Vodafone India — Fraud/misrepresentation of facts leading to overcharging on international roaming

This is to bring to your kind notice that i, anudeep gupta activated international roaming for my (2 numbers used by my wife and me) trip to italy. The numbers are: +91-[protected] and +91- [protected]. I had to chose (Without being educated by the customer care executive) the basic plan (Default plan offered by vodafone) as we were not suppose to use the line until there was an emergency. As soon as we were out of india, within 24 hrs there was a message of billing of approx 4000/- and 5000/- on both the numbers. I could not believe the basis of these charges. After sometime i checked both the numbers and noticed the outgoing calls were barred.
Unfortunately, day before our return flight my 7 year old son got sick and was on basic medication for vomiting and diarrhea and we could not call back our home for any help. While coming back from the trip 3-4th jan, 2017, we had a serious medical condition on our flight from frankfurt to delhi, lufthansa airlines, my 7 year old son was given emergency medical treatment and we reached delhi in unimaginable panic state. As soon as we landed and tried to call medical facilities/family members, we noticed that both the

Numbers were still out of service (I assumed that there was some problem and phones would be working in india). Somehow i connected with vodafone customer care to enquire, they acknowledged cutting both the lines and had raised an unbelievable outstanding amount of 17000/- and 18000/- on both numbers, and on requesting them again and again because of the emergency medical condition they did not activate the service and left us stranded with my ill son in my lap.
I have no words to share my horrible experience, though i have been their so-called valuable customer since many years.
The said services are suffering form the following defects:
1) it is the duty of the service provider to educate the customer about the product. Example: on doing my research, i noticed that data charges per mb charged to me is 563 rupees, whereas other telecom companies are giving 1 mb at around 30 rupees, including vodafone. The customer care executive has a responsibility of educating their customers.
2) it is the duty of the service provider to remove obsolete plans or expensive plans as default plans. Elaboration: the international roaming data plan offered to me was a plan introduced 5 years back. As you are aware technology is continuously improving and getting cheaper and within everyone’s reach. But vodafone did not change the default
Plan, which is very expensive. This exhibits fraudulent/misrepresentation of facts leading to unethical business practice.
On account of your aforesaid fraud and misrepresentation of facts; i have suffered financial losses/physical and mental stress. Though, the amount of
Tress cannot be compensated with anything monetary. I have no other option other than holding you liable to compensate me and my family with rupees 10, 00, 000/- (Rupees ten lacs only).
You are hereby finally called upon to
• remove the said defects in the services/product and
• rectify the outstanding amount for both registered numbers (Charge 30 rs per mb) and resume services on both the
Numbers and
• pay compensation for financial loss/ injury/harassment
Uffered due to your negligence/malpractices; within 45 days of the receipt of this notice failing which i shall be constrained to initiate against you for redressal of my aforesaid grievances and recovery of the aforesaid amount such proceedings, both civil and criminal as are warranted by law, besides filing a complaint under the statutory provisions of the consumer protection act, 1986 exclusively at your own risk, cost, responsibility and consequences which please note.
