I had booked a flat in PARK ELITE PREMIUM .
I have booked through a brokrage firm having various offices in Delhi.At the time of booking, these people had given me a debit note on their letterhead for 5.5% of b.s.p. as a discount, which states that the commission will be given to me on receipt from the builder (BPTP).They also told me verbally that it will be given at the time of payment of 2nd instalment.
Now even 4 months after timely payment of 3 instalments, they are denying the payment of commission and saying that they had not recd.it from BPTP, but BPTP accounts people are saying that they had made on account payment to the agent. Also they are saying that the commission of 5.5% can not be given and now 4%comm. will be given to me as BPTP had redused their slab.
Can anyone advise me how to proceed to claim the commission. Should I go to consumer court or any other legal authority. Can I file a complaint against them with Delhi Police-economic offence wing.
Any suggestion or legal advise will be highly useful for me and cases similar to this.

I am not a legal expert however the commonsense says that if anything is there in writing that can be contested in the court of law.
My personal experience says that never count on the words of anyone and the dealer discounts etc are between the dealer and the buyer the best option had always been to get that money adjusted in the bsp of the property itself. However since that time has passed and dealers have got their commission the only way to get the money is from the dealer itself. Pursue him and take whatever is he is willing to pay - as going for any other channel would be time consuming and costly - 1 or 2% hardly makes any difference when ball is on the other party's court.
I have been to the construction site of Elite Floors - It was in the evening so could not shoot video of the construction however to me it looks fine and according to the map.
I would still request if any one can click the pictures and shoot the video of the floors and internal construction and upload it to YouTube then it would be a real help to those who have interest in Elite Floors Project.

Once again the refund given by BPTP puts them in good standing. now I feel no one would have any problems with them :)

can any body confirm if this project is approved by HUDA/Town Planner. as on date i.e. till 15/04/2010 or noe . Has BPTP started any construction work or not.

I have been allotted a floor in Z block.any body can tell me, what is scope in Z block and when ever they are going to start any construction.but BPTP people are cheater bcoze they must have booked only as per original nos and further action after proper notice to the people.

LIC doesn't release the loan fund because BPTP didn't full fill their paper work or formalities for PARK ELITE FLOOR. ...then where we go???
even BPTP staff does not know, how much more time will it take to complete formalities for loan sanction

Have you ever thought why the prices in Greater Faridabad is much lower than the other areas ? This space is just starting to develop - There is no inhabitants there, non of the projects are delivered by any of the developers.
Those following my posts know that real appreciation will come only around 2013-14 so still 3 odd years to go before we can see the real colors of that area.
In 3-4 years many of the projects would be delivered- Infra like roads, electricity, water sewrage would be in place properly, badarpur flyover would be complete, the highway along side the canal would be done, metro would be there or would be almost complete. but above all - THE AERA WOULD BE INHABITED and that would be increasing the prices.
So those who don't have the ability or willingness to fund from their own pockets should exit - they are getting much more than normal bank interest and should not complain.

what about the loan??? I don't think so, everybody has the ability to fund from their own pockets ... In this case ... everybody should exist?????????????
ha.ha.ha.ha. everyone should exit. only rohit should have all the floors. no that is not funny? what will be funny is that rohit invests more on the floors in bptp park elite which he buys from harassed customers who are exiting. then before the D-day "2013" rohit's car falls into the nehar of faridabad and he dies with dreams of good return on his investment. so in his next life god makes him a snake who safeguards the lost treasure of a king...ha.ha.ha.ha.ha..

I would like to say that, It shouldn't be a way to use this portal. Here, we all are due to our wish, no one forcibly called us to join and post commenst here. I saw urs anme from last few days only, and I am here from almost last 6 to 8 months.
Even I am not satisfied with the way, Rohit replied, that who can not pay from their pocket, should exit. I am sure that more than 90% of buyer, who are real end users, can not pay from their pocket. So ideally being a vinatge member, Rohit should come up with some way, that what should be our next step, in case when Bank won't release the money.
