[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. Thanks a lot for your advice. I am in touch with one broker. I want to know one thing should I trust the broker regarding the authenticity of the papers since I would be the lay person in this field?? Could you please be kind enough to answer my following queries:

1. Broker told me that now BPTP is charging property transfer charge which is approx. 50, 000/-. Is it correct? If yes is it only the buyer who should pay these charges?

2. He further told me that there is a premium of 1.5 to 2 lakh in A block. Is it correct?

3. I have heard that at the time of original booking the 1st buyer got some dealer discount? but now at the time of selling the flat he is not sharing that discount. He is giving us the flat at the full cost. Is it correct?

1. I have been following your commenets/advices regularly and i found those never disheartening for the Elite floor owners (like me), inspite of lot of things happening around. I did like to convey my sincere thanx for keeping people like me intact with the project which infact i had plan to quit from.
2. The new demand by BPTP includes 10.3% service tax excluding 75% abatement. Is it justified?
3. I also did like to know the fate of M block and the expected appreciation amount presently.
4. How long do you advice to hold on?

Having compare the lay out plan which was shown at the time of application with that I got with flat buyer agreement size of each segment whether it is bed room, kitchen, toilet or balcony is less. It is hard to understand how the tentative are is still 876 sq. feet as mentioned in the flat buyer agreement after reducing the area of each segment. It clearly means that size of rooms etc. shown at the time of application was not correct and BPTP has given misleading information at the time of booking. The difference is clearly evident from the comparison as below:

Hi Amita,

All developers charge the transfer fee nothing new to it, however for exact amount you should check with BPTP directly and who should bear the transfer fee is matter of negotiation between the buyer and seller.

A block is getting maximum premium again matter of negotiation because the units are visible there and it is on the tigaon road where the completed projects like granduera, princess park, puri's pranayam lies and I have seen most of the broker's office is on that road only.
At the time of booking the markets were depressed and most dealers offered 5 to 6% discount - check for the total payment made.
Buying of a resale property is 100% negotiation - only points to remember
a) The property has only one owner and you can meet him/her in person.
b) There is no dues whatsoever on the property, this can be checked from the builder
c) The seller is ready to accept full payment except so portion of premium through cheque,
d) The commission with the broker is decided

M block seems like a good bet, actually the entire township should only bloom in two years or so, as far as service tax is concerned if it is on the 25% of the total cost of the property then its okay - it will go to government and builder is just a collection agency much like the service tax on your phone bill

I do not see much difference except for the length of balcony - I have seen different 180sq yd floors they seemed good to me - ofcourse because of so many doors in the living space it would look smaller from inside, however I am satisfied with construction. with one caveat I do not own any of 180sq yd floors - I have only bought 300sq yd floors.

I am working abroad & not even chance to visit india soon.
I made a call to BPTP regarding original allotment paper but each time i call them i get diffent time frame of allotment.
Can any body tell me how long do i expect to wait for the allotment paper?

HI Ajeet,

How many installments have been demanded by BPTP in regards to your floor, if it is more than 3 then it means the construction on your unit has already been started.

BPTP is doing things block by block which I believe is a good thing. You must have got a mail from BPTP which is sufficient enough till the builder buyer agreement is not done. Once the builder buyer agreement is done for your unit all suspense should end.

However keep in mind that all the builders always have the right to change the unit and there is nothing much that can be done by the customer except representation. So, lets hold with what we got now till the day real estate regulation bill is passed.

Atually i bought it on resale in 2009 october. As he had paid two installment.
i got the 3rd payment reciept & change on my name.
But after paying 3rd installment i was suppose to get allotment paer still waiting for..

Allotment was done long back and there were some applications which were not alloted any unit - BPTP offered refund to those were not alloted.

As far as I know BPTP does not have any clear timeline for the second round of allotments for Park Elite Floors.

I would suggest to get in touch with BPTP for a clearer picture, if they do not have any plans for second series of allotments for park elite floors I would advice getting back the refund they offered 9% interest on the amount.

Here is a piece of advice Only buy what is visible in resale, buying a booking which does even been alloted an unit lands you in a difficult situation.

Hi All,

There is a sudden spike in "NO EMI TILL POSSESSION" offerings by builders mostly in Greater Noida region. I get bit cautious with schemes which seems too much in favor of customer.

In No EMI Till Possession - actually you need to get a loan sanctioned from the bank and that loan is disbursed to the builder - something very important to note here - You are taking the loan - not the builder - The EMI or Pre EMI (the interest) would be deducted from your account - Builders give you post dated cheques for that interest amount.

So, Since the liability is entirely yours about the loan - consider the situation if builder delays the project or does not delivers at all - it would be yours liability to pay the entire loan on yourself and you are getting nothing.

So, if you are going for this kind of offers "No EMI till possession " - Go only for Construction Linked plan - (Builders will press you hard for down payment plan) - The outcome would be you end up loosing the discount of down payment plan - but have very less money at stake.

Once again Think Twice before going for this kind of plan.

Hi Everybody,

I am a real estate consultant and a Civil Engineer by Profession. I have sold this project to few of my customers. One of my Customer brought Flat Buyer Agreement to go through it and comment on it's viability. I have been in this profession of Real Estate Consultancy since 2005.

