[Resolved]  PRTC — Violation of Fundamental Rights

Modi Garden a layout located in the heart of the city under corporation ward no 47(DJ-Halli) is only at a distance of six kilometers from Vidhana Soudha.
It is with great sense regret that Modi Garden Residents submit before you the following problems for your kind consideration as following: -
• Road
BWSSB Water Supply and Sanitation
• Government Transportation
• Road work
Modi Garden has only life link road with other parts of the Bangalore through Desraj Urs Road and Sawerline Road. This is a public road as per state records. The Modi Garden Residents road connection has been cut-off by the Army authorities namely Parachute Regiment Training Centre which has caused lot of hardship.

Residents approached the army authorities which went in vain and could not get justice. The Residents were forced to approach the Hon’ble High Court of Karnataka. The Hon’ble High Court of Karnataka heard the argument and gave an interim stay order and asked the army authorities to keep the road open for public use.
Inspite of the Hon’ble High Court of Karnataka orders, The Parachute Regiment Training Center has closed Southern end of the Desraj Urs Road and Sawerline Road to which the Residents then went on a Dharna under the guidance of Shri.H.S. Doraiswamy who is a Senior Respected freedom fighter. The army authorities did not even have the courtesy of meeting the freedom fighter. This was highlighted in all the leading newspapers on 15th February 2005. A memorandum was given to the commander of the sub-area regarding the same on 14th Feb 2005.

After these incidents the Parachute Regiment Training Centre has continued to harass the resident by stopping state authorities to develop the locality such as BWSSB in Connecting Kaveri drinking water supply and Pipes of sanitation. The local authorities of the government did not question the army authorities. When we approached them they say that the residents have to only get the permission from the army authorities.

Recently The Parachute Regiment Training Center have erected two new gates one on Modi Garden Entrance and another on Northern End Desraj Urs Road and Sawerline Road and from 23/01/2010 the authorities has closed the said gates in the pretext of 26th Jan 2010 Republic day, Forgetting that we the resident of Modi Garden are Indian and the said day is also celebrated by us.

The road issue is pending disposal before the Hon’ble High Court of Karnataka in W.P(G.M, P.I.L[protected]/2003 but the army authorities are destroying the evidence such as the BBMP sign Boards on the Desraj Urs Road and Sawerline Road and erecting their sign Boards.

This Military authorities are not even allowing state authorities like Police, BESCOM, BWSSB or even the ambulance to enter in case of emergency.

We the residents have written many letters to various authorities regarding our problems such as State and the Central Government, No authorities have come forward to liason with this Military authorities and give us freedom of right to way.
Kindly consider the complaint and get the road opened before any incident which involves violence to happen.

Its painful to here that the residents of Modi Garden don't have a proper road for transport. The Indian Army (PRTC) should close the forest roads at the border of Kashmir in other places through which terrorists enter, I don't know why PRTC, which is supposed fight against the terrorists and save country, is interested in fighting with Modi Garden residents with no weapons ...
The PRTC after losing the case on the road dispute last weak is acting very cheap at the Modi Garden by attacking the young students for no reason and trying to fix them in some case to just prove the court that there are illegal activities happening in their PRTC campus ... Very cheap :-(
The PRTC army personell who are serving in the Army and retired from Army are also the residents of Modi Garden. The Army servicemen were not alloted quarters hence living in our premises however we are not indifferent towards them as they represent our country but when we residents of Modi Garden in times of emergencies like taking money from ATM enter the road they are hostile and talk very indifferently. We have very high regards for our defence but such acts are degrading to the residents of Modi Garden. Humble request the authorities of PRTC to honor the court orders and release the road as in times of emergencies the Kaccha road during rains is unusable and the potholes on roads are unusable with vehicles. Autos and Taxis refuse to come in that road or charge double with grumbling. Can this reach to higher authorities?!
These Army fellows at PRTC do not deserve any facilities given by the Central Govt, they tell that they kept the Sawar line road closed for their security. But I being a student ask these Indian Army Fellows that for whose security ( Common man or your own what so called PRTC campus ) does the Central Govt pays you and gives you tax less or less tax commodities . The Army personnel at PRTC should ask this for themselves.
In spite of disobeying the court orders several times, PRTC has been given time to think on this issue at every hearing. Why is the HC not taking any action against "contempt of court" by PRTC, instead giving a next date???
