We would like to update you on our below issue with Bank of Baroda, Fatashil Ambari Branch where they have failed to carry our due Adherence to Procedural Guidelines and Circulars of RBI in levying Minimum Balance Charges as they are not able to provide any proof, data or records in regards to the same.

I request concerned authorities to conduct an Full Audit whether the said Bank of Baroda followed all the RBI Rules and Guidelines while conducting all the day to day activities and make appropriate actions if the bank branch is found guilty of non compliance of any RBI Guidelines.

Moreover in my case the said bank is unable to show me any proof, data, records which have been followed while charging Minimum Balance Charges in my account. Please conduct Full Audit for the Minimum Balance Charges levied and all other charges levied to all the customers of the said branch whether the said branch is following all the RBI Rules, Guidelines and all other necessary compliances while performing all the day to day operations.

The below were my queries with the said Bank Branch which they failed to provide.

1. (i) In the event of a default in maintenance of minimum balance/average minimum balance as agreed to between the bank and customer, the bank should notify the customer clearly by SMS/ email/ letter etc. that in the event of the minimum balance not being restored in the account within a month from the date of notice, penal charges will be applicable.

Query: - Provide us necessary proofs of notification given to me clearly by SMS/EMAIL/Letter.

2. (ii) In case the minimum balance is not restored within a reasonable period, which shall not be less than one month from the date of notice of shortfall, penal charges may be recovered under intimation to the account holder.

Query: - Provide us proofs of intimation of information regarding charges levied due to Minimum balance not maintained by SMS/Email/Letter etc.

3. (vi) It should be ensured that the balance in the savings account does not turn into negative balance solely on account of levy of charges for non-maintenance of minimum balance.

Query: - My Overall balance in your savings account is Negative Rs. 476.23/- which should not happen because as per RBI the balance in my account can not be negative in any case.

Moreover I want REVERSAL of all the charges levied in my account and all others customer in which RBI Guidelines have not been followed.

The Branch Manager and all other Top Bank Officials who are found negligent in rendering satisfactory banking services should be SUSPENDED FOREVER. Our above case raises a questions mark: Are there no analytical system to check compliances with various RBI Guidelines and Rules for each and every transactions at the banks end so that corrective necessary actions can be taken for the aggrieved customers before much delay ? What Bank officials are doing all day long ?

Please take urgent necessary corrective steps on the same on high priority basis.

Dear Sir/Madam
Levy of penal charges on non-maintenance of minimum balances in savings bank accounts
Please refer to our circular DBOD.Dir.BC.53/13.10.00/2002-03 dated December 26, 2002 on ‘Minimum Balance in Savings Bank Accounts’ advising banks to inform customers, in a transparent manner, regarding the requirement of minimum balance in savings bank account and levy of penal charges for non-maintenance of the same at the time of opening the account.
2. In this connection, a reference is invited to paragraph 30 of Part B of First Bi-monthly Monetary Policy Statement, 2014-15 announced on April 1, 2014, regarding ‘Developmental and Regulatory Policies’ proposing certain measures towards consumer protection. One of the proposals contained therein was that banks should not take undue advantage of customer difficulty or inattention. Instead of levying penal charges for non-maintenance of minimum balance in ordinary savings bank accounts, banks should limit services available on such accounts to those available to Basic Savings Bank Deposit Accounts and restore the services when the balances improve to the minimum required level. A reference is also invited to the recommendations of Damodaran Committee on customer service in banks which, inter-alia, recommended that ‘banks should inform the customer immediately on the balance in the account breaching minimum balance and the applicable penal charges for not maintaining the balance by SMS/Email/letter. Further, the penal charges levied should be in proportion to the shortfall observed’.
3. The policy announcement has been reviewed after extensive consultation with banks. Consequent to these deliberations and after taking into consideration the recommendation of Damodaran Committee, it has been decided that while levying charges for non-maintenance of minimum balance in savings bank account, banks shall adhere to the additional guidelines given in Annex. The guidelines come into effect from April 1, 2015.
4. These guidelines should be brought to the notice of all customers apart from being disclosed on the bank’s website.
5. In the meantime, all banks are advised to take immediate steps to update customer information so as to facilitate sending alerts through electronic modes (SMSs/emails etc) for effective implementation of the guidelines.

Levy of charges for non-maintenance of minimum balance in savings bank account shall be subject to the following additional guidelines:
(i) In the event of a default in maintenance of minimum balance/average minimum balance as agreed to between the bank and customer, the bank should notify the customer clearly by SMS/ email/ letter etc. that in the event of the minimum balance not being restored in the account within a month from the date of notice, penal charges will be applicable.
(ii) In case the minimum balance is not restored within a reasonable period, which shall not be less than one month from the date of notice of shortfall, penal charges may be recovered under intimation to the account holder.
(iii) The policy on penal charges to be so levied may be decided with the approval of Board of the bank.
(iv) The penal charges should be directly proportionate to the extent of shortfall observed. In other words, the charges should be a fixed percentage levied on the amount of difference between the actual balance maintained and the minimum balance as agreed upon at the time of opening of account. A suitable slab structure for recovery of charges may be finalized.
(v) It should be ensured that such penal charges are reasonable and not out of line with the average cost of providing the services.
(vi) It should be ensured that the balance in the savings account does not turn into negative balance solely on account of levy of charges for non-maintenance of minimum balance.

You can see in the above notification that there are some guidelines to be followed by banks before levying Minimum Balance Charges. Please see my queries on respective guidelines by RBI.

