[Resolved]  Samsung — CHEATING OF SAMSUNG EMPLOYEES..

Sir,

I Arvind Vashistha (Advocate) office at: - 225, A-2/42, IInd Floor, Gupta palace, Rajouri Garden New Delhi, do hereby serve you legal notice:-


1. That I am a consumer of your company and has purchased a product of your company i.e. Samsung Corby Pro “GT B-5310 mobile phone IMEI No. 352206/04/051032/0” from “The Mobile Store Limited” G-3 Aggarwal City mall, Sector-5 Dwarka, New Delhi.

2. That I have purchased the same on dated 22/01/2012 and the same is under warranty period of 1 year i.e. upto 21/01/2013.

3. That for the purchased of the same the mentioned store issued and raised Invoice No. DL/118445 and for the purchased of the same I had paid Rs.6000/- included Tax.

4. That I had a complaint with above said product sold by you and within warranty, I went to your Samsung authorised service centre Named: CELL NET, L-1 Mahavir Enclave, Palam Dabri Road, New Delhi-110045 on dated 07/02/2012 for the showing of the fault of my phone “i.e. calling problem”. On the same day they serviced my phone and gave it back to me but after that there were some other problems, I found in my phone which wasn’t earlier before that service on which I got a doubt that the service person might have changed some original parts of my phone and I again went there on dated 20/03/2012 for the complaint of my phone. The Service person while serving break my phone in front of me and said that “Ab aapke phone ki warranty khatam ho gayi hai, ab aage se aap isey kabhi bhi free mei thik karwane ke liye hamare pass nahi laoge” and on my objection, the manager of above mentioned service centre named HARSH misbehaved with me, used abusive language and start to do scuffle with me. After that when I ask them to give me in written that they open my phone, a female service person destroy the Job card of my phone which is made by the service person and other documents which is related to my cell phone and the same by my noticing all the incident was also recorded in the cameras fitted there and also noticed by some other consumers in the service centre.

5. That on the same time at 4:18 pm I call the P.C.R to solve the matter but they do not pay any heed and even humiliated me saying that “Teri aukad hi kya hai, tujhse Jo kuch ho tu wo kar le, Hume jo karna tha wo humne kar ke dikha diya”.

6. That when the P.C.R police officers feel that the misbehaving of service centre persons are continue and they don’t want to solve the matter, they transfer and registered the matter to LP local police station. and after some time when IO came there and trying to solve the matter. Manager Harsh said that “Isey ab se payment toh karni hi padegi, ab kuch nahi ho sakta”and said to me tujhe jaha complaint karni hai waha kar le mera kuch nahi bigad sakta meri pahuch bahot upar tak hai, or mere liye toh vakil Samsung wale karenge.After that IO took the Manager Harsh to the police station.

7. That when I feel that the manager harsh does not want to solved the matter and regularly misbehaved with me, I filed a written complaint to the police station wide DD. No.37A. Dt.20/03/2012.



I, therefore call upon you through this legal notice to respond within 15 days of the service of the
same as to:-


1. Why I should not file a complaint to Monopolies and Restrictive Trade Practices Commission (MRTPC) for unfair trade practice?

2. Why should I not complaint in consumer forum?

3. Why I should not institute criminal as well as civil proceedings in competent court of jurisdiction against your company and service centre for breach of contract, humiliation, and harassment etc caused due to snag in your product and your service centre?

4. Why I should not file a suit against your company for Damages/Compensation?

5. Why I should not made the Samsung Company Party to proceedings?

6. Why should I not send a complaint to the Australian Company “CELL NET” (Add: 59-61 Qantas Drive Eagle Farm, Queensland 4009) whose name you are using?

Otherwise I would be contrant to initiate all possible legal actions against you at your cost and risk.
