Lodha Group — Complaint against Lodha Developers regarding parking allotment issue at Lodha Casa Viva - Wing A, Thane

I am writing to register a formal complaint against Lodha Developers regarding a parking allotment issue at Lodha Casa Viva - Wing A in Thane. I have been facing significant challenges and unfair treatment due to the incorrect parking allocation made by Lodha Developers.

I took possession of my house in Lodha Casa Viva - Wing A in November 2022, following a prolonged payment battle with the developer. Upon possession, I was provided with a tour of my apartment with my family, during which I was allotted parking space B1-056 in the underground parking area of the building as written in my possession letter. Subsequently, I sublet my apartment and parking space to my current tenant after both parties underwent a thorough police verification process.

However, in March 2023, Mr. Sandeep Gupta, another owner residing in the same building, claimed that parking space B1-056 belonged to him. When this matter was brought to the attention of Lodha Developers and one of their representative Mr. Kunvarfateh Bahadur, they acknowledged that it was their "human error" and oversight to assign the same parking space to me. Mr. Kunarfateh has admitted this mistake in writing as well.

Despite accepting responsibility for the error, Lodha Developers have now informed me that I must relocate our parking to an open space within the complex. This decision is highly problematic and unfair for several reasons. Firstly, open parking areas are susceptible to various environmental and human hazards, including items being thrown from above, posing a significant risk to the safety of our vehicles. Secondly, if we are forced to accept this alternative, it sets a precedent that could lead to further disputes as after a few months any other residents might claim my parking space and Lodha might again claim they were wrong in allotment. How can we trust? I believe it will also affect the value of my apartment, as at the time of selling apartments with closed parking are preferred. I have also paid the 2-year maintenance and other service charges, so why am I being treated unfairly when clearly Team Lodha is wrong here and have accepted their representative's mistake?

Furthermore, we question the timing and authenticity of Mr. Sandeep Gupta's claim. He had been residing in the building for three months without raising any concerns about his parking allotment until now. It appears highly suspicious that he suddenly realized the supposed error after this duration. I request a thorough investigation of this matter and Mr Kunvarfateh Bahadur.

We believe we have been falsely led. Moreover, we are disappointed with the lack of assistance and resolution provided by the Lodha customer service team. They have repeatedly urged us to accept the open parking spot, while their service team has expressed an inability to resolve the issue satisfactorily. This continuous back-and-forth, coupled with the persistent problems we face, is causing immense distress and frustration.

In light of these circumstances, I kindly request your intervention and support in resolving this matter fairly and promptly. I seek proper compensation in the form of the correct parking space allotted to me as per the original agreement. Additionally, I urge the Consumer Complaints Division to investigate the actions of Lodha Developers, as they have failed to rectify their error and have disregarded the concerns and rights of their customers.
