Hi all,

This info is not a complaint but rather a concern, I am a software engineer currently in the wedge of shifting my house but thinking whether I should accept my landlord (10% increases in the rent as per the agreement) and continue or should I find another place.

I would like to bring the following info into the notice
Advance: here in Bangalore is 10 months rent (I cant accept the logic behind the deposit, i feel this should have been 2 months rent + roughly estimated cost of the accessories that are present in the premises eg: Fans, Geysers, Lights, Washbasin etc 20K/25K should be more than enough)

Renewal: Every year 10 percent which is quiet illogical (Roughly in Bangalore you cannot find any average house below 8K/month, that means we need to pay extra 10000 Rs for the coming year not even i do think we will get hike of 10K hereafter)

Maintenance: When you leave the house you are supposed to pay another charge for maintenance (claim for painting) most of the time this will be hitting around 10K. I don’t think they are spending not even 2 K while doing painting. I do remember my owner had been delaying to give the house key bcoz it is not painted, on a fine morning he called me & told they had done painting, the same house which I didn’t find any work done the previous day. So the entire painting is done on the night itself, anyway it was clean when he handed me the key

I don’t feel the owner’s intension behind this is to give the house very clean (just to loot the 10K when u leaves). Are we supposed to give this amount isn’t it like they earned & they had to spend from what they earned. Will it end up taxi drivers asking for an extra fee for dusting the car once you reach the destination as he could have washed the car when he started in morning?

If i want to find another house i need to chase an agent (he may charge another 8K/one month advance) & for shipment of household items i need to spend another 3-5K. Owner will take 10K so my loss is going to be around 20K which i am thinking can be substituted with the 10% increase in rent, (I will save at least 10+K in this case)

How long we can continue promoting this kind of activities? Can the govt bring in some laws (like rent per/sqft on specific areas should be defined)? Does any of the newspaper focus on these kind of activities

Hope the above is not only my concern, but for most of the people around here in bangalore

i am vijaykumar i was staying in yelahanka new town someswara nagar.in 2012 sep we moved to this present house. at tat time the the problem of the house is for the ward robe they dint fix the doors, and the electricity problem was there, initially owner was promised to us they will fix up the ward robe doors because i had small kid while playing the nails which has left for door fitting it was very dangerous.after we moved to home they will repair every thing include electricity.but they dint done .whenever we ask they were quarrel with us .after that in sep 2013 by paying extra rent we shifted to ground floor to avoid owners nuisance .after 4 months again we face owners nuisance i, e misbehaving like that when we asked to owners now they r saying vacate the house .in sep 2013 the agreement was orally renewed as of now we paid extra rent also but the owners dint renewed written. for these wat was the legal actions against owner

Electricity — exorbitant electricity charged by Landlord

dear Sir,
My landlord is charging is charging exorbitant electricity rate. He is forcefully asking us to pay the electricity charge at Rs 5 per unit when the govt rate is just near to Rs 2.40 per unit.

House on Rent — Charging Extra Money For Water(though not mentioned in the Agreement)

Our Landlord didn't mentioned it in the Agreement that He will charge additional money for Water, But now he is asking for additional money otherwise we should find some other place. He has also said that during the notice period of 30 days he will not give us water if we don't give money for water, though anything has not been mentioned for this in the agreement
I agree with you. This is the worst city from this point of view. In cities like Delhi also it not a problem. But, in Bangalore these people just loot the tenants.

Further, I feel, here the Govt is fully inefficient and inactive. The reason being, the people who are politicians or bureaucrats are themselves landlords and are practising the same ridiculous things with the tenants. So, they will never change the law.

Further, the landlords, besides the painting charges deduct monies in one head or the other from the deposit one wd have paid. This the most greedy city I have came across so far.

The Karnataka Rent control Act, itself is very unfavourable to the tenants.

Real Estate Agents — Rented a Flat but Agent Plays Foul

Hello,

I have yesterday rented a flat through a Broker, who wanted 1 and half month Brokerage which was 9 thousand, Now She asked me to pay Rs10, 000 for the same, What should be done in this case.
My landlady asked me to hand over the keys one month before the notice expired. As I found another house on Aug 1, i did so and she said she would return the deposit 50k (not adjusted to Jul and Aug 09 rent) in one week. A day after I left, she called up abusing me and saying that the house is left as a sty even when we took extra care to clean up the house before leaving. She seems to have no intention of refunding the deposit and has been threatening me since over phone. I will go to collect it next Sat. Please advise me if she threatens not to return the deposit and shows a bloated bill by her contractor.

