My name is Ajinkya Nivrutti Ranaware, I am the owner of the flat "Orchid H-307, Golden Dream (Crown Taloja), Khoni, Dombivali east (421204)". This mail is for complaining to you that we are suffering with the bad quality of lodha construction. Today (14th April 2024) we had an accident that our bathroom and toilet passage area ceiling fell down which was provided by lodha and it is a part of lodha's construction. The complete ceiling was stable on the support of a single screw and today suddenly it collapsed and fell down. I complained about the same to hpm team but they are saying that it will not be repaired via lodha team as it is not a structural defect. But for your kind information if you see the agreement, it is clearly mentioned that "Structural Defect in the Unit or in the material used therein such defects shall be rectified by the Company at its awn costs. In the case it is not possible to rectify such defects, then the Purchaser shall be entitled to receive reasonable compensation from the Company for rectifying such defects, based on the estimated cost of rectifying such defects as determined by the Project Architect of the Company."
Also lodha took 5 years of maintenance charges in advance from us to maintain all the things in lodha property. So it's the lodha team's responsibility to repair the damage caused in the property. My wife is 8th month pregnant and she was passing through that area before 5 minutes of that incident, if any injury will happen to our family members then who will be responsible for this, assume that our kids/grand parents/ family members was passing through that area and they get injured then who will take responsibility of that injury. This accident can cause death/major injury of childrens/senior citizens. This ceiling is fitted by lodha in the bathroom, toilet and common passage of bathroom, and this should not happen with any other family.
So I request the lodha team to please look into it on priority and repair the ceiling and please make sure the ceiling is properly fitted. If any action not taken against this and not got repaired then we need to reach out to RERA and consumer portal that lodha team is not helping us as per the agreement. I am attaching the clip and photos of the accident. please resolve this ASAP. I raised so many emails earlier also about the bad quality of lodha construction and issues we faced.
