Vodafone India — illegal payment recovery

We were in mauritius between 11th to 18th aug. Knowing the fact that there is no vodafone iroam pack, we ensured that our phones were never online, unless on wifi. We had only enabled sms pack of inr 149/- which only talks about incoming sms not being charged.

My 2 year kid has a habit of viewing youtube videos while eating. Knowing this fact, all her favorites were already downloaded. Below is a series of event that happened.

15th aug 2018, as per our schedule, we were in a hotel for dinner. Since there was no wifi coverage, we had ensured the phone is in offline mode before handing over the cell to our kid.

As per my understanding, around 8:25 pm mauritius time i. E. 9:55 pm ist, accidentally, my kid disabled airplane mode and was browsing online. I do not deny this fact.

However below is the questions i have been asking vodafone, for which i do not have answers till date. Thus i am not paying my bills. If any of the below questions asked are not genuine, no one from vodafone, has been able to help me understand the same.

1. There were alerts being recorded in the vodafone system on real-time basis which says i have been utilising my data on 15th aug 9:57 pm to 10:16 pm. The sms were recorded at an interval of 2 mins during the real-time usage by my kid. Knowing the fact that i am in a non-iroam country without a data pack, vodafone still continues billing me for the usage.
If my credit limit is inr 3000, i have already exceeded the same on first 20 mb. Ideal cases, when you exceed your limit, the out-going features are stopped. Vodafone talks about a continuous session billing, but the same is referenced only for voice calls and not for data in any documents of t&c.in addition, the usage intimation sms though were recorded on real-time basis, were never delivered.

2. Had my card been a pre-paid card, my outgoing would have been stopped immediately. I have experienced this in my pre-paid number in 2013. On asking a question why was it not done on my post-paid connection, they mention a dynamic credit rating. As per the guidelines, its vodafone’s discretion to give a dynamic credit. However, logically and by all practical means, you can increase the credit of a number by 10x and not 70x, without a consent or approval from the user.

3. I have an email from vodafone stating my outgoing was “temporarily restricted” until further notice on billed usage of inr 54, 630/-. Then why my bill came up to 1.8l?

4. The point related to cdr delayed billing in t&c, talks about i being liable to pay when there is a delay in reporting data. However in my case, when it was a real-time reporting, still there was no action taken and i am being penalised for the same. Is this justified?