I am a owner of house with two portions given for rent, but that is no way going to imply that my views will be biased, as i myself was a tenant for few years before constructing my own house. In my views I think the rules should always benefit the owners of the house. With Bangalore growing at such a pace, with many software companies providing employment, land rates shooting up, more influx of people into bangalore. Just imagine if local people do not construct additional floors for the purpose of rent, which they are not obliged to in the first place since there are alternate ways of earning income now a days, where do all the people who are coming into Bangalore to earn their living will stay. Not all companies provide accomodation to their employees, neither government. WHERE DO U STAY THEN? ON THE ROADS, FOOTPATHS...I owner earns a sufficient amount as a rent only in the heart of the cities, otherwise the rents are quite fair in rest of Bangalore.

TENANTS COMPLAINTS:
Unnecassary clauses, too many conditions, extra charges while leaving, increase in annual rent.

OWNERS COMPLAINTS:
Not complying with clauses, not keeping the house tidy, handling of house in a poor manner, and delivering the house in a bad shape while leaving.


Every tenant should remember that owners have spent his hard earned money on the construction of the house, so he will naturally treat it like his baby. There is no COMPULSION on the tenant to take the house against his wishes. Tenant always has the option of going through the clauses in the agreement before taking the possession. SO WHERE IS THE PROBLEM?. If you do not agree to the clauses, look for somewhere else. OWNER HAS THE RIGHT TO PUT AS MANY CLAUSES AS POSSIBLE TO SAFEGUARD HIS HOUSE. AGAIN NO COMPULSION ON THE TENANT. While leaving the normal deduction towards painting and other repairs and damages and leakage of taps and electrical appliances is a common thing. TENANT CAN ALWAYS CROSS CHECK THE RATES OF PAINTING AND THE AMOUNT OF MATERIAL, SO WHERE IS THE PROBLEM OF OVER-CHARGING.

FOOD FOR THOUGHT
How many tenants really comply with the clauses. Do not they bring unknown people after taking possession stating they are his friends and they stay on for few days or months. How many tenants ensure that they let the owners know the people that are going to stay overnight even the friends. NO OWNER WOULD LIKE TO WAKE UP AND FIND SOME STRANGERS WALKING UP AND DOWN IN HIS PROPERTY. How many tenants ensure that they are not coming to the house late in the night and to inform the owner if they are coming late. Security and Safety is the big concern in the City. How many tenants make sure that they keep the house clean even maintaining the bathroom and toilets, especially the BACHELORS. Owners can always take pictures while given tenant the possession. The tenant can himself compare the AFTER AND BEFORE PICTURES. Regarding 10% increase in price, WHY NOT. If tenant does not have the capacity to pay the rent, it does not mean the owner have the keep the rates down to suit the tenant. Again, tenant can leave the house and can always find some cheaper houses at slighly less developed area.

PERSONAL VIEWS:

Again no bias. I think if the tenants comply with the clauses 99% there won't be any problems. More problems comes because of the arrogance and egos than anything else. Just Imagine, if a owner is getting rent in time, tenants are decent and cordial, comply with all the clauses. Why would the owner have a problem. CAN ANY TENANT ANSWER THIS?? Tenant think they are paying the rent, so it does not matter even if they do not comply with the clauses in the rent and they are not answerable to the owner for anything. SOLUTION TO THIS IS VERY SIMPLE. I[censored] DO NOT LIKE TO COMPLY WITH THE CLAUSES OR ANY OTHER ISSUES, PLEASE TAKE TIME, INFORM THE OWNER AND LEAVE THE HOUSE AND LOOK FOR SOMEWHERE ELSE. Tenants who are coming from other states needs to be humble and respectful to the people of the other states, because the culture vary from state to state. FOOD, WATER, SHELTER will always be a problem for the people of outside and will continue to get worse in the future because of the huge population. SO, the local people are in a way doing a lot of service by constructing an additional floors not only to earn extra income but providing shelters to others also.

