[Resolved]  Axis Bank Limited — Complaint regarding demand of payment for the pre-closure of my loan account

I, Venugopal Cheela taken loan from Axis bank vide Loan account no.PP[protected]. I have made my payments in time upto 2008 until I felt very sick because of multiple complications combined with heart attack and diabetic related problems. Being doctors advised me to take complete bed rest and there is no other person to look after my businesses in my absence, which was also running under losses, I forced to close all my business activities to save my life and to avoid further losses, problems, tensions & complications.

As I am a principle person with ethics, I, by myself have approached all the Banks & individuals and explained them about my health & business position by showing the documents and came to an understanding with them for pre-closure of my loans under one time settlement [OTS] against the agreed payment after reaching an understanding on the settlement amount against proper receipts which includes closing of my personal loan account with your bank which I availed wide loan account no. PP[protected]. I have settled the account as per the understanding reached figure [under OTS] of Rs.7,80,000 which includes Cash, Post dated Cheques, DDs and Credit Card through your Authorized DSA M/s. Tejaswinini Financial Services, Hyderabad in November 2008 itself.

I have demanded for loan closure / no due certificate at the time of issuing cheques on[protected] but their executives convinced me by saying that you will get no due certificate automatically after realization of above mentioned final cheque dt.[protected].

After my credit card payment I have called and reminded bank people number of times for the issuance of no due certificate but unfortunately I have not received the same and I was under the opinion anyway the loan account is closed and I have the receipts for records and stopped following up after sometime.

After closing the account in 2008, recently I have received a letter dt.[protected], stating that I have due or Rs.3,41,480. I was shocked and approached the bank immediately with the supporting documents. Again surprisingly they are also said the same. After verifying the receipts and tallied with their account, I came to know that my settlement have been cancelled due to the less payment of Rs.2 or 3000 and payment made by me is one month late as the final cheque was bounced and you have paid the same in next month. After taking required money for one time settlement they have made me fool by converting the whole amount into EMI's and calculated interest from there on to till date. So the due will become 3Lac plus. What a bank, what a bank officials. They have never intimated me the same until I approach the bank. By their own decided to do cancel the preclosure letter and taken as EMIS. I have arranged this fund from various sources to clear at once and want to be peaceful. But the bank has cheated me after taking the required amount and created me humiliation to me.

As a responsible citizen, as a good client, because of my health, business conditions, family position etc I have voluntarily come forward on my own and pre-closed the account to avoid tensions and complications but unfortunately since last several months I am facing heavy tensions because of this issue and I am in helpless condition.

Even now it is a surprise to me if really my loan account is not closed why more than 2 years bank has not approached me for EMI’s? Why your bank has collected EMI’s from one time settlement amount which I have paid? Why you have not informed me the same that we are collecting EMI’s not settlement amount if it is short? Why applying pressure on me and creating tension to me which is effecting my health? If my health is affected and in turn effects my family is your bank takes responsibility? Is it wrong that I am honestly come forward with a trust to close the account by paying the agreed amount as a settlement? See, with a good intention and to avoid EMI burden I have approached for one time settlement. This is not fair that your bank has collected the entire amount in installments, after that collecting EMI’s from that amount adding interest, charges etc.

After taking the entire settlement amount may be short fall of two or three thousands it doesn’t mean that I am defaulter. I have arranged the amount from various sources to settle the account and arranging two or more thousands is not difficult. If you have not collected entire amount from me, it's not my fault, that too myself approached to pay, if you take less amount am I responsible for that? I am not responsible for that because I have paid what your bank peopled said to me. Your people don’t collect money properly, and they will not inform to me then how would I know that still I have due of Rs.2000 or 3000. If is it so you have to see the intentions and ethics of the person. Cancelling my settlement letter and converting big amount into emi’s is nothing but cheating, creating troubles to the customers. Nobody has approached me to collect the amount since so many days by thinking customer is a fool he will go for one time settlement for one more time is very wrong and it is not advisable from reputed bank like yours. This is nothing but clear cheating and blackmailing the customers like. I don’t understand after paying full and final amount I am getting this kind of letters which affecting my health badly.

So I am writing this complaint to your goodself to know the facts and take severe action against the bank and bank officials who harassed me. Please also take action against the bank, bank officials, and the persons who are encouraging this kind of torture to the innocent people like me, without knowing the facts and background of people who lives in the society.

Sub: Complaint regarding demand of payment for the pre-closure of my loan account.

I, Venugopal Cheela taken loan from your bank vide Loan account no.PP[protected]. I have made my payments in time upto Septemer 2008, last amount paid before settlement is Rs.36,152 by cash towards EMI wide Receipt No.66151 dt.[protected] through your authorized DSA M/s. Tejaswinin Financial Services, Hyderabad as per the commitment.

In 2008, I felt very sick because of multiple complications combined with heart attack and diabetic related problems. Being doctors advised me to take complete bed rest and there is no other person to look after my businesses in my absence, which was also running under losses, I forced to close all my business activities to save my life and to avoid further losses, problems, tensions & complications.

