[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. I would suggest to wait till the actual allotment happens, since you have waited for 30 months there is no point loosing your cool at this point.

Anyways in worst case if the allotment does not happen you can always get your money back with 9% interest.

Greater Fradiabad has come a long way in last 3 years and new advancements are happening everyday.

The best part is that the land is limited there unlike G Noida so the prices are bound to go northwards.

Lets wait for few more month, I am satisfied with the progress and it is largely in line with my expectation.

Dear All,

I have booked in Park Floors - Sec 76 and paid 5 lakhs. I gave my bank approval letter in July 2010, but BPTP sent a communication that my booking is cancelled before that.

They are now not re-allocating the unit and are asking for current market price if I want to have re-allocation. I have full communication from my side in emails, but they are not honoring the same.

Is anyone having the same situation?

I have gone through all complaints. thanks to all because i was plannning to book property in BPTP elite.
Previously i had booked flat in india bulls, gurgaon & they cheated same way, so i cancelled booking after 6-7 months. I think almost all builders have same policies of cheating & the the rate hike is also artificial. They have tie ups with propery dealer's. they show artificial bookings on the name of property dealer's & after one year they sell property for double price & give share to propery dealers on % & get additional profit. i think we should take some hard steps against these private builder's.

I took whole amount from indiabulls on the basis yhat i had not signed any legal doument/agreement & i demand my amount with 18% interest as i gave them to use my money without any agreement. But i got only my booking amount only. I went to mediation center but before standing case i did compramise. i was very much doubtfull about mediation center people also.anyways i just wanted to share my exp.

The highhandedness and fraud of BPTPisnot only limited to Park Elite floors but in other projects of BPTP as well.For instance in Park-81, Faridabad projected as a premioum project, changes in plans are made unilaterly to teh detriment of allottees interests . Enquiries do not get timely and correct responses. Plan of 300 sq yds. floors have been changed reducing the width of balconies to drastically leaving them without any utility . Park-81 allottees also need to join hands to take up teh issue and if need be seek legal redressal.

yes BPTP is no. 1 fraud company my relative also booked a park elite floor and gave 2 installment but did not get any allotment we should go to media and tell the government to do steps against BPTP a fraud company my email id is [protected]@rediffmail.com
May be preet81 you are right,
Earlier it was told that after the booking amount paid we can get possion in 2 and half years, then later on it was intimated that after the allotment issued 2 and half years time will be counted for possion .
But now they are intimating after the agreement made between the buyer and company time of possion will be counted from the date of agreement done, and agreement was done in last sep 2010 as I have made payment of 16 lacs till date .
According to them now from the 2010 sep they will count 2 and half years for the possion of the flats .
More over if we see earlier time when booking started it was said that Elite floors will cost us 15 lacs only now they extended the amount to 18.5 lacs which is more than promised .
Now I am sure all these builders are some way or other are fraud and think of money only promises does not stand for any of them
I have same case wherein I have paid appx 5.0 Lac Rs to BPTP and also submitted the loan sanction letter from Bank but Part Elite floor was not alloted to me. I have been in regular touch with BPTP officials thru phone or mails and they were keep on saying that 2nd phase allotment is confirmed by not giving the target of allotment. Today they have confirmed that 2nd phase allotment will be done before June '2011. In the same time dealers are approching that BPTP again coming with simillar floors but rates are quite high.
My question is that will the original rates be applicable for the customers who are waiting for the 2nd phase allotment from last 2 years or BPTP is going to cheat them by offering the revised rates which are almost 50% higher ??
Will somebody inform me about BPTPs plan for the customers who are waiting for last 2 years for allotment since there is no clarity on this issue from BPTP

i had booked a flat in park elite premium. Till date BPTP had not recd. approval from town planning department. I had got my loan sanctioned 3 times from LIC Housing Fin. After 3 months loan sanctioned date expires and I would have to pay processing fees to LIC HFL again and again.

Does anybody have any update regarding PARK ELITE PREMIUM flats ??????????
Please tell the status of E Block, E17-29A whether construction started or not, It is 250 sq yrd luxury floor.

I am Nitin Agrawal. Booked BPTP park premium elte @ July 2009. Deposited 4 lacs (in 2 part).
After that there is no any news from BPTP.
Now even they are refusing to allot the flat and asking dozens of documents for Refund.

This is in regards to our unit in Park floors, Sec 76 Faridabad.
We are extremely frustrated with our experience with BPTP. I would like you to go through the sequence of events experienced by us in our dealing with BPTP.

