[Resolved]  Co-Operative Housing Society — Repairing of our ceiling and wall

i had 2 flat in our society on the top floor, in our society we had 2 wings A and B both the wings are of 4 th floor, i ahd 1 flat each in both the wing on the 4th floor.

In the year 2008. we had faced lot of problem due to rain water from the top of the ceiling and wall in both the flats. due it there were dampness on the ceiling and wall. i had made complaint to our society in 2008. but they had taken action for water proofing of terace this year in the month of June 2009.

My question is that the dampness which is there in flats, Is there any right to the member where he can claim for the dampnees from the society.

kindly help me out in this matter.

There is an old buliding situated on Nehru Road Opp Post office by the name of Kalika Niwas is in bad shape there is no repair conducted, Please revert for this

I have contributed a amount to society for repairing which was going to happen in that month (Dec 2009), but some how all of the tenants did not gave money so it was held up. After that there was no meeting held about the repairing.

As when the work was to be done was not sure i asked for refund & gave a letter to secretary.
But till to-date no steps have been taken to refund my money back.

Please suggest what action should I take.
There is a leakage of rain water from the terrace and the walls of the building and the 3rd floors (top floors) are mainly affected by it. Even 2nd and first floor also are affected by the water leakage. Our society's working committee is not paying attention on it, they even refuses to accept the written complaints. AGMs are also not called for last 5 years. Our society has got an ownership flat at ground floor. It's monthly rent and maintenance also comes regularly. But, the committee members are not ready to show the funds of th society. We need an amount to build a shed on the terrace and it is a preliminary need.

In the recent monsoon most of the families are suffering from water leakage from the terrace. They are not agree to construct the roof on the terrace, as most of the societys have done and their problems are solved.

Can we sue the society? What will be the procedure?

I am a member of a society called Pramukh Vijay Coop Hsg society in Marol, Andheri (E), which is part of the LT Colony. We have been residence of this society for the last 30 + years and have been very regular in paying all the maintenance and other charges demanded by the society at regular intervals. However now my grouse is I had a near death accident when my roof of the 4th floor aprt that I live in collapsed and almost killed me and my son. Before this I had major leakage which destroyed my fan and I made a complain of the same to the society. They did not take any action to this and hence the second mishap took place. Now they have woken up and agreed to do the repairs of the terrace which is in a miserable state, so much so it could be dangerous to the whole building. However we refuse to pay the charges for the damages caused to myflat due to the negligence of the society in full, they reckon they will pay only 25% of the charges and the balance 75% has to be paid by me. Please let me know if this is justified. Also is there a clause that says that the society will pay only 25% of any damages casued to members flats due to negligence of building maintenance as they mention to me. Would appreciate your advice.
As per the bye laws, the terrace belongs to the society it is their duty to see that the terrace is done. pl. advise your cell/tel. number may be I could speak to you on this issue & give you more knowlege also there are many associations which do come forward to help
society matters r covered under consumer protection act. member is a consumer of the society and u can apply to the consumer court seeking direction against d society to pay u compensation for dampness. pl note that u must substantiate ur each n every contention with supporting documentary evidence.
I AM A ONWER OF A FLAT IN MUMBAI HOUSING SOCEITY.MY FLAT IS ON THE TOP FLOOR OF THE BUILDING. THERE IS LEAKAGE IN THE CEILING FROM THE TERRACE. I HAD JUST PAINTED AND RENOVATED MY FLAT . THE PAINT HAS PEELED OUT DUE TO DAMPNESS AND MY FURNITURE HAS ALSO SPOILED. I AM PAYING REGULAR MAINTAINANCE OF MY FLAT. I HAVE MADE WRITTEN COMPLAINTS TO THE SOCEITY BUT THEY ARE NOT CARRING OUT REPAIRS ON THE TERRACE FLOOR WHICH HAS BECOME SOFT AND WATER IS GOING INSIDE THE GAPS INTO OUR FLAT. IS THE SOCEITY RESPONSIBLE TO MAINTAIN THE TERRACE AND BLOCK THE LEAKAGE ? CAN I STOP THE MAINTAIANCE OF MY FLAT TO THE SOCEITY..AND WHERE SHOULD I COMPLAINT NEXT AS PER LAW.
