HDFC Bank — Fraudulent documents in initiating a policy account #18482269

Address:HDFC Bank, Opp. National College, Bandra West, Mumbai

I would like to bring to your attention that I have strong evidence of fraudulent and incomplete information of Form 60 and other initial documents of my wife's account with HDFC Life. Attached are the documents and email communication. The account was opened in 2016 when my wife was residing in Canada. She never visited India in 2016. She last visited India in 2007. Yet all information was as if her location of signing was in Mumbai. Plus as a non resident, HDFC Life claimed that she was a resident of India. Form 60 to my knowledge as per law is a requirement to be only filled and signed and dated by the potential policy holder prior to acceptance by HDFC Life. This was not the case with HDFC Life.
To my knowledge HDFC Life was using fraudulent Life insurance account in the BSE stock exchange.

I received your documents. After reviewing your attached documents, I declare that the policy documents HDFC Life created for policy #1842269 was invalid, fraudulently created with false information.

The requirement as per "Proposal form for single Life" stated that the entire form also known as Form 60 as per HDFC Life was to be filled complete by the policy holder. This was not the case.
Also, the form required a witness and signature. Who was the witness? I did not see the policy holder's signature and the place and date where she signed her Form 60. Why was HDFC Life careless in their undertaking? Where is the accountability?

In PDF # 2344_[protected] under "Declaration in Lieu of Pan Card" shows that the place that Winifred D'Souza supposedly signed an undated form, was in Mumbai. The form without a date has no validity. Also, this document you produced was falsely noted as signed in Mumbai. Allow me to declare that Winifred D'Souza as once holder of HDFC policy #18482269 had never visited India in 2016. This document you produced stated false information.

In the "Customer Consent Document", Winifred D'Souza was never a tax resident of India in 2016. Also, for more than 30 years prior to 2016 she was not a resident of India. So why was Block "yes" been checked? No attested or verifiable photograph was included? This is a Regulatory requirement in 5.3 in RBI Master Circulars.
What analysis did Varsha Satam do by using the HDFC suitability Matrix? Show me the contents of that analysis?
And to top it all, Winifred D'Souza's signature was again supposedly signed in Mumbai dated 28th April 2016. This is a false statement.
Varsha Satam, Manager, on behalf of HDFC Life declared that she carefully read and understood the declaration and terms of the above policy This action, criminal in nature by HDFC LIFE personnel in approving and supporting false information is unacceptable and due process of the law should be applied.

Trading in invalid policy funds in the stock market are a crime. Policy #18482269 was created intentionally to benefit HDFC Life and personnel.

Incomplete and false statement policy documents by HDFC Life and personnel of policy # 18482269 not only invalidates the policy but is also subject to prosecution and financial charges. Since none of the documents including "Form 60" presented showed that the waiving of pan card documents was complete and/or with false statements, therefore intentionally opening of above policy and operation was invalid.

Allow me to quote some of the legal terminology. "Consequences of wrong declaration. Making any false statement in Form 60 may attract these consequences: If the amount involved is less than Rs. 25 lakhs: imprisonment from 3 months to 2 years along with a fine can be imposed. If the amount involved is greater than Rs.25 Lakhs: imprisonment from 6 months to seven years along with a fine can be imposed.

I did not surrender Rs. 50 Lakhs of my funds for charity to HDFC Life and received zero returns. This policy that was offered was to increase HDFC Life sales figures by enticing, defrauding and swindling clients. The policy cannot be in "withdrawn status" as it was invalid from the start. What did HDFC Life team security investigate? They appear to be corrupt or support the corruption process.

If HDFC Life ignores this email and chose not to respond to a satisfactory explanation within 72 hours of receiving this email, legal process of reportable action will be taken.

Attention: This email was sent from someone outside of HDFC Life. Always use caution when opening attachments or clicking links from unknown senders or when receiving unexpected emails.