We purchased a floor in BPTP park floors in Aug 2008. We recieved a confirmation letter
regarding the same in Oct 2008. After which, we did not recieve any documentation or intimation untill November 2010. We went back looking for the BPTP office in CP and were told that the office had moved in 2009. We made numerous phone calls and finally got namrata on phone. We then made a visit to your new BPTP office in July 2010 and met Audrey Verma (Manager - Customer service) and recieved details on our booking. Audrey reconfirmed our address. We also personally collected the buyer seller agreement as we had not even recieved an agreement untill then. We were given the total amout that was due and were asked to get a bank loan. We visited the site in Aug 2010 however the connectivity was extremely poor. We also contacted our bank (IDBI and HDFC) however were told that they were not giving a loan for the said project. We're sorry to say that besides all the other lapses at the BPTP end...even their customer services department is least forthcoming, specially Rajan Kapoor and Audrey. With great difficulty we were able to reach their new office in CP, however Audrey did not offer us any help with the bank loan etc as she now claims was possible to get at that stage. We have made investments with Ireo and Emaar MGF and there is a significant difference and great degree of professionalism in the other real estate companies versus BPTP.
We visited the BPTP office again after getting a letter for the final payment in May 2011. We met Mr rajan kapoor (AGM - Customer service). We really did not expect a person at his stature to be dealing in such a manner. He was no better than a front line executive. He kept repeating his statement on the BPTP policy like a parrot. Despite our repeated requests he did not even take the trouble to go through our prior emails etc. I would like to quote him here " it is not possible and its not in my hands...even if I read your mails and your correspondence, it will not make any difference as you are one of the thousand customers who come everyday". We had gone with the complete payment of 15 lakhs that day and he refused to take the payment and insisted on either paying the interest ( which was a ridiculous amount of 4 lakhs on that day) or he would block the apartment.
We visited the site again today and here is the status. The approach road to sec 76 is still not constructed and there is no work in progress on that road as well. Even if we get the possession as claimed by BPTP in the next 6 months, it will still not be of any use untill the 60 mtr approach is ready. It will be more like a dead investment as this property will only start attracting a premium after its linked appropriately. It was impossible for us to go right upto our site today as there was no proper road. I am sure you understand where we are coming from as there is no point of possession as people will only reside there once the road is completed. Since BPTP has constructed the apartments as per the stated timeline, we will pay the entire amount requested (although the construction only holds good once the road is ready), however the interest is ridiculous as there have been major lapses at the BPTP end as far as this project goes. ELITE floors has already attracted a premium since it has a suitable entry however we are the victims already...and we are being punished further.

In short our points of contention are the following:
1. How can they charge the interst when they only recieved the approval for this project in March 2011.
2. They cannot even demand the construction linked payment untill they deliver the project as promised ie. on the 60mtr approach road as they are completely taking their customers for a big ride by delivering a project without any proper link to the project site.

Please suggest how we can all campaign against this completely unethical behavior of BPTP's management.

SAME HERE. THIS IS DINESH KUMAR. I HAVE APPLIED FOR GROUND FLOOR BUT ALLOTED 7TH FLOOR AND TILL DATE NO CLUIE OF THE LOAN SANCTION. THERE IS HUGE PENDING AMOUNT TO BE PAID, OTHERWISE THEY WILL CANCLE THE ALLOTMENT. WE CAN NOT LEAVE THEM WITHOUT ANY ACTION AGAINST THEM. WE NEED TO UNITE AND IF SOMETHING IS NOT DONE SOON, WE MUST FILE CASE IN CONSUMER COURT. THIS WHO HAVE NOT SENT THE AGREEMENT IT IS BETTER YOU HOLD THAT, AS THE LEGAL TERMS MENTIONED ARE NOT IN YOUR FAVOUR ANYWAYS.

I have been allotted Park Elite floor in Z block, can anybody tell about construction of the same, since BPTP is neither giving any confirmation about consruction in Z block, not is is telling about future of Z block, they are cheating to customer
Hi Rohit and all other Elite floor owners,

Here, I would like to bring some thing new to you all, at least to most of you it will be new..yesterday, I received a demand and that said that my unit was initially measured 1203 SQFt but now they said that it is 1370 SQFT and so I need to pay them almost 4 lkas extra now..
Due to the great image of this builder, I m not sure that I am the only one who is in this situation or some one else also hav received same situation..
And I am amazed that where is Rohit, as he used to be up to date for all such event and situtaions..
If some one also have received the same letter and situation then please guide me for the required action at this time.

ROHIT: BRO... Tell me what is this... and WHAT SUD WE DO NOW..???

I received same type letter yesterday, now they are measuring and found the super built up area was increased from 876 Sq. Meter to 1045 Sq. meter.
This is only fraud by this builder.
Suggest us what we should do?
