Zomato — cheating by delivery boy

I had placed an order for food with zomato [[protected]] yesterday. Delivery bill no. 8053 dated 05/06/2018 21.38 hours for an amount of rs. 612/- i did not have change; hence, i paid rs. 2000/- cash to the delivery boy who promised to refund the balance amount of rs.1388/-. This order was delivered at my above residence by the delivery boy salman zuber pwaskar (Mobile[protected] around 10.10 pm when my father was attending to his legal work in the bed room since he is an advocate. I did not have change; hence, i paid rs. 2000/- cash taken from my father to the delivery boy who promised to refund the balance amount of rs.1388/- (Rupees one thousand three hundred eighty eight only) after getting change from the shops nearby my above house. There was no reason to mistrust the delivery boy; hence, i gave one rs. 2000/- currency note to the delivery boy and took the delivery of food on the clear understanding that he will come back and refund at the earliest the balance amount of rs.1388/- (Rupees one thousand three hundred eighty eight only). He did not come. I therefore called the restaurant sardaarji (Lokhandwala complex) and told one mr. Shubjeet singh that the delivery boy had not refunded the balance amount as mentioned herein above. It was at this time i came to know that the delivery boy was from zomato [[protected]]. He asked me to call the delivery boy on his mobile no. [protected] and ask him to refund the amount. I as well as my father made several calls on the mobile no. [protected] of the delivery boy and he promised to refund the amount and it was taking time due to traffic jam. After some time he blocked my mobile as well as the mobile of my father ([protected]). We reported this again to mr. Shubjeet singh of sardaarji (Lokhandwala complex) who assured us that he had spoken to zomato and the balance amount as aforesaid will be refunded by them in a day or two. The delivery boy has therefore with a dishonest intent to defraud me obtained the money from me with clear dishonest intention not to refund the same; so as to cause wrongful loss to me and wrongful gain to himself and the property in question (Money) having already been taken by him, he has committed criminal offence under various provisions of the indian penal code, 1860 as advised by my advocate father and a culpable offence of cheating on the night of june 05, 2018 and the early hours of june 06, 2018 under section 420 of the said penal code. Besides zomoto is responsible to pay the balance amount as principal and also remove the delivery boy in question from job as he is a cheat and can cause more harm to public at large.
