Vodafone — Charging of abnormal tariff for inernet serrvice by ignoring opted plan duly confirmed by Co.

Subject : Complaint against Vodafone company for issuing wrong and illegal Bill dated 21.03.2015 by charging abnormal tariff against opted tariff Plan for internet facility - Mobile A/c No.[protected]. Sir, The mobile connection bearing number[protected]Relationship number[protected] of Vodafone Company is being used since long and nothing is pending against this connection except part of wrong and illegal bill issued by the company on 21.03.2015. I want to submit as under:- 1. That the mobile connection bearing No.[protected]Relationship No.[protected] is being used since long and nothing is pending against above said connection except part of disputed wrong & illegal bill dated 21.03.15. 2. That I have submitted a request through my mobile for activation of internet facility of Rs 200 per month (having 2 GB data per month) in last week of February 2015 (probably during 25 to 27.02.2015). I have received a popup message from Vodafone Company with intimation that internet facility will be available within two hours. So, I started using internet facility for "Whats App" after lapses of considerable time from the time of intimation. 3. That the Company has not sent me any sms etc. intimating me not to use internet facility till receipt of further confirmation from Company. The Company has not notified the rate to be charged for using internet facility from day to day basis. 4. That the company has issued a wrong & illegal bill dated 21.03.2015 amounting to Rs 1774.62 with due date 08.04.2015. I visited office of the Vodafone Company at Dharampura Bazar in Patiala on 24.03.2015 to enquire about heavy amount shown in the bill dated 21.03.2015. The representative of the Company told me that total bill of Rs 1764.62 includes an amount of Rs 1504.40 on account o[censored]sing 0.36 GB through internet during period of bill i.e. 21.02.15 to 20.03.15 (Copy enclosed). It is pertinent to mention here that I have opted for 2GB pack valuing Rs 200 per month in last week of February 2015, butthe company has not given me benefit of this opted pack and intentionally issued wrong & illegal bill. 5. That I submitted a written complaint dated 26.03.2015 (Copy enclosed) in the local office of Company at Dharampura Bazar, Patiala regarding illegal and wrong bill issued on 21.03.2015. My complaint was received by Ms Neeru after initial refusal to accept the written complaint citing reason that they are not authorized to receive any written complaint. 6. That I told Ms Neeru, representative/employee of the company that I have availed internet connection of Rs 200 per month which entitled me to use 2GB data per month and requested to correct the bill, so that actual payment could be made within time. I further requested that bill for the next month may kindly be issued on the basis of requested plan. 7. That on same day of my complaint i.e. 26.03.2015, I received a call from phone No. +91 [protected] from Pune, Maharashtra at about 4.55 P.M. The caller Sh. Amol did not give any satisfactory reply of my complaint. 8. That on 28.03.2015, I again received a call from phone No. +[protected] at about 11.02 A.M. The caller told me that he is calling from Chandigarh and told me that your complaint is under consideration and further intimation will be given in due course. 9. That my complaint dated 26.03.2015 was not resolved upto 08.04.2015, i.e. last date of payment of bill, so I tried to contact representative of company by dialing at +[protected], but I received voice message that this number does not exist and check the number. 10. That since 08.04.2015 was the last date to deposit bill, so I deposited the bill of Rs 309/- (Rent- Rs 75 + internet pack charges -Rs 200 + Service tax- Rs 34) for the plan requested by me to avoid levy of late payment charges vide receipt No. PUN001C150408_11572570 dated 08.04.2015 (Copy enclosed). 11. That I submitted a written intimation dated 08.04.2015 to company that I have deposited payment of Rs 310. My intimation letter was received by Ms Neeru again after initial refusal to accept the same citing reason that they are not authorized to receive any written complaint. I further requested the company that next bill may also be sent on the basis of requested plan and my incoming/outgoing call facilities etc. may not be disconnected otherwise I will be forced to take suitable legal action against the company at the cost of Company. 12. That on 17.04.2015, I received a call from phone No. +91 [protected] from Hindupur, Andhra Pradesh at about 3.16 P.M. The caller Sh. Jaspreet Singh told me that he is calling from Patiala and enquired about reasons of pending payment. I told him complete story as stated above and requested to resolve the matter and furtherrequested not to disconnect incoming/outgoing call facility from my mobile connection. 