[Resolved]  A retired State Bank of India official and now a pensioner — IT Refund of Rs.12,386 for the AY-2007-08 not received till date

Sub: Non-receipt of Refund of Rs. 12, 306 on IT Return submitted for AY 2007-08 of Nukala Manohara Rao ( DOB[protected]PAN # AARP and AARPN4100F- Return filed u/s 11 and submitted on[protected] which was acknowledged as [protected] Bndl # 76, Range:13 * REFUND *

1. A refund of Rs.12, 306 on the captioned reference has not been received by me till date. In this regard I have to submit that:
1.1. I have contacted your office 1st time on[protected]. Since almost all the staff were involved in receipt of returns for the AY 2008-09 by the duedate[protected], I was told to approach after 2-3 weeks by which time the staff would be resuming to their duties.
1.2. Next time when I approached in August 2008, enire staff were on STRIKE . It happened to meet ITO Range-4 ( name Sri, Gopala Krishna as I remember ) who was available at that time and apprise the position. He assured that he will look into the matter and asked me to come after a few days and meet the ITO Range-13(4).
1.3. Therefore as 3rd time I have come to your dept. during August 2008 and could not meet either of ITOs and approached Mr.Madhu, the Sr Asst of your office and requested to do the needful. He traced my return in the respective bundle #76 and observed that “no salary” was inscribed on the return. As it seems some of the enclosures submitted by me were missing, he asked me for the Xerox copies of my copy of the return and attached.He asked me to come after a few days by which time he said the return will be duly processed and the refund will be directly credited to the bank account thru MICR facility. And in case the refund amount is not credited into the account in a week or 10 days time, he advised me to approach the ITO Range(13-4) for the same.
1.4. It is in this process I have approached your office 4th time during second week of Sept.2008 and personally approached Sri. M Raja Reddy, ITO Range 13(3) Who was in additional charge of Range 13(4) also. He heard me patiently and got the return traced immediately and instructed concerned staff to process immediately and put upto him. He advised me to come after 10 days time and approach him in case the refund is not credited to the account.
1.5. Since I was away and busy with my family matters, I did not approach your office during Oct to Dec2008 despite the fact that the refund has not been credited to the account.
However I came to your office on[protected] for the 5th time and met both Sri. M Raja Reddy, ITO Range 13(3) and Sri. K Rockesh Kumar ITO Range 13(4) who assumed his charge during 1st week of October 2008 and requested to expedite the process. Both ITOS have duly responded and put the staff Sri. Abhay Chowdary, Asst and Ms. Priyanka Kumari, Asst ( both in Range 13(4) and Sri Madhu, Attendant on the job but for no avail. Further it was also verified in the computer system by Sri. Prasad in the lab and has confirmed that there was no entry in Range 13 (3) and 13(4). However Sri M. Raja Reddy ITO Range 13(3) told that he remembers to have transferred the file to Range-12 under whose jurisdiction my return falls (Since I am a pensioner from State Bank of India ). They have also verified the outgoing tappal registers in range 13 (3) and 13 (4) to find out the exact date on which the return was forwarded, but found that there was no entry made therein Then alternatively assumed that the same could have been forwarded under a covering letter, but the relative correspondence was not traced.
After waiting patiently for nearly 5 hours from 11.30 AM to 5.00PM, I was told that my return was not traced and for that matter the entire bundle # 76 was missing and will resume search the next day., on Monday[protected] since 3rd was Saturday being holiday and 4th being Sunday. Then Promptly I left the office.
1.6. Again resumed visiting your office promptly at 11.30 AM on[protected] for the 6th time and met both ITOs. Both ITOs asked the staff to be on the search. It was 2.0 PM. Then I met Sri. K. Rockesh Roshan, ITO who told that he has to construct the record and asked me to submit Xerox copies of the return along with an Affidavit-cum-Indemnity to enable him to forward the same to Range 12 for process.
Having told the reply at last I have gone out of the office and got Xerox copies of the return and submitted to him which was duly handed over to Sri. Abhy Chowdary, Asst.
2. I request your good selves to please clarify me on the following points:
2.1. Is it compulsory and mandatory for me to submit the Affidavit-cum-Indemnity on Rs.20 Stamped paper duly notarised in the circumstances that the relative return was either not traced or lost at ITO office?
2.2. Is it appropriate to submit the Affidavit-cum-Indemnity by me in the absence of relevant communication directing to me to do so for no fault of me?
2.3. How the return was then accepted and acknowledged by the Range 13 without being directed to Range 12 for submission?
2.4. How much time ( period )it will take to process and refund? Or Is there any time limit?
2.5. I fail to understand how my return will fall under jurisdiction of Range12 where in I am a SBI pensioner since[protected]?
2.6. Why e’mail addresses of any of IT Officials are not displayed on the internet site when the department itself is being IT enabled and submission of returns is made online?

3. In the circumstances I would appreciate if an appropriate and correct course of action to be followed be advised to me .
