[Resolved]  Datawind Innovations Pvt. Ltd. — Neither deliver ubislate cz tablet nor Refund Rs 5999 with interest

I had booked 1 nos. o[censored]BISLATE 7CZ tablet phone on 24th Nov 2013 paying full amount through online payment. After 16 weeks ,payment made they have not deliver goods. I proposed them either deliver goods or refund. but they want deduct 500 Rs.
It is Datawind,s inability and they are not capable to deliver goods as promised in their advertise. How can DATAWIND punish customer by deducting Rs 500 from full paid advance money in refunding.Is this called justice. Deducting Rs.500 from from paid advance is not acceptable to me

DATAWIND should either deliver ubislate CZ or refund full amount. Matter is clear that I am not cancelling order but they are not in position to give delivery in time and for this you are not going face any loss .All this is because of DATAWIND's false advertisement(i.e. delivery within 2- 4 week after payment made in advance) regarding to delivery. It is their inability not to give delivery , for this They want to punish customer who trust them and pay them advance full money? Is this their business ethics for customer?

Dear sir

I had upgraded my 2 nos o[censored]BISLATE 7+ (PM72DFF5518E & PMD3480A06EC) to UBISLATE 7C+ (PME2841D6C6F and PMED93489AC8) as per Datwind's upgradation offer on 9 th feb 2013 by paying (Rs 1700 +Rs 1700= Rs 3400) through credit card on 12th feb 2013.In their offer DATAWIND proposed me to pay (Rs 1500+ Rs 1500) Rs.3000 towards upgradation o[censored]BISLATE 7+ to UBISLATE 7C+.But at the time of online payment additional Rs. 400 have been taken by DATAWIND. Thereafter I sent many mails to DATAWIND mentioning online payment made by me on 12 Feb 2013 and sending delivery of goods.

On 1st March 2013 at 6.00 pm delivery boy ( Named Rajesh chalke, mobile no [protected]) from FEDEX courier come to deliver 2 nos. o[censored]BISLATE 7C+ sets. Initialy he asked me to pay Octroi amount I agreed for it and asked me to sign on electronic recieved device I did so. Then he
asked me to pay additional Rs 1800 +[protected] and Rs 376 + 376 (Rs 752/-)towards COD and Octroi respectively . But I had paid already online Rs 1700 + 1700 towards additional upgradation charges as per DATAWIND`s offer on 9th Feb 2013. But I was ready to pay octroi charges but Delivery boy deny to give me delivery though, I showed all online documents which are attached to this email as proof of payment made.Even I talked to FEDEX office person on phone call regarding to delivery.After many reminders from me regarding to above matter, DATAWIND have not taken any step to resolve this matter.Therefore I may kindly request DATAWIND to either resend goods with proper document (Cash bill and not a COD bill) or DATAWIND may refund my paid amount Rs. 9400.00 to my Axis bank a/c no [protected], bandra East, Mumbai branch.

Sub : refunding Rs 5999/-
With telephonic conversation with your customer care ( Mobile No[protected] Representative of DATAWIND on 28th March 2013, DATAWIND is ready to refund me Rs. 5999/-( without deducting Rs 500/-) within a week, as promised .DATAWIND asked me give my bank account detail for refund. I have mailed my bank accuont details to DATAWIND on 28th March 2013 . So far DATAWIND has not refunded as they promised. For same I have sent 2 reminder so far.
Kindly deposit amount to my AXIS bank account as mentioned in mail.

I ordered ubislate 7C+ on 09 March 2013 and also paid online vide order ID PM0CFEEBD4B4 on same day i.e 09 March 13. Datawind promised to deliver product within 72 hours ut till date[protected] not yet received. Datawind also confirmed address on telephone. Now I checked booking status it shows "Status of your Ubislate 7Cp is pending. I requested may kindly deliver my ordered Ubislate 7C+ as soon as possible and any problem regarding delivery of product please contact me on my Cell number [protected]
