
Overheating even with minimal usage
Rapid battery drain within a few hours
Laggy and unresponsive user interface
Poor and unpolished software experience
Missing basic features like a native gallery app
These problems are not visible at the time of open box delivery, which only checks for physical damage and product presence. It is unreasonable to expect a customer to assess performance within 2–3 minutes in front of a delivery agent. Such issues only emerge after some hours of real-world usage.
My Request:
I respectfully request Flipkart to either:
Provide a full refund of ₹23, 068, or
Allow me to exchange this phone for a different brand of equal value that better suits my needs.
I have kept the phone in perfect condition, with no physical damage, and I am ready to return it in original packaging. If I am returning a fully functional but unsatisfactory product in good faith, why should Flipkart not accept it? Why is there no option for open box return or a minimum 24-hour performance evaluation window?
Why This Is a Consumer Rights Issue:
This sale violates the principles of fair trade by denying return for poor performance not evident at delivery.
Section 2(1)(r) of the Consumer Protection Act defines such restrictive policies as potentially unfair trade practices.
I am being denied the right to use my money on a reliable product essential for my education.
Please take appropriate action and direct Flipkart to initiate a refund or facilitate an exchange. I have attached relevant proofs (invoice, screenshots, communication with Flipkart) and am ready to cooperate in resolving this matter peacefully.
