Sony India — Water damage due to manufacturing defect

i had purchased a sony xperia z ultra c6802 (IMEI NO :[protected]) from the sony exclusive showroom in lulu mall, cochin on 1/12/2014. the handset was claimed to be " water proof ". but im having difficulty in using the phone once i used it under the rain..before coming in contact with the rain, i made sure that all all the openings (the usb port and the sim card & memory card ports) are closed..after using the phone under the rain, it suddenly become unresponsive and had shutdown..i tried restarting the phone, but it didnt..after cleaning the phone i opened the charging port, i noticed water droplets inside it.. i was terribly shocked..water had entered into the phone even when the ports where correctly closed. after long hours of search in the internet, i came to know that the charging port cover had a rubber beeding, which was absent in my phone.. how can the phone manufacturer be that irresponsible and claiming it is waterproof? the phone is working now, but im facing great difficulty in using the touch screen. i rarely respond to the touch...i want my phone replaced under warranty since it is a manufacturing defect..otherwise i will be forced to file a case against the manufacturer.
