[Resolved]  SBI Cards — Harrasment

My wallet wast stolen on 30 dec 2011 and was misused by some unknown person .Although the cards are safe now as the merchant had doubt on the person and collected all the cards from him but he swiped my card no clue why.

The name of merchant who is the witness of all the incidence is mr. Shailender and his contact number is [protected].


I also logged fir against that person at indrapuram police station other than this I already informed sbi call center as soon as I got information about the above mentioned fraud.

They took around 3 months and without investigating anything they imposed all the payments liability to me.


On the other side to the merchant (allen solly) was claiming that sbi reverted back all the amount from his account but sbi fraud department is not aware of that which means fraud department haven't contacted the merchant and haven't inquired anything.


SBI asked me to provided the declaration of the merchant in which he mentioned that he collected all the cards from thief , I provided the same to the SBi but again they started harassing me.Finally after almost 5 months I was able to get the money from Allen Solly Merchant (who collected the card from thief and wrongly swiped my card) I called SBI representative Mr. Puneet and handed over the amount in front of few witnesses which is now reflecting in my statement.

After chasing a lot to the merchant and SBI I finally able to get cheque of amount which was wrongly swiped by Allen Solly merchant with wrong intention and handed over to the SBI representative Mr. Punit in front of witnesses.I have copy of receiving in which Allen SOlly Merchant admited that he wrongly swiped the card.

Now there are few more things :


Bank is saying the other merchants handed over all the good to that thief hence the liability of payment is mine:

My concern is

1)When Allen Solly Merchant caught the thief and collected my all the cards from him and also collected all the goods which thief purchased from the Allen Solly also according to the store Manger of Allen Solly he slapped the thief and they clicked several photograph of him then how did they allow him to run with the goods which thief purchased from other shops ?


2)When Allen Solly caught the thief Why he swiped my card he could have cancel the generated bill?


3)My card was unsigned although It was Risk for me the chances for risk was that the thief could have sign my card and same signature he could do on the charge slip then the liability would be mine or Merchant could ask the thief to sign the card in front of him and same signature he asked him to do on the charge slip and match the name with my Id proof or the card and allow him to shop as much as he want to.But my fortune that any of these case did not happened and eventually I got my card back from Allen Solly Merchant.

Now As per Visa/Master guidelines If the cardholder refuses to sign the card, and the merchant accept it, Merchant may end up with financial liability for the transaction should the cardholder later dispute the charge.

Could not a thief have signed a previously unsigned card before using it? In fact I would expect precisely that behavior from a thief. Wouldn't a thief take more care to sign than would a lazy, careless card holder? Upon seeing the unsigned credit card, their estimate of my honesty should go up not down (well, that's not quite a stable equilibrium...).

I've often complained about the same thing, though in my experience merchants do accept you signing the cards in front of them—though the clerk tends to look annoyed. However, let's consider for a moment the possibility that this isn't totally pointless and ask what the reason might be. First, we have to assume that the signature is of any use at all, that is that merchants do check signatures against the card and that the attackers aren't good at forging signatures. I'm not sure that either of these is true, but let's assume that they are. If so, Visa has an incentive to force you to sign your card immediately to avoid situations in which your unsigned card falls into the hands of criminals, who then sign it. Since they can't send a CSR out with your card to make you sign, having your card denied if it's not signed is probably the best they can do.

This sort of matches up with Visa's card acceptance policy, which actually requires the customer to sign the card in the merchant's presence (thanks to Tangurena on MR for pointing to this):

While checking card security features, you should also make sure that the card is signed. An unsigned card is considered invalid and should not be accepted. If a customer gives you an unsigned card, the following steps must be taken:

Check the cardholder's ID. Ask the cardholder for some form of official government identification, such as a driver's license or passport. Where permissible by law, the ID serial number and expiration date should be written on the sales receipt before you complete the transaction.
Ask the customer to sign the card. The card should be signed within your full view, and the signature checked against the customer's signature on the ID. A refusal to sign means the card is still invalid and cannot be accepted. Ask the customer for another signed Visa card.
Compare the signature on the card to the signature on the ID.

If the cardholder refuses to sign the card, and you accept it, you may end up with financial liability for the transaction should the cardholder later dispute the charge.

Note:my 3 cards got misused hdfc gold debit card,standard charted bank credit card and sbi gold credit card.


HDFC had resolved my case within 15 days of logging dispute.