I had sold only Park Elite Floors of BPTP so far. I did it as the project was competitive and lucrative and had features which suited End User's. I had never believed that forums shall be created with half knowledge as anxiety only disturbs the mindsets of everyone who reads or propagate such forums.

After reading the contents, conditions laid out by BPTP, I personally feel that Company has fabricated this agreement keeping in view that only stupid, hand to mouth or individuals with no base of property in & around Delhi NCR will sign the unilateral & one sided agreement. This agreement speaks of all the rights of Developers Sales & Marketing agency "M/s BPTP Limited" acting on behalf of M/s Countrywide Promoters Pvt. Ltd and its allied groups and associates.

I felt elated after hearing speach of Mr. Kabul Chawla the day he thanked all associates who had worked on this project to conduct bookings beyond expectations of Developer. After reading this agreement I personally see him as an wicked man with only single objective of making fast bucks, interested in steep growing financial graphs, and looking forward to cancellations from applicants/ customers end as he is unable to accommodate all applicants who had paid him 3-4 installments.

Stupid & derogatory conditions laid out by M/s BPTP Limited are :

1. Last para on page 5 of Agreement ?
2. Annexure "A" on page 28 is missing ?
3. In case of increased super built up area revised arte of Rs 2425/- per sft. will be
applicable ?
4. PLC rates were never declared at the time of registration. Additional PLC of 10%
of BSP if floors are facing sector roads or roads over 18 mts. in width is on
higher side !
5. Condition 1.7 on page 8 of agreement says that timely payment rebate of 5% can
be withdrawn by the company at any point of time without assigning any reason
whatsoever speaks of greed & unethical & unprofessional financial conditions ?
6. Condition 1.15 on page 9 of agreement indicates helplessness & frustration of
Developer created due to excessive bookings, developer is looking forward to
automatic cancellations by educated clients.

I personally feel that all educated applicants/ customers shall come forward, join hands and shall protest & if required shall take legal action against the developer in case he/ they are unable to convince all of you the reasons for laying such arbitrary, unethical & unprofessional conditions in the agreement. Promises are meant to be kept they shall not be construed or twisted in one's favour ?

I am a NRI and have bought flats in Park Granduera and thereafter I invested in Park Elite Floor through resale.

I was feeling cheated when Park Granduera was getting delayed but after the possession of Park Granduera my faith in BPTP has been restored.

I have other investments in other parts of country and the builder buyer agreements are more or less same favoring the builder only and this is nothing new in case of bptp as well.

I had seen media reports where Indian government is going for some kind of real estate bill and icra is coming up with ratings of the projects. I feel that even though there are certain uncertainties regarding the facilities in Greater Faridabad area but that should get fixed in 2 years time.

Mr Sharma you have used very strong words like "Stupid, Hand to Mouth and individual with no base in property" please abstain from using such kind of words as they hurt the sentiments of the investors and endusers. while it may be true that most of the buyers of park elite floors may not have previous exposure to real estate dealings in delhi but if they can pay the installments in time they are much above the "hand to mouth" - It seems Mr Sharma you are too rich and got into real estate business by fluke as you have said that you are in the business since 2005 only and you have done only one project till date and that too of bptp park elite floors.

To the rest of investors or endusers who have some interest in naharpar area I would advice to stay invested as here in US there is growing interest in investing in Indian real estate.

As I am planning for buy a 180sq yd Elite Floor. Could I have guidance regarding which block I should go for? Yesterday I visited the site and came to know through dealer that now premium has gone up and its really tough to get flat now. If we get something we will get it at very high premium.

Which block one should go for? Any comments for any particular block. Is P block would be a good choice. Is there any chances of delayed development or any draw back due to a seperate unit.

A few days back I called up BPTP office (marketing department) and enquired about HUDA approval for these blocks . She informed me that on A block is HUDA approved. Is is correct?

Could anybody give me contact of some good dealers.

BPTP has obtained most of the approvals (without which they cannot go for kind of construction). A Block is getting maximum premium because of connectivity - read my previous reply to your query. P block has its own advantages like being near the commercial developments however it would be couple of miles from the BPTP bridge.

Here is my advice for you and all who are looking for a property- pick up a notepad and write down the following
1- Your total liquid savings which you can spare "easily" for a property.
2- your job - do you plan to change it in coming few years ?
3- Family expansion
4- preparation for a situation if bank funding is not available
5- your current and realistic future earnings
6- your current and future EMIs

Do a reality check about yourself and your needs - you should get the answer.

Today Haryana CM approved the Faridabad Metro Line upto YMCA. Construction will start from October this year and 13.875-KM stretch will be completed by March 2013. It is certainly a very good news for Naharpar projects.

Hi All,

Today I went to Greater Faridabad, saw work in progress at a continued pace and the prices are rising too, seems that now people are realising the true potential of that area.

The badarpur fly over seems to be complete and one of the dealer said every week there is a rise of around 50000 in premium in 180 sq yd floor and this should continue till Diwali.

The construction seemed to be good except that I saw Chinese make of windows frames being used I have clicked a few pictures which I would post on google earth.

Overall I feel that I would be getting around 40 lakh premium by the time bptp offers possession for 300 sq yd elite floor.