BOTTOMLINE: If the tenants continue to indulge in unnecessary arguments and legal fights and harrasing the owner, no one will built or let their houses on rent. I THINK WE ARE ALREADY SEEING THIS. People can buy a site rather than constructing an additional floor or invest in varied schemes. NO MAINTAINENCE, NO UNNECESSARY NUISANCE. NO HEADACHES.
I can see only the arrogance and greed in the entire text from the so called Owner Ravi.

Every alternate line I read has the Threat -- 'tenant' can "LEAVE" the house. With out going into specifics We also need to ensure that both tenant and the owner of the house follow what is promised in the agreement and also some things which do not go in to agreement . Like in my case the owner of the house where i stay currently had promised to provide a safety door, and few other things which were never made available . I have been living in this house for last 3 years by adjustment since the locality and the people of the house are good . Though it is very clear to me now that as long as the tenant is paying the rent on schedule and not asking (not putting too much pressure to get the basics / what he was promised ) for his rights the owner would continue to ignore /escape the tenant for the other 30 days of the month (except for the day when rent is due).

If the tenant asks for his rights then the tune which ravi is singing will emerge from the owner (Leave the house if you are not happy)

I would like to get in to a forum where such incidents / cases need to be high lighted. I am feeling cheated due to my recent experiences

House renting — high maintainance

I have rented 3 BHK to a company which uses my aprtment for residence purpose for their females employees. Company has posted 7 employees in our flat which is about 1500 Sq Ft.
Now society wants to pass a bylaws stating that if anybody rents their flat to a company instead of an individual family the owner has to pay double maintainance. Already they are charging non occupancy charges from us for renting. whether a society can pass such bylaws?
Society wants to restrict the number of people in the flat e.g 5 insted of 7? I need guidance with clause to face the society.
lets not be biased about things based on personal experiences

As there are 2 faces of a coin, there are different experiences for different people,

To get rid of harasment form both sides i think following things have to happen

I think the major problem is the 10month deposit
--> The deposit calculation should be based on the "scope of damage/wear-n-tear" + 2 months rent(to cover risks of tenant running away without paying any rent). The job of a Agent should not end at cutting the deal(rent agreement), he should check the house, decide deposit, inspect the house before and after occupancy and come to a mutually agreeable deduction amount
1. Set up Avoid_owners and avoid-tenants data base
--> setting up a avoid_tenant is easy, i think its already there.
--> generally when a tenant decides to vacate the house, and requests to return deposit, the most common answer Owner gives is : let the new tenant come, we will return your deposit, now even if a tenant has a bad experience with the owner, he just keeps quite and let the other tenant occupy the house so that he gets the deposit back
In some cases Deposit only serves as a blackmail-tool for the "BAD" owner. This has to stop, lets take exception to owner's behaviour, lets be frank in telling our experiences to the new tenants, thats where a " not-to rent_from" data base or a "tenant testimonials" to tell both good and bad dealings with owners would help, How may of them would have checked/googled for owner's name and address to check if there are any such issues or bad experiences

The owner can do the same about the tenants, The Agents can play a role in this

Lastly
i would like to take exceptions to what Mr Ravi(The owner of 2 houses) has said
Mr. Ravi, Lets be clear about few things
1. About renting house : you are not doing some social service by renting your house to some body. There is no "COMPULSION" for you to rent the house, keep it in a cradle like your "baby"
2. my old landlord deducted the rent of march even when i vacated the house on March 1st, he himself had asked me to vacate the house on 22nd feb
3. You talk about local cultures and respect: In Bangalore my old landlord abused me in a regional language(not kannada) when i asked him to return my deposit. He has asked his agent to rent his apartment to only a perticular regional group( non kannada) all the houses he has rented now is for that perticular regional group.
if he had expressed his favourability to a perticular regional group then he should not have rented the house to me and then harrased me for no fault.


My experiences mentioned above does not mean that ALL LANDLORDS are bad,
in the same way not all the tenants are bad