13. That on 18.04.2015, I received a call from phone No. +91 [protected] from Gaziabad/Dadri, Uttar Pradesh at about 11.28 A.M. The caller Ms Gunjan told me that he is calling from Delhi and enquired about reasons of pending payment. I told her complete story as stated above and requested to resolve the matter and further requested not to disconnect incoming/outgoing call facility from my mobile connection. 14. That The Company has intentionally not activated internet facility even after ending confirmation of receipt of request in last week of February 2015 and further informed that facility will be available within 2 hours. The company failed to intimate me even up to 20.03.2015, that the facility requested by me in last week of February 2015 which has been allowed by company the company vide pop message, will not be available. This amounts to deficiency in service. 15. That not admitting to fact that internet facility was not admissible to me from last week of February, but for the sake of other users/argument, it is submitted that the Company is charging abromal rate for internet facility lowed by the company for day to day basis (i.e other than fixed monthly rental facility). The company has charged 41.78 times (i.e. 4178%) tariff than the tariff which is applicable on monthly basis which is calculated as under:- Amount for 2GB data under monthly plan = Rs 200. (i.e. Rs 100 per GB) Charged amount for 0.36 GB data = Rs 1504.04 i..e. Rs 4178 per GB) Required amount for using 0.36 GB data = Rs 36 (200*0.36GB/2GB) 16. That such a abnormal tariff for so called temporary service by the company as compared to regular tariff is applicable for any service in the world. The Company can not charge abnormal tariff for so called temporary service which is abnormally higher (4178% higher) as compared to fixed monthly fixed tariff for regular service. The company is not bothering to address genuine complaint of consumer and is causing mental tension to the complainant by sending voice mail whenever a call is made. It is apprehended that the company will disconnect outgoing/incoming calls etc illegally. The company should be directed to place on record :- a) The detail of my request made through my mobile requesting internet pack of Rs 200 per month (2 GB data) in the last week (probably between 25 to 27th) of February 2015. b) The detail of popup message sent by the company confirming receipt of my request with intimation that internet facility will be available within two hours. c) The details of action taken by company on my complaints dated 26.03.2015 and 08.04.2015. d) The detailed action taken on my requests made to representatives of company on 17.04.2015 (Mr Jaspreet Singh) and 18.04.2015 (Ms Gunjan). e) The detailed instructions of company which forbids its employees from accepting written complaints. f) The detail of rates notified the company regarding applicability of tariff (i.e. Rs/KB or Rs/MB or Rs/GB) for short term services (i.e. when fixed monthly tariff not opted by consumers) to consumers. g) Whether the rates as per (f) has been displayed on web site of the company and same has been/are being intimated to a consumer whenever any internet service for short period is opted by a consumer, so that the consumer will be in position to ascertain his bill amount. h) The rule/regulation alongwith approval of competent authority which allow the company to charge such a abnormal rates (4178% higher than fixed monthly tariff) for temporary day to day basis service. i) The details of consumers who have opted for fixed tariff plan on monthly basis, but same has not been activated by the company inspite of intimating consumer about availability of requested plan after 2 hours. j) The detail of amount billed or collected by the company, where requested plans have not been activated, as stated in para (i) above and bills have been sent to consumers by charging higher tariff, throughout in India in last three years. It is requested that company should be directed to rectify the wrong and illegal bill dated 21.03.2015 and to issue subsequent bills on the basis of requested plan. The company should be restrained from discontinuing incoming/outgoing calls etc. through my mobile connection[protected]. It is also requested that some suitable punitive action may also be taken against the company for charging abnormal tariff/rate from customers in the past. The company should be directed to notify the rates applicable for various services (i.e. day to day basis/ fixed monthly basis). The company should also be directed to activate the requested plan immediately on receipt of request and confirmation of same should be sent through sms instead of popup message within 2 hours and in case same is not sent by the company to consumer within 2 hours of request, the consumer is free to use requested plan unless it has been denied by the company through sms.
