[Resolved]  Club Mahindra — Cheating

HelloSir, My name is John Lionel and My ClubMahindra Member id is:[protected]. Here I just wanted to escalate againstthe false commitments and cheating done to me for refunding my money against cancellation. I wascontacted from MahendraClub, Cochin, Kerala office for an appointment (30thJune 2014) of just 10 mins during my office hours just to give an idea ofMahindra club holidays. I too was interested in knowing about the product as Igo for holiday trips almost every year. The marketing representative came to myoffice and we spent about 30 minutes and he explained me about the advantagesof having a membership with Mahindra. During my discussion with the sales representative, I clearly told himabout my preferences and priorities, ie, as I already have a membership withcoutryclub and few more options, this time specifically I told him that I wasspecifically looking for a abroad holiday options and he told they have resortsin Austria, Thailand, Dubai etc.. And on top of this they have an affiliationwith RCI which has more than 3600 resorts worldwide. I told him that I am goingto get an US work permit shortly from my office and the next 4-5 years I’ll bein Seattle, US. Hence looking for some holiday options in Seattle and my natureof holidaying is mostly on wildlife and hill stations kind of thing. Hepromised me that I’ll be having so many options in wildlife resorts where everI go in US or anywhere else. I haveclearly told him my preferences many times and he too agreed with mypreferences and promised to fulfill the same. He insisted me to sign thecontract then and there itself saying since he was coming from cochin, it’sdifficult for him to come once again to collect the documents and payment, butassured me if I find holidaying with Club Mahindra is not suitable for me, Ican apply for a refund even after enjoying my first holiday trip with ClubMahindra. He did not even bring a brochure or any other thing to give me moredetails on the resorts or the locations. He said, he would send the documentsby post as soon as possible. I simply trusted the brand Mahendra and signed thecontract for a blue season studio membership for Rs 2, 20, 000. I paid 22, 000.00Rs for becoming the member of Club Mahindra through my ICICI credit card. After some 3weeks, I received the documents about the resorts and it’s locations in US andI found not even 1 resort was in my taste. There are so many mountains andforests in Seattle state and not even a single RCI resort is even in thefringes of the location. So the next day I called the sales rep and told himabout this and he was not very sure about the RCI clubs in US. He asked to senda mail to memberrelations to cancel my membership. I sent a mail to thememberrelations dept and one Ms.Lakshmi from Chennai contacted me and enquiredabout why I was trying to cancel the membership. I have explained her my storyand she agreed with me and said she would forward this to Cochin office fromwhere actually I took this membership. From Cochin office so many people ( Mr.Vignesh and Ms.Sini)contacted me and tried to convince me. I told them about my case and requestedthem to cancel my membership. Initially Mr.Vignesh agreed to cancel memembership, but with a cost of 40% of my down payment (Rs 22000), but I wasasking for a 1005 reimbursement as I didn’t enjoy even the free complementholiday voucher. Though it was a 100% fault on their side ( as they gave mefalse commitments), they simply dragging the process of cancelling themembership for months. . I got disapponted with the services and false commitmentsof the club mahendra people, so I have applied for the cancellation & refundof paid amount on July 2014. Even after multiplemails and calls I didn’t get any properresponse from Cochin, I sent a mail with a warning as below, John Lionel <[protected]@gmail.com> Sep 1 to MemberRelations Hi, It's almost 2 monthssince I requested to cancel my membership, but I didn't get any confirmationfrom Cochin office. Seems cochin office is not serious about taking thecomplaints. If I don't get any response in the next 48 hours, I'll take thismatter to the chairman of Mahindra group. Literally I was not given any time tothink about taking the membership, but in between my office hours, therepresentatives met and forced me to sign the documents saying they cannot comeonce again from Cochin office and any time after enjoying the first holiday Ican cancel the membership. They swipedmy credit card on the sitting itself by around 5 pm and the same day theydeducted money from my account as well just to trap me and not to give anychance. But I never expected such a fraudulent act from a group like Mahindra. When I was contactedfrom the Chennai office, they never said this cannot be cancelled, I think it'sa problem with the cochin office guys. As I said, If I don't get this mattersettled in 2 days, I may force to take this to the next level. During the initialdiscussion with the sales person, I was promised that, I can apply for arefund even after enjoying my first holiday trip with Club Mahindra. My actualholiday with Club Mahindra supposed to be starts from October-2014. I received the complementary holiday voucherafter 3 weeks of signing the contract. In this scenario how do I cancel the membership in 2 weeks’ time after enjoyinga holiday? I have explained this so manytimes to Mr.Vignesh and he written a reply like above. Since he did not respondfor the repeated reminders in the last 2months, I was forced to write a mail with a warning message saying if hedoesn't respond I may escalate this to the next level. For that he retaliatedtoday by writing the above mail as if I can do whatever I want and he doesn'tbother. Again I wrote the below mail to Mr.Vignesh and I didn’t getany reply so far, Hello Mr.vignesh, I don't understandwhat you are talking here. From the day1 I have been requesting to cancel mymembership and you just keep delaying it intentionally and not replying so far.I don't really understand what you mentioned here as 'further to ourdiscussion'. What we discussed is about cancelling my membership and you said40% would be deducted as charges, but I asked the complete refund as assured byyour representative. In your presence, yourrepresentative agreed that I would get the complete refund even after enjoyingthe first holiday, but you are arguing refund is only if I applied within 15days of enrollment. As I told you many times and repeatedly, I didn't evenreceive the membership kit in 2 weeks’ time. Even before getting the membershipkit, even before knowing anything about the holiday plans you have, why wouldsomeone has to cancel the membership? When yourrepresentative came to meet me, I told him very clearly that in the next 5years I'll be in Seattle and I am specifically looking for a holiday option atSeattle and that too my taste of holiday is wildlife and hill stations. He sendthe list of options I have in Seattle only 4 weeks after I opted for this membership. He insist me to make thepayment on the first visit itself on the condition that I can cancel myholidays any time in the first 3 months. He too agreed this in your presenceexcept the 3 months time. As soon as Ireceived the list of holiday options in Seattle, the very next day I have contactedthe representative to cancel my membership. We spoke a lot and Iexplained you everything. You agreed for a refund of 60% of what I have paid, but I asked for a complete refund. Now what made to make a statement like I amnot eligible for any refund? After the abovemail, even while I kept asking for cancelation of my membership with clubmahendra, again they have deducted Rs 16500.00 from my account in July 2014. Ihave called multiple times to Ms.Sini, customer care representative at cochinoffice and she promised she will payback my second EMI with interest chargesand penalty . Now it’s almost 3 months and I didn’t get anything from Mahendra. Here I request you todo the needful get my money (22000 + 16500 = 38, 500.00 ) back as early as possible.
