Sir,

Subject: Legal notice for BNS Section 318 deals with cheating, specifically, fraudulently or dishonestly inducing someone to deliver property or consent to its retention.

I, Nikhil Gang, son of Shri Krishna Kumar Gang, Uttar Pradesh, state the following:

1. I am a law-abiding and peace-loving citizen of India, and have a good reputation in the society as well as in my office. It is further submitted that the train ticket details booked by the undersigned from Bhubaneswar (BBS) to ANAND VIHAR TRM (ANVT) with PNR No [protected], train number 12801 / PURUSHOTTAM SF, Class AC 3 TIER, through MAKE MY TRIP on Booking Date: 08-Feb-2026, Boarding Station: BBS with Reservation Status: NIKHIL GARG: WL/47, ARCHANA GARG: WL/48, SOUMYA GARG: WL/49, SANCHIT GARG: WL/50, PRADEEP KUMAR: WL/51, ANSHU: WL/52 with Boarding Station: BBS, Boarding Date: 09-Mar-2026, Boarding Time: 23:00

2. It has been stated that the time of booking is covered under the Trip Guarantee programme that promises a refund of 3X the ticket fare in case your waitlisted ticket is not confirmed at the time of chart preparation. However, there is no truth in this at all. The undersigned complaint market an email at Sat, Feb 14, 8:56 AM (8 days ago) regarding same subject to [protected]@irctc.co.in,
[protected]@irctc.co.in, , rajesh.[protected]@makemytrip.com, [protected]@ecor.railnet.gov.in, , [protected]@ecor.railnet.gov.in, [protected]@gov.in, appt.[protected]@gov.in, office.[protected]@gov.in, , deep.[protected]@makemytrip.com.

Complainants also market an email to PM office vide Grievance Registration Number: MORLY/E/2026/0007594 which is pending with RATNESH KUMAR JHA (EXECUTIVE DIRECTOR PG).

5. On Feb 14, 2026 an email received from [protected]@makemytrip.com from Yash Jain2
Email: Yash.[protected]@go-mmt.com stating You will be eligible for the 3X refund only if the ticket remains waitlisted at the time of chart preparation by IRCTC.
If the ticket status changes to Confirmed or RAC at the time of chart preparation, you will not be eligible for the 3X refund.
The offer is applicable only to tickets booked under the waitlisted category.

6. As per the ticket agent of official IRCTC act may be treated as cheating with people of India in cognizance with senior officials of IRCTC and Indian Railways that may be punished under BNS Section 318 BNS deals with cheating, specifically, fraudulently or dishonestly inducing someone to deliver property or consent to its retention. It outlines the offense of cheating and the potential penalties, including imprisonment and fines.

7. It is pertinent to mention here undersigned cancelled the tickets seeing dishonesty by the alleged employees of MAKE MY TRIP and IRTC.

You are requested to publicly apologize to the undersigned in writing. It is also hereby directed that you pay damages of Rs. 50, 00, 000/- (Rupees fifty lakhs) for mental harassment to us. It is also submitted that you have also directed the undersigned to pay a sum of Rs. 20, 00, 000/- (Rupees twenty lakhs) for mental harassment and torture. You are requested to pay Rs. 70, 00, 000.00 (Rupees seventy lakhs) for harassment/torture.

6. Also, 18% interest will have to be paid within 7 days from the receipt of this legal notice. Failure to do so will compel the undersigned to take appropriate legal action, both civil and criminal, as advised and permitted by law.

In addition, you will be required to pay ₹51, 000.00 (Rupees Twenty-One Thousand) as the cost of this legal notice. A copy of this notice has been retained in our office for reference and records.

7. Needless to say, the undersigned reserves the right to add to, modify, alter, cancel, or amend this notice.
