Hello sir/madam,

My name is piushkumar maru. I had purchased an lg led tv from reliance digital xpress in viviana mall (Malls address: 2nd floor, thane west, thane - 400601, next to jupiter hospital, off eastern highway).
I was consulted for 0% loan on the product by mr. Sieran kumar of capital first. (The capital first's representative name was provided to me by mr. Sanjay from reliance store, i believe he is the head of store). Since i was not carrying any document proof for loan process, i was told that my documents could be collected from my home. So the product was delivered to my house and the person (Mr. Aakash from reliance) who delivered the product collected my documents (One cancelled cheque of hdfc bank, my self-attested passport copy & pan card copy). When i provided the document, i was told to sign the ecs mandate form, but since i had incorrectly signed the ecs mandate form and it was the only form that mr. Aakash was carrying with him, i told him that i will keep the ecs mandate form and will sign the new form. Also, the cancelled cheque that i had provided had some details on it, so i called mr. Sieran kumar to see if that cheque would work, but as he was also not sure about the same, he said he will let me know after checking with someone from capital first and that he will meet me with the new ecs mandate form to avail my signature on it. After few days when he called me twice during weekdays i was not available as i had already told him that i can be available on weekends. After the two calls i never got any calls from him, but i received an sms from capfirst on 28/11/2015 that my emi's will be starting from jan-05-2016. I was under the impression that since the sms is from capital first the representative (Mr. Sieran) from capital first will call me for signing the ecs mandate form. But when i did not receive any calls until a week before 31-dec-2015, i myself visited the store to check why was i getting those messages even though i had not signed the ecs mandate form, to which i got the reply from mr. Sieran that its just a process from capital first wherein the loan details were filled online and that mr. Sieran himself will be visiting me with a new ecs mandate form before dec-31-2015 which he did not. So just out of curiosity and suspicion about my signature being forged, i decided to check after jan-05-2016. So after jan-05-2016, i got a call from directly from capital first's customer care department, that i had missed an emi, to which i was totally surprised. So i asked a simple question that did they received any ecs mandate form with my signature on it and i was told that the ecs mandate form was rejected by bank due to signature mismatch. Now as i mentioned earlier that i had not signed myself any ecs document to be submitted to bank except the one which is still with me at home on which i signed but does not match my signature on cancelled check, so i requested to have capital first's management call me in order to discuss the matter. After that i also visited the reliance store in viviana mall, this time with one of my friends who has knowledge in banking sector and in his presence when i questioned mr. Sieran kumar on how was it possible that my emi got started and also got missed without my signature on ecs mandate form to which he said it was some online procedure which he was not sure of either. So he connected to some lady from capital first (I cant remember the name, probably it was someone named shraddha or sheetal) and she said to me that she will look into the matter and get back to me with hard copy of the ecs mandate form and again i never got a call from her on that matter. After that i only received a call from your collection department about asking me on when i would be paying the emi and i had to explain the whole story to them again, to which your collection departments mr. Satish, says that i was trying to enjoy the product free of cost. He also said that it would not be good for my record in cibil, what the hell? I have three loans going on for more than past 2 years and i haven't missed any payment dates.

I had received the first message from captial first regarding the emi starting on jan-01-2016 and then a reminder on jan-02-2016 that the emi will be deducted on jan-05-2016. So i believe that, if i was getting those reminder messages then the ecs mandate form would have been sent by capital first to hdfc bank much before jan-01-2016 and capital first would have received the rejected response from hdfc before jan-05-2016 may be even before jan[protected]On which i was sent a reminder from capital first). If capital first representatives say that i had signed the ecs mandate form then my question is why was i not intimidated about the rejection (With reason) of ecs mandate form, from hdfc bank? Let me tell you why, it's because i did not sign the ecs mandate form. If the process had been legal capital first would have provide me a hard copy of the loan document with the ecs approved.
Let me also tell you that, in an argument on this case with mr. Sieran, when i told him that why did he not call me or visit me for having the ecs mandate form signed as i had requested him to meet me either on weekend or in morning before 10:3 am in weekdays as i also have to go tot office, he said does not have time to come early in the morning.
Just because the deadline of your sales target should not get missed, a wrong and illegal approach has been taken and this may have not only damaged my credit history in the records of cibil, but has also put me in a stressful situation as i am afraid hat my documents that i provided as a proof may have been or could be used illegally.

I demand that capital first immediately return my documents along with a letter to cibil providing an explanation about the same.

Capital first management team, request you to look into the matter asap.
