Hyundai Motor India — old car given us in place of new car

Dear Sir/Madam,

I booked a car (Grand I10 Magna) from the dealer Modi Hyundai, Malad West, Link Road, Mumbai on 26th Dec 2018. We got this car for Rs. 520000/- On 14thJanuary, when we went to take the delivery of the we noticed the engine, silencer rusted and color faded. And after checking the manufacturing date of the car it was, January 2018. But the sales person Mr. Ram Pathak had promised us the car manufacturing date will be Oct, Nov, or Dec 2018. And also on that morning before taking the delivery of the vehicle we received a call from Hyundai Service centre. Ms. Sarita was asking on the reviews of repairing the car. She took my name i.e me Mr. Wilson had brought the car for repairing and painting. Without taking the delivery of the car, how can I take the car for repairing? And she also told that I have paid some 3400/- as a repair charges. So we understood it was sent by the showroom to the service center. And the car was already registered in my name, so that she could call us and ask about the reviews. We immediately understood the car was old and repaired and given it to us. This is the main reason we inspected the vehicle and came to the conclusion it’s a old car. So we have not taken the delivery. But they were saying they cannot give us replacement of the car, nor they accepted the fault. So we had to call the police.

When the police arrived they said their General Manager, not there today to assist them, and Ms, Cynthia, customer care manager said, tomorrow i.e 15th he will be there in Bangur Police station, Malad west at 5.00 pm, and asked us to come there, but he did not turned up. We wasted 2 days with the police, and Modi Hyundai people did not come to meet them. So we had to come back, after giving a written complains in the police station. And police advised us to give the complain in Consumer court

We even made many calls to Hyundai customer care in Delhi, spoke to Ms. Laxmi, Ms. Radha, Mr. Milan, and so many other names I don’t remember, but that was a waste. Even I called Hyundai Mumbai regional office, they said they will solve our problem and disconnected the call assuring us they will call back, no response from them anytime.

Moreover we had done twice the payment (520000+520000). Since the sales person Mr. Ram insisted, if we don’t pay before 31st December 2018, the deal will be closed. Since the loan amount couldn’t be processed before 31st December, we took overdraft from our FD’s and paid the full amount 520000 on 31st December. After 2 days our ICICI bank had processed the loan and that amount also credited in their account on 2nd January. Mr. Ram clearly told us, once when they get the loan amount from the bank immediately they will refund the amount to our account.

So since 2nd of January till yesterday evening, we were following up for the refund, and at last after only when we called the police to the showroom, they started processing the refund and we got back yesterday evening our excess amount paid to them. We had to bear lot of mental harassment for our refund since January 2nd till yesterday evening.

I request you to please take the matter with them and resolve our issue.