Please respond to my queries below. Also, I fail to so understand your term as "contract withdrawn", as you attached a policy document without pan card information and without signatures. That attached policy document has no validity. Surely, opening an account with a Life insurance company involves signatures of client as well as Life insurance personnel. Please send me the right policy document with signatures and pan card information including the completed Form 60 which was mandatory in 2016.

I had spent over 3000 hours of my time in researching, emailing in getting HDFC Life and bank to acknowledge their corruption tactics and they keep deflecting it. This has caused me a lot of stress, anxiety, mental and physical health issues, time lost in carrying out normal life and monetary loss.

Hi Mukesh,
Thank you for your unexpected call today. Is the wheels of justice and fairness now coming to haunt HDFC bank/Life? It is sad that HDFC bank/life claims to be the largest private bank in India when they cannot keep their documents in order. They lie, they cheat and this culture comes right from the top. I meant from the top that includes Vibha and Sashi.
You claimed that my wife's form 60 cannot be sent an email copy because the legal team advised that it is the bank's internal matter and confidentiality. Please show me the RBI circular to that effect? As per my research, I cannot find any RBI circular that dictates to banks to withhold documents pertaining to account holder. It seems that HDFC Bank is the only bank that i am aware of that lacks morals and values. HDFC life /Bank customer service is pathetic.

Trevor D'Souza

The following is a brief summary of what occured since 2016 :-

HDFC Life had opened a policy pension account in my wife's name when my wife was then 64 years old in 2016. My wife last visited India in 2007 and has no intention of residing or retiring in India. This pension account was designed for a much younger person so that by the time he/her reaches a retirement age, can avail of the funds. Varsha conned me and assured me verbally that after 5 years, I can withdraw the funds with gains and bonus. I honored my commitment by transferring funds of Rs. 10 L every year. So on the 6th year, when I wanted the funds released, HDFC Life refused declaring that it will remain until my wife's death. That year 2021, my daughter had a serious motorbike bike accident. During Pandemic, even her Dad was not allowed to visit the hospital. Yet, HDFC Life insisted that I obtain documents from the hospital. The hospital was one of the top hospitals in Toronto and after a lot of pleading and persuasion by phone, I received the papers from the head of the department. Yet HDFC Life harassed me with wanting documents after documents. They finally released the balance of my Principal after a lot of procrastination and demands.
I met Varsaha Satam, manager of HDFC Life when I last visited Mumbai early this year and she with support of Manager, Jogesh Bohra, claimed that HDFC Life did their own internal investigation and found that their documents were in order. Once I returned to Toronto, I started asking for policy initial documents including "Form 60". I found that those documents which were a requirement prior to opening an account by Income tax authorities were fraudulent.
"Form 60" should have been completed in my wife's handwriting. Also, there was no witness and no signature, place and date. Yet, Varsha and HDFC investigative team declared that the policy account documents were in order and binding. I sent all information to Vibha Padalkar CEO and her directors and not one of them responded, only from HDFC life service/support repeating their mantra to dismiss me. No one wanted to rock the boat, not even Vibha Padalkar or Sashi Jagdishan of HDFC Bank. So after some research I found that Life documents were falsified just to please the upper management in improving the bottom sales.
HDFC bank to date has declined sending copies of initial documents of my wife's account when requested by her. They are citing " internal matter and confidentiality". I can conclude with certainty that HDFC bank was also either holding none or fraudulent initial documents. Since HDFC bank is also the controlling member of HDFC Life, their responsibility is even greater.
What irks me, is that terrorists can open accounts with HDFC Bank with support from employees, just to improve the bank and Life's bottom line.
I intend to speak my mind in Twitter, FB, YouTube and other social media of HDFC Life's fraudulent handling of my wife's account. Soon it will be in the media in India.
Show me one employee who would invest Rs. 50L over a period of 6+ years and be satisfied receiving zero returns.
Both HDFC bank and Life are in the hands of the Complaints Forum and expect that justice would prevail as I produced the evidence.