But in the current situation "BAD" landLords have an upper had as they can demand exorbitant deposits and then start abusing and blackmailing about false damage costs when its time to refund deposit
I have been in Bangalore for the last two years and I stay with my family in an apartment on the Outer Ring Road paying a rent of almost Rs 15, 000 per month. However, whenever there is any problem and I ring up the landlord, some Reddy, he simply turns a deaf to it and asks us to vacate the flat. He flatly refuses to listen to our problems and if we insist, he starts abusing us. In fact, I, being a lady, was taken aback, when he started abusing me over the phone using all kinds of the ugliest vulgar slangs possible, just because I had asked him to provide the generator backup due to loadshedding. In fact, it's clearly mentioned in our agreement that there would be 24 hours power back-up. But the landlord all of a sudden has taken the decision to supply the back-up only from 6pm till 10am.When I asked him to reduce the rent in that case, his only solution was that if we did not comply with his decision, we would have to vacate the flat.
Now is that a solution?
Besides, I have found him to hate all the north indians and that's the reason why he tends to flare up at the slightest of the matters.He keeps saying, "Tum North Indian salon, apne aap ko bara hoshiyaar aur smart samajhtey ho!!!"
Well I am not from north but from east India and believe me, in my city, which is Calcutta, I have never heard such biased comments about any of the south indians from the tenants. There are lots of south indians in Gariahat area in Kolkata and they have been leading lavish lives and hardly encounter any problems with their tenants.
So why is it here?
I am fully agree of this. Many people are suffering. Government should take an action. Many of my friends and I also suffered a lot for this.
The house owners in Bangalore, are indeed a bunch of thugs and hoodlums who are out to con the tenants at every opportunity. They are taking full advantage of the IT and software boom, and are making hay while the sun is shining.
I am staying in an apartment in Anjanapura, off Konanakunte Cross, where the apartment owners' association religiously collect the maintenance charges every month. But they have not held a residents meeting for more than two years now. Even for getting a BSNL internet and telephone connection, they charge exhorbitant fees from the residents. As no meetings are held, there is no question about any accountability to the fees collected on one or other pretext. Besides, the office bearers are rude, high handed and boorish.
The house owner, too, has taken a stand of not providing any help. Even the rental agreement charges had to be paid entirely by me. He has also made it clear that he would not do any maintenance or other work, as, according to him, it is the responsibility of the tenant to do this work.
As one of the respondents had written, this state of affairs is probably due to the apathy of the government, who are probably land lords and owners of houses themselves, and stand to gain a lot from this present state of affairs. Besides, corruption is the hallmark of Karnataka.
The only development which one finds in Bangalore is due to the IT and BPO companies, and it is totally disgusting that the government and the other authorities do next to nothing to develop the place or the people. The infrastructure is horrible, there is much bad blood between the local population and the people from all over the country residing here due to their jobs. In fact, some political parties are encouraging regionalism, language issues and other differences to come to the fore. In a state where the majority of the people are poor and uneducated, this is a callous and cruel attitude to take.
Though Bangalore is mainly known for the IT sector and responsible for catapulting India in the world stage, another part of Bangalore is still in the middle ages, where casteism and feudalism holds sway. One way in which this is illustrated is the many brahmin-run, or wannabe vegetarian hotels in the city. Most of the non vegetarian hotels are either shabby, or cost a fortune. This illustrates the sway of casteism in Bangalore even today.
Issues like poor behavior towards tenants, corruption, and other factors will continue to plague Bangalore as long as the majority of the people in the state are poor and illiterate, with caste and money playing a major role in the lives of the people. It is upto the tenants of the city to get united and form a strong association to take on the victimizing tactics of the landlords, their associations, and a callous government.
iam a tenant at rajajinagar my owner seems to b greedy he as asking for extra 10% on what we are ussually paying ie 8500/month for accomidation of 2 bedrooms, hall, kitchen, attachtoilet, an common toilet at ground floor .as our aggrement as been over on 1st oct that is after (11months) can u pls help me out is it worth of paying the amount .3rd block rajajinagar bangalore10
Landlords in Bangalore are not a syndicate but independent and separate identities of lousy businessmen. Businessmen who look at short term gains instead of long term. The days are limited because of this behavior of theirs. In a couple of years this city will become so un-liveable because of their greed that Employer will choose to walk away from Bangalore rather than let their employees suffer this plight. These same landlords will be brought to their knees and the economy which is run by us IT workers will not be available to them. They will leave that as their inheritance to their children. That is what greed causes.
I totally agree the article written by Satheesh, there should be some method in this madness.Owners have become monoply, no one to ask them.
The rental laws have become arhaic is all I can say. My experience both as a present day tenant as well as landlord (back at my hometown) has been that everything boils down to how the person is. Is he/she an ethical person or a greedy mercenary with no scrupals. If either of the side fits into this trait it is hell for the other party. At present my landlady fits the above bill.
One more observation: Gone are the days when tenants were infact less in social stature just because they were renting out of property. Now with changing society and profession and places of opportunity and progress, the equation has not even changed it is wiped clean and a new dynamics has evolved. So for starters Landlords should treat tenants with respect and consider them as humans.
Lastly I have been thinking of forming a forum wherein people can rate and recommend their landowner and it should be such a community which should be accessed as widely and qualitatively as say, Google! When ever a person shifts to a new city or locality, she should be able to log in to this forum find the rental places with owners rating and entire Owneropedia, so tenants are not subject to abusive (mental or otherwise), greedy and unfair landowner, who are often the greatest sweet talker until one shifts to their rental place.
I think instead of Lease Agreement, Tenancy agreement should again come into force.
Since many o[censored]s here are in software industry or exposed to Information Technology, Let try to make one of the most successful forum for 'Tenant Interest Protection'
I completely agree. I myself want to complaint in the consumer court regarding this. i hope some action is taken against them.