I think various RBI Guidelines are not being followed by your branch and are being taken not seriously.

So, in regards to my above query provide necessary proofs of compliances by your Bank Of Baroda of Fatashil Branch.

    I have a locker with bank of baroda, altamount road branch 36, crystal, kemps corner, mumbai 400 026.
    Bank is not allowing me to operate my locker reason giving prohibitory order. I request to give me the prohibitory order copy but they did't give me the copy and also not allowing me to operate my locker since last three months. My locker no. Is 985

        I paid for one dress at paytm using bob debit card, but due to some problem in dress i have cancelled that order and paytm contomer care service has informed me that they have proceeded my refund but i still not get my refund.           My name is abhay gupta having account in bank of baroda, khera nawada branch [protected].. Sir but badoh branch of bank of baroda has used my aadhar number[protected] due to which i had a loss of gas subsidy for more than two years... Kindly ask them to recover my subsidy and also take strict action against those who are responsible for my loss... And these # are not even recieving my call... Do take serious action against the bank for this fraud and helpless nature after fraud

            I did not get my refund in my bank amount having generated the reference number. It has been 10 days since reference number generated. Customer care service did not helped me. I had bought a product from amazon which i returned and ask for refund.. They processed the request and got the reference number means amount is deducted from their account but not credited to mine.

              Amazon.in initiated the refund rupees of 1898. On 17 may 2018 so according to amazon refund should be reflect in my account till 23rd may 2018 but still i didn't get the refund i complained in bank customer care and bank of baroda branch also but i didn't get conclusion and i contact to amazon again regarding the refund so amazon given the refund reference number to me which is[protected] kindly credited refund in my account with few hours.

              I have recharge from amazon pay 89 rupees and payment matherd Dabit card but recharge is decline not refund my bank

                With regard to an item (Phone) which i had recently purchased from amazon.in.. I wish to raise a complaint regarding a refund on this item due to some problem with the item... So it was said that the refund has been made from amazon.in.. But it has not been credited to my account;which is from bank of baroda... I also have a reference number which states that the refund transaction has been made to the bank... Is there any way where i can receive back the money.. It has already been 10 days since the refund has been initiated to the bank...

                  I have ordered blender. By mistake opted for amazon prime membership. Membership was cancelled on the same date of the order by taking help of customer care.

                  Refund has been initiated by amazon as on 05/08/2018 for that membership. Same should be reflected in bank by 05/16/2018. Has not been credited to my bank till 05/22/2018. Refund reference number is[protected]. Talked to customer care both at amazon and bank of baroda. But issues is not resolved yet.

                  Please do the needful.

                        I cancelled 3 orders which were from amazon amounting to rs. 1739. The transaction was done on 10th may 2018 at 4.13 pm. I contacted amazon executives and they said the refund amount has been processed from their end. The reference number of my refund is[protected].

                        Please check were is the default in the refund and please do the same as soon as possible

                        The amount of INR 175.00 is initiated from Amazon.in on 13/may/2018 but it is still not showing in my credit history.

                              I have paid amazon 13049 on 4 may 2018 and after cancelling my order amazon refunded the amount as they are saying it on 8 may 2018 with refund ref no.[protected]but amount not reflected in my bank account till now. I have called so many times to bank of baroda as well as amazon but no action taken from both side so i want to file charge dispute against them.

                              Refund amount from Amazon not received in account. Customer care said to mail all details. Did that, but did not got and response.
                              Amazon processed refund on May 1 of amount 369.

                                I have not received my refund amount of rs7695 in my bank account. The refund has been issued by amazon on 12 may 2018.
                                The authorization refund number for the transaction is 202104. The bank is denying from the fact that there had been any refund initiated.

                                And amazon is saying that they have made the refund by 12 may. I contacted the bank customer care they are denying from this fact that this refund transaction number seems like useless for them. It has been 3-5 working days still no refund has been initiated.. Kindly see in this issue.

                                  This is to your kind notice that i had lodged many complaints in bank but unable to get any resolvement till now. It had already four months passed away.
                                  Below the description of complaint is also given:

                                  I am account holder of bank of baroda (A/c no. [protected]) on 11 jan 2018 i withdrawn an amount of 3000rs but the transaction (Transaction id: s[protected] was failed but my account was debited by this amount against which i had made a complaint and got only 1000rs on 22 jan 2018 after which i had made many complaints in the bank but unable to get remaining amount of 2000rs till now and bank will not giving any response to my complaints.

                                  It is my humble request to you that please take immediate action to redress my complaint as soon as possible.

                                    A refund has been made by amazon in FEB 2018regarding a product which i've ordered through the amazon. But the refund has not been received yet. Bank is saying no amount has been received by them. I've talked to them again and again but no response is coming. So i need to file a "charge dispute" on them, to get the full details. I need bank to resolve this issue as soon as possible or i'm gonna take some legal action.

                                      I have a new account but my account is still freezed i am daily visiting to branch but everytime they make a new excuse and don't solve my problem. A account is opened in 10 to 15 working days but they had open my account in 2 months. Even i haven't got my cheque book yet. From 3 days i am daily visiting to the branch. From start they were not supporting me. Its my humber request to you that please solve my problems. Otherwise i have to visit to consumer court.

                                        Staff in vrindavan branch is very very uncooperative and even the manager is having a very disgusting attitude... They refuse to deposit cheque giving lame excuses that figures are not clear.. Although the cheques are digital and computer generated... Despite repeated attempts and request.. Their attitude remains the same... Pls look into this matter as soon as possible...