Tejaswinini Financial Services, Hyderabad in November 2008 itself after negotiating with your bank officials as per the following details:

1. Paid by cash of Rs.36,15 vide Receipt No.65182 dt.[protected]

2. Paid by Cash for Rs.36,152 vide Receipt No.66151 Dt.[protected]

2. Paid by Cheque No.015276, dt.[protected] for Rs. 36,152 drawn on Bank of India.

3. Paid by Cheque No.015272, dt.[protected] for Rs. 36,152 drawn on Bank of India.

4. Paid by Cheque No.015273* dt.[protected] for Rs.1,00,000 drawn on Bank of India [*The Cheque No.015273 for Rs.1,00,000 was dishonoured and we have paid the cash for Rs. 36,152 on 30th December 2008 vide Receipt no. 36925 dt.3-12-08 and for Rs. 63,848 on[protected] vide receipt no.37457 dt.[protected]]

5. Paid by Cheque No.*015274 dt.[protected] for Rs.3,03,848 drawn on Bank of India. [*This cheque was also dishonoured and I have paid by Credit Card for Rs.3,03,848]

6. Paid by Cheque No.*015275 dt.[protected] for Rs.3,03,848 drawn on Bank of India. [[*This cheque was also dishonoured and I have paid by Credit Card for Rs.3,00,000]

We have demanded for loan closure / no due certificate at the time of issuing cheques on[protected] but your executives convinced me by saying that you will get no due certificate automatically after realization of above mentioned final cheque dt.[protected].

After my credit card payment I have called and reminded to your bank people number of times for the issuance of no due certificate but unfortunately I have not received the same and I was under the opinion anyway the loan account is closed and I have the receipts for records and stopped following up after sometime.

After closing the account in 2008, there is no communication [or] call [or] any correspondence from your bank till your letter dated 24th March 2012 for the payment of Rs.3,41,480 for the account which is closed and immediately I have called your Secunderabad branch by phone number[protected]. Even your bank people have said the same that you have overdue amount of Rs.3,41,480 if you have any queries you have to come to Secunderabad Branch with your records. So as per the conversation, I have sent my cousin Mr. Praveen to the branch to verify and get the closing certificate. But surprisingly, your system has showing the overdue of Rs.3,41,480. Your executive verified my documents and said “Sir, you have paid the last agreed instalment amount in the month of May2009 instead of Feb’2009 and that too you have paid short by Rs.3,848 that is why the settlement stands null and void. You have to pay Rs.3,41,480 compulsorily [or] you have to go for one time settlement again with my higher officials.”

In the above said letter, you have mentioned that you have made numerous attempts in the past to contact me with a view to clear my outstanding, but you have been unsuccessful. Please understand after my one time settlement even when my cheques were bounced, we have approached by ourselves and paid by cash and credit cards. Not even single call, mail, and letter have not been received as mentioned in above Para from your bank [or] your bank officials until this letter dated 24th March 2012. After this letter only, I was very shocked when I receive this letter stating that my account was not settled.

In this letter you have also mentioned that, you have received information that “I am applying for fresh loan from other sources”. I don’t accept this and I don’t know how do you know that I am applying for fresh loan. This is ridiculous that I am going for any personal loan. How dare your people say that I am applying for a fresh loan without any proper knowledge and records. For your information, nobody will approach for any kind of loan after this bloody drama created by banks like yours. You have to take these words back, or else I will file a defamation case against your bank and bank people.

Even I have verified with CIBIL to know the status, in that also your bank has reported my settlement is not happened and informed them that I have defaulted, although I have settled my account well before 2009.

All these days I was feeling very tense, because of this I have not made any written complaint to your bank, to your ombudsman [or] to RBI ombudsman with a hope that the issue will be settled and I will be free of the problem.

Generally, any individual will tear off/destroy the any receipts after may be year and so. But fortunately I have kept these receipts even after 3 years and some safety I have atleast to quote. Please understand what would have been my position if I have not maintained the records of receipts and what I feel that “your bank has taken advantage of my innocence and goodness” and in this situation to safeguard myself, I am forced to make this written complaint to your bank and all the higher authorities of your bank, and to your banks ombudsman and ombudsman of RBI.

I have taken loans from 20 to 25 various banks and cleared the dues with one time settlement although I was admitted into hospital with a principal and good intention. But your bank and Barclays Bank only have created this kind of problem and trauma. Please refer my loan account no.[protected] with Barclays Bank for which I have given a comlaont. [I am enclosing all the records for your information]. They have given me apology letter and also ready to give compensation but I have refused.


Atleast now, your bank and bank officials have to seriously look into this complaint and have to issue the no due certificate for the personal loan account no. PP[protected] immediately and should relieve me from this issue.

My demands: I need closing letter [ no due certificate] alongwith apology letter and removal of my record from CIBIL.

Even after this, if justice is not done, I have decided to go to any extend including including filing criminal & defamation case in India and other countries, approaching press & electronic media, human rights commission, Govt of India for my constitutional rights and justice.