Complaint Against Owner Who Is Not Returning The Pain 2 Months Deposit — Not Returning The Deposit

I Mr. D.Chandra Mouly Rseident of Saidabad Hyderbad -(Andhra Pradesh State ) has taken Flat for rent with share bases with Mr. P.P.Dass (Mobile No : [protected]) Age 65 Years #[protected]st Block IInd Floor Flat No : 201, Sai Prashanth Kuteer Apartments, Opp: Darjelling Tea Depot and Beside Market Yuard Ground, Chintalbasti, Khairtabad Opp: Lane of Shadaan College Hyderabad - 500004 of the Flat Owner Mr. Anand Raj (Mobile No : [protected]) and redident of same apartment in the 1st floor. We both paid the 2 month rent advance of Rs. 12000.00 (In Words Twelve Thousands Only) by[protected] each Rs. 6000.00 and the flat owner mr. anand raj has given us in his scribbling pad letter that seperate paid received amount signed by him and said when we leave the premisses he will be giving back the paid deposite amount and I Mr.D.Chandra Mouly intimated the owner and the shared patner on november 2010 last week that i am leaving the premisses by 10th of devember and i also cleared the november month payment and on that he said that he will be giving the deposite on i leave the premisises and on 10th december when i went and asked the owner that i called the trally and i am and he said you load by leaving he will pay he said and after loading when i reached his premisses he was not available in the flat and left the premisses and when i called many times he was saying many excuss and not lifting the phone and at last lifted and said he has sit my shared patner and discuss and my shared patner is saying he is not in position pay the amount and he said he will be paying only his part of shared amount and he also denied to me .

So in this case where should i go sir so please make my hard worked deposite amount Rs. 6000.00 to me as soon as possible. I request to accept this complaint and do justice to me and make my deposite amount back as soon as posiible and 2 to 3 times i went there he was not available and used many unlogical words to interrupt me and when i went called him he not even lifted the phone and under what rule that my shared patner will pay the deposite amount. I paid the 2 months deposite amount to the owner.

so please sir accept this complaint and get my 2 months deposite amount back as soon as possible

Also I agree the painting charges while vacating the apartment is the owners cost as he is getting rent paid for it and a normal wear and tear is expected. If there are any damages done (intentionally or unintentionally) they can deduct the necesssary charges with breakdown rather than making us pay for getting their flat ready for the next tenant to move in. Even the brokers though they take brokerage from us for the flats they are too biased and make such practises a norm and support the owners point of view which makes in more difficult to find a rental place.

The owners in bangalore are taking advantage of the IT boom and trying to loot tenants while vacating the flats by deducting unnecessary charges from the huge security deposit we give them. Understand that they are renting out their apartment but we as tenants are also providing them with steady income and the least we expect is that they are transperant in their dealing and have a fair practise. Its become very difficult to live on rent in bangalore and the people here are very greedy and arrogant. Why cant the owners be more sensible and justful?

I hope there is a law which can curb such unlawful practises.

Even my house owner is also a GREEDY Lady. Many house owners are really very GREEDY and ARROGANT Like Mr. Ravi .

We need to pay half-the amount in all the maintenance work at home when are still in the agreement period. I don't know how much this GREEDY lady is going to loot in my advance amount.

Surely... such GREEDY owners suffer a great loss with others if they continue looting from tenants.
